The Characteristics Of High School Transition Programs That Assist Learning Disabled Students To Succeed At The Post-Secondary Level, Julia Lynn Mcnair Jan 2002

The Characteristics Of High School Transition Programs That Assist Learning Disabled Students To Succeed At The Post-Secondary Level, Julia Lynn Mcnair

Graduate Student Dissertations, Theses, Capstones, and Portfolios

When students with learning disabilities (LD) move from a high school environment in which they are often carefully guided to a setting in post-secondary education, where they are expected to achieve on their own, they may encounter transition difficulties.

The purpose of this study was to investigate the transition programs in place in high school for six successful students with learning disabilities who were enrolled in an institution on a post-secondary level and to measure the effectiveness of the practices of those programs in conjunction with internal characteristics that students brought with them to that environment. The outcome of the …

It's All Relative: A Study On The Acceptance Of Family Employment In College Athletics, Jennifer E. Cirillo Jan 2002

It's All Relative: A Study On The Acceptance Of Family Employment In College Athletics, Jennifer E. Cirillo

Graduate Student Dissertations, Theses, Capstones, and Portfolios

Nepotism is a dirty little word: Related individuals work together in entertainment, medicine, education and yes, even sports administration. This study proposes to identify the acceptance of relatives, by blood or by marriage, working together in NCAA Division II colleges in the southeastern United States. "Nepotism" is an arguably accurate descriptor of arrangements of relatives working together. However, the potential for real as well as asserted preferential treatment is shown to exist. Further, as the trend of couples working in the same discipline grows, whether or not a candidate accepts a position may be determined by the potential manager's acceptance …

Function And Design Revisited, David J. Buller Jan 2002

Function And Design Revisited, David J. Buller

Faculty Articles, Papers, and Other Scholarship

Several analyses of biological function — for example, those of Williams, Millikan, and Kitcher — identify an item's function with what natural selection designed it to do. Allen and Bekoff have disagreed, claiming that natural design is a special case of biological function. I argue that Allen and Bekoff's account of natural design is unduly restrictive and that it fails to mark a principled distinction between function and design. I distinguish two approaches to the phenomenon of natural design — the "trait-centered" approach of Allen and Bekoff and the "organism-centered" approach — and defend the latter. When design is understood …

Agricultural Zoning: Impacts And Future Directions, Mark W. Cordes Jan 2002

Agricultural Zoning: Impacts And Future Directions, Mark W. Cordes

Faculty Articles, Papers, and Other Scholarship

Farmland preservation has become a growing societal concern over the past two decades and is now a common component of any serious discussion of environmental land-use controls. All levels of government have perceived farmland preservation as an important societal goal and have responded with a variety of programs to slow and control the rate of conversion. This article will examine agricultural zoning as a farmland preservation tool. Part one will briefly examine types of agricultural zoning restrictions. Part two, which is the main focus of the article, will examine the impacts of agricultural zoning from four perspectives: (1) Its Legal …

Civil Procedure By Contract: A Convoluted Confluence Of Private Contract And Public Procedure In Need Of Congressional Control, David H. Taylor Jan 2002

Civil Procedure By Contract: A Convoluted Confluence Of Private Contract And Public Procedure In Need Of Congressional Control, David H. Taylor

Faculty Articles, Papers, and Other Scholarship

This article will examine the basic nature of our public system of dispute resolution and consider what role, if any, there is for private contracts that alter that system. This article will begin by tracing the evolution of PLAs from their initial disfavorment by courts to their wide spread present day acceptance. Also, this article will compare the standards for recognition and enforcement of PLAs that have been given life by courts to those that are the creations of deliberative bodies. The main emphasis will be on discussing how effective the various approaches have been in preserving fundamental fairness in …

The Effect Of Palazzolo V. Rhode Island On Takings And Environmental Land Use Regulation, Mark W. Cordes Jan 2002

The Effect Of Palazzolo V. Rhode Island On Takings And Environmental Land Use Regulation, Mark W. Cordes

Faculty Articles, Papers, and Other Scholarship

This article reviews the state of regulatory takings law after Palazzolo, with particular attention to controls on environmentally sensitive land. Part II briefly examines regulatory takings law prior to Palazzolo, first discussing development of the two-prong takings test currently used by the Court and then analyzing how the issue of notice of restrictions had been handled prior to Palazzolo. Part III then examines Palazzolo itself, focusing primarily on the central issue of notice. It demonstrates how the Palazzolo Court rejected a notice preclusion rule, predicated on two rationales: (1) regulations that are takings when enacted cannot become valid by the …

The Economic Performance Of For-Profit And Not-For-Profit Hospitals, Virginia Wilcox-Gök Jan 2002

The Economic Performance Of For-Profit And Not-For-Profit Hospitals, Virginia Wilcox-Gök

Faculty Articles, Papers, and Other Scholarship

This research examines whether for-profit status or system membership is significantly related to the financial performance of hospitals. Panel data containing 573 observations of Florida hospitals for 1984 through 1987 are used in a fixed-effects regression model. The results indicate that it is system membership rather than forprofit status that is significantly related to better financial performance. For-profit status is unrelated to overall financial performance. System hospitals have higher revenues per admission, but not higher expenditures per admission than independent hospitals. The findings are consistent with the hypothesis that expanding hospital systems target locations and services that are potentially profitable.
