Judge Harry Edwards dislikes empirical work that is not flattering to federal appellate judges. A few years ago Dean Richard Revesz published an empirical study of the United States Court of Appeals for the D.C. Circuit providing further support for the rather tame proposition that judges’ political orientation has some effect on outcome in some politically charged cases. A year later Judge Edwards published a criticism phrased in extreme terms. Dean Revesz then wrote a devastating reply by which he demonstrated that Judge Edwards “is simply wrong with respect to each of the numerous criticisms that he levels.” We believe …

The purpose of this study was to examine the relationship between teachers' perceptions of the principal's leadership behavior, either initiating structure or consideration and work motivation of elementary school teachers. The three subscales of motivation are: (1) Intrinsic, (2) Extrinsic, and (3) General Satisfaction. This study also examined the relationship between work motivation and job satisfaction of elementary school teachers based on the teachers' age, years of work experience, and the student enrollment of the school they work in. Academic Achievement As A Function Of Attributions Of Success And Failure And Socio-Cultural Variables In Mexican-American Students, Mary Alice Reyes

The purpose of this research was to examine Mexican-American 8th grade students' attributions of success and failure in school-related contexts. The relationship between and among these attributions, socio-cultural variables and academic achievement was also explored and analyzed. Attribution theory formed the theoretical foundation for the study.

The study utilized three instruments as the primary sources of self-reported data: the Texas Assessment of Academic Skills (TAAS ), Student Achievement Responsibility Survey ( SARS ) (Ryckman, 1985), and the Short Acculturation Scale for Hispanic Youth ( SASH-Y ) (Barona & Miller, 1994). In Chapter 1, it has been demonstrated that the damping treatments for beam and plate structures are effective, and the vibrational behaviors of the systems considered are influenced by many geometrical and material parameters. This has led to an interest in developing advanced “intelligent” structures. In the past, passive and active damping mechanisms have been used to reduce vibration. The uses of passive constrained layers are limited, but it has dissipative qualities for all the modes of the structure; and the uses of active constrained layers are limited to a single mode control. Mediation is a big business today that is practiced by lawyers and non-lawyers, and is closely related to the business of law. Lawyers have a long-standing monopoly on the law business and do not look favorably on sharing their power with nonlawyers. This phenomenon is odd because it occurs at the same time that the legal profession is beginning to embrace a new ethic of problem-solving that honors the values of collaboration and power-sharing among professionals in multiple disciplines. The American legal system has generally rejected legal rights for data privacy and relies instead on market self-regulation and the litigation process to establish norms of appropriate behavior in society. Information privacy is protected only through an amalgam of narrowly targeted rules. The aggregation of these specific rights leaves many significant gaps and fewer clear remedies for violations of fair information practices. With an absence of well-established legal rights, privacy wrongs are currently in search of remedies. When Legislatures Delegate Death: The Troubling Paradox Behind State Uses Of Electocution And Lethal Injection And What It Says About Us, Deborah W. Denno

This article discusses the paradoxical motivations and problems behind legislative changes from one method of execution to the next, and particularly moves from electrocution to lethal injection. This article first examines the constitutionality of electrocution, contending that a modern Eighth Amendment analysis of a range of factors, such as legislative trends toward lethal injection, indicates that electrocution is cruel and unusual. It then provides an Eighth Amendment review of lethal injection, demonstrating that injection also involves unnecessary pain, the risk of such pain, and a loss of dignity. Persistence And Visibility Of Group Faultlines: A Theoretical Model Of The Effect Of Group Culture And Team Identity On The Group Faultlines-Organizational Conflict Link, Katerina Bezrukova, Karen A. Jehn, Madhan Gounder

We expand the group faultline theory by taking into account the relative importance of various demographics within the group that can trigger the formation of strong group faultlines. We draw on group faultline theory (Lau & Murnighan, 1998), social identity and categorization theories (Turner & Tajfel, 1986), social dominance theory (Sidanius & Pratto, 1999), and evolutionary psychology (Kurzban & Leary, 2001) to predict how group faultlines affect conflict. The Effects Of Cross-Level Conflict: The Moderating Effects Of Conflict Culture On The Group Faultlines - Performance Link, Katerina Bezrukova, Karen A. Jehn

We examine how task, relationship, and process conflicts arise from group faultlines. We define group faultlines as hypothetical dividing lines that split a group into subgroups based on the group members' attributes (adapted from Lau & Murnighan, 1998). We further link group conflict to performance, and predict different effects for individual performance, group performance, and employee satisfaction. We also examine the moderating effect of the organizational conflict culture on the relationship between group faultlines and group conflict. This paper describes how the University of Northern Iowa's San Antonio Regional Student Teaching Program developed a course to provide cultural information on Hispanic Americans for its predominantly white student teachers. The course was delivered over 2 semesters; with students doing most work in five 2-hour meetings on campus. During the student teaching semester; they implemented the ideas and activities that they had created during the course.
