The topic of lawyers advertising for clients seems prosaic enough, but it is really a subset of a much larger, more theoretical question. What Americans think about the Constitutional right of lawyers to advertise and market their services both reflects and molds what we think about the right to be left alone. In 1928, Justice Brandeis, in his famous dissent in Olmstead v. United States, wrote that our Constitution "conferred, as against the Government, the right to be left alone-the most comprehensive of rights and the right most valued by civilized men." In one of the most stirring passages in modern ethics, Immanuel Kant famously enjoins: "act that you use humanity, whether in your own person or in the person of any other, always at the same time as an end, never merely as a means." Precisely what Kant means here, however, is not entirely clear. More than one interpretation of this formula is possible. But the importance of Kant's "formula of ends" in modern moral philosophy is impossi- ble to deny.

In Law and Social Norms, Eric Posner offers an original and important theory of the emergence of norms. According to Posner, norms are collections of signals. He develops his signaling account in a variety of contexts, including criminal law, family law, political participation, and racial discrimination. This article extends Posner's theory to cyberspace, a domain of social organization not touched on in Posner's book. In particular, I will test Posner's theory by examining how well it explains the emergence of Web site privacy norms. Part One will examine signaling theory. Professor Eric A. Posner has written a fascinating book about "Law and Social Norms." In it, he uses an informal signaling model (derived from Michael Spence's formal model) to explain a wide range of striking social behavior, and to show underlying connections among apparently disparate phenomena. Looking at topics as dissimilar as gift giving, family law, criminal law, voting and political participation, and commercial practice, he argues that much of observed social behavior can be understood as the result of attempts to signal that one is a good cooperator.

Eric Posner's cooperation theory of social norms develops from rational choice theory an austere and powerful explanation of why people comply with social norms. He illustrates his theory with subtle analysis of a number of legal issues. The book will help anyone influenced by law and economics to incorporate into her thinking the work in sociology, psychology, and ethics that bears on human behavior. Most readers will find applications for Posner's theory.

Although criminal law can be justified with respect to non-utilitarian goals such as retribution, no one can deny that one way to justify criminal law is with respect to the instrumental ends of deterrence. So, one question of interest to scholars in the field has been how to think about the kinds of criminal law policy that encourage compliance. My own work has focused on this important question. Specifically, I have been concerned with the ways in which different kinds of criminal proscriptions, along with certain methods of law enforcement, could affect crime rates in disadvantaged, urban neighborhoods. The Strategic Alternative: How State Takings Statutes May Resolve The Unanswered Questions Of Palazzolo, Michael A. Culpepper

In a world of "Hobbesian stick[s]" and "Lockean bundle[s]," analytical confusion should be expected. Indeed, critics describe the world of federal takings jurisprudence as "an unworkable muddle," as "a jumble of confusing holdings," and as a body of law existing in "doctrinal and conceptual disarray." Since the United States Supreme Court first considered the regulatory takings issue in Mugler v. Kansas, the Court's inconsistent application of the doctrine has largely conformed to criticism. Governed by abstruse metaphors' and ad hoc analysis, the Court acknowledges its imprecision 9 and often relies upon it.

One of the most notable trends in legal scholarship is the explosion of writing on social norms. Just a few years ago one might have argued that the scholarship was marginal, of interest to only a handful of law professors, but expressions of skepticism about the value of this scholarship have become rare. One of the major difficulties faced by MEMS researchers today is the lack of data regarding properties of electroplated metals or alloys at micro-levels as those produced by the LIGA and LIGA related process. These mechanical properties are not well known and they cannot be extrapolated from macro-scale data without experimental verification. This lack of technical information about microscale physical properties has affected the consistency and reliability of batch-fabricated components and leads to very low rates of successful fabrication. The Thumb Member of the Miocene Horse Spring Formation contains a vertebrate track assemblage of mammal (camel and carnivore) and avian footprints. Camelid tracks identified are Lamaichnum alfi, Lamaichnum macropodum, and Lamaichnum etoromorphum. Carnivore tracks include canid tracks (Canipeda sp.) and a possible felid track ( Felipeda? sp.). One canid trackway records a c-shaped pattern, which is apparently the fist documentation of a rotary gallop gait in Miocene canids. Five types of bird tracks, four of which are previously undescribed, also occur. They are: (1) Alaripeda lofgreni, (2) Avipeda sp. A, (3) Avipeda sp. B, (4) Anatipeda sp. A, and …

This research took an age-related condition, diffuse idiopathic skeletal hyperostosis (DISH) and used it to create a new technique for estimating the age at death of older human skeletal remains (age ≥40). Diffuse idiopathic skeletal hyperostosis is a condition characterized spinally by ossification of the anterior longitudinal ligament resulting in fusion of vertebrae; and extraspinally by enthesopathies, ossification at sites of ligament or muscle attachments. Using the Terry Collection, housed at the Smithsonian Institution, National Museum of Natural History, 1728 human skeletons of known age at death were analyzed looking for evidence of spinal DISH. This thesis develops a two-dimensional grid system for the determination of the haul distance and direction to haul the soil on a mass excavation project using linear optimization programming methodology. The system generates a mathematical solution for the minimum haul distance and the direction in which to haul the soil for each unit of the program grid when formulated with the proper input. The necessary inputs are the calculated cut and fill quantities for each cell of an X-Y coordinate grid system. Until now, no one has published what specific theatre texts should be taught to students in high school before they graduate. However, with national standards paving the way for the future of education, and the idea that no child will be left behind, every curriculum, not just the core ones, needs to have a list of required reading before a student graduates from high school. This study investigated the difference in Mean Arterial Pressure (MAP) and Cardiac Output (CO) between two methods of isometric muscle contractions during the Anti-G Straining Maneuver (AGSM). 12 subjects (ages 18 to 38 yrs, height 176.8 +/- 7.4 cm, body mass 78.8 +/- 15.6 kg, percent body fat 14.3 +/- 6.6%) participated in the study. The study was a one-way within-subject design with test conditions counterbalanced. Two methods of isometric muscle contractions lasting 30 seconds each were assessed; an isometric push contraction and an isometric muscle tensing contraction. Denitrification in biological reactors has been widely studied, whereas, little is known about denitrification occurring in secondary clarifiers. In this study an attempt was made to study denitrification occurring within a secondary clarifier at the Clark County Sanitation District (CCSD) wastewater treatment plant, Las Vegas. The results obtained from this study showed that denitrification and phosphorus (P) release were occurring within the CCSD clarifiers. Dissolved oxygen (DO) and soluble COD concentrations were found to be the most influencing parameters on denitrification and P-release within the clarifiers. In this study, comparisons were made on the methods for bulk specific gravity measurements of rutted and unrutted Hot Mix Asphalt (HMA). Bulk specific gravity determination was performed using three methods: Water Displacement(TM), Parafilm(TM) and Corelok(TM). The evaluations were made on a total of sixty-two sets of two or three specimens, four different mix designs for rutted specimens, and three different mix designs for the unrutted specimens. The bulk specific gravity test results were compared for similarity of the methods and repeatability of the measurements for each method.
