The Taliban’S ‘Other’ Crimes, Mark A. Drumbl Jan 2002

The Taliban’S ‘Other’ Crimes, Mark A. Drumbl

Scholarly Articles

This paper explores possible legal responses to the Taliban's 'other' crimes--those inflicted against Afghans during Taliban rule. This criminality largely has been rendered invisible by virtue of the international community's focus on punishing the Taliban's support of transnational terrorists, in particular al-Qaeda. This invisibility is problematic given that carefully constructed prosecutions of these 'other' crimes could play an important role in post-conflict reconciliation and national reconstruction in Afghanistan. Such reconciliation and reconstruction can legitimise a representative post-conflict state and curb terrorist recidivism.

Using Benford's Law To Detect Fraud In The Insurance Industry, Meredith Maher, Michael D. Akers Jan 2002

Using Benford's Law To Detect Fraud In The Insurance Industry, Meredith Maher, Michael D. Akers

Accounting Faculty Research and Publications

Benford's Law is the mathematical phenomena that states that the first digits or left most digits in a list of numbers will occur with an expected logarithmic frequency. While this method has been used in industries such as oil and gas and manufacturing to identify fraudulent activity, it has not been applied to the health insurance industry. Since health insurance companies process a large number of claims each year and these claims are susceptible to fraud, the use of this method in this industry is appropriate. This paper examines the application of Benford's Law to four health insurance companies located …

The Breadth Of The Anti-Trafficking Provisions And The Moral High Ground, Jessica D. Litman Jan 2002

The Breadth Of The Anti-Trafficking Provisions And The Moral High Ground, Jessica D. Litman

Book Chapters

This is a cautionary tale. Back in 1996, 1997 and 1998, the law prohibiting circumvention of "access controls" was conceived, described and defended on the ground that it was very narrow. Initially, "access" was intended to mean initial access - the digital equivalent of breaking into a bookstore to steal a book. Copyright owners, though, insisted that "access controls" should also include devices to facilitate pay-per-view. Since that would require protecting works against continuing access, copyright owner lobbyists resisted any narrowing language. Still, when opponents of section 1201 complained to Congress that the language before it might give copyright owners …

Restorative Justice And Collective Responsibility: Lessons For And From The Rwandan Genocide, Mark A. Drumbl Jan 2002

Restorative Justice And Collective Responsibility: Lessons For And From The Rwandan Genocide, Mark A. Drumbl

Scholarly Articles

Genocide struck Rwanda in 1994. Since then, national and international trials have endeavored to promote reconciliation, deterrence, peace, justice, and human rights. This article posits a disconnect between these trials and the attainment of their avowed goals. This disconnect emerges in part from the influential agendas of international lawyers who equate selective criminal prosecution with the "rule of law" and espouse criminal prosecution as the preferred and uniform response to mass atrocity. Creating a presumption in favor of criminal prosecution has dampened the need to explore whether such trials actually are suitable for the particular afflicted society. A socio-legal analysis …

Affiliation Among Females In Wild Hamadryas Baboons (Papio Hamadryas Hamadryas), Larissa Swedell Jan 2002

Affiliation Among Females In Wild Hamadryas Baboons (Papio Hamadryas Hamadryas), Larissa Swedell

Publications and Research

Previous studies of hamadryas baboons have described a “star-shaped” sociogram, whereby the strongest social bonds within hamadryas one-male units are those between a leader male and his females and bonds among females are weak by comparison. This type of social organization has also been called “cross bonding” to distinguish it from the “female bonding” found in most papionin monkeys. Models of female primate socioecology have suggested that hamadryas baboons lack female bonding due to their reliance on scarce, widely-dispersed food resources. Here I report observational data from a wild population of hamadryas baboons in Ethiopia indicating that, while females varied …

Ranging Behavior, Group Size, And Behavioral Flexibility In Ethiopian Hamadryas Baboons (Papio Hamadryas Hamadryas)., Larissa Swedell

Publications and Research

This study reports group size, home range size, daily path lengths, seasonal effects on ranging behavior and qualitative information on diet for a population of hamadryas baboons inhabiting the lowlands of the northern Rift Valley in central Ethiopia. The minimum home range size and daily path length for this population are similar to those reported for other populations of hamadryas baboons in Ethiopia and Saudi Arabia. Group sizes, however, are much larger than those in most other hamadryas populations for which published data are available. The large group sizes in this area may be related to the abundance of one …

Stable Isotopes Of Carbon As An Invaluable Stratigraphic Tool: An Example From The Cambrian Of The Northern Appalachians, Usa, Bosiljka Glumac, Malkah L. Spivak-Birndorf

Geosciences: Faculty Publications

This study illustrates the usefulness of carbon isotopes in stratigraphic interpretations of poorly fossiliferous strata beyond the resolution possible by biostratigraphy. The Upper Cambrian strata of the lower Gorge Formation in northwestern Vermont have been interpreted as highly condensed continental-slope deposits with a hiatus bracketed by the trilobite fauna of the Dunderbergia zone (Steptoean) and the Saukia zone (upper Sunwaptan). This interpretation was based on information from two thin fossiliferous intervals, the occurrence of one of them being unconfirmed in a recent study. Carbon isotopes provide a means for testing this interpretation because marine carbonate rocks deposited during the Steptoean …

Cosmology With Negative Potentials, Gary Felder, Andrei Frolov, Lev Kofman, Andrei Linde Jan 2002

Cosmology With Negative Potentials, Gary Felder, Andrei Frolov, Lev Kofman, Andrei Linde

Physics: Faculty Publications

We investigate cosmological evolution in models where the effective potential V(f) may become negative for some values of the field f. Phase portraits of such theories in the space of variables (f,f˙ ,H) have several qualitatively new features as compared with phase portraits in the theories with V(f).0. Cosmological evolution in models with potentials with a ‘‘stable’’ minimum at V(f),0 is similar in some respects to the evolution in models with potentials unbounded from below. Instead of reaching an AdS regime dominated by the negative vacuum energy, the universe reaches a turning point where its energy density vanishes, and then …

現代小說中的食物與愛情, Leyun Chen Jan 2002

現代小說中的食物與愛情, Leyun Chen

Dissertations from all years
