'Can We Go Home Now?' Expediting Adoption And Termination Of Parental Rights Appeals In Ohio State Courts, Susan Wawrose

Two years ago, the Ohio Supreme Court amended its rules and those of Ohio's intermediate appellate courts in order to fast-track appeals of cases involving termination of parental rights ("TPR") and adoption of minor children. Three of Ohio's twelve appellate districts already had local rules to expedite or accelerate these types of appeals, but in some districts, the amended rules established procedures that were entirely new.

The major impetus behind the court's amendments to the rules was to move children out of foster care and into permanent adoptive homes more quickly. Further, by amending the rules of the intermediate appellate …

This essay proceeds in two parts. The first half presents the authors understanding of the major steps in Eisgruber's argument. The second half of this essay will be devoted to discussing both the most troubling aspect of Eisgruber's account, in my view, and its most valuable contribution to a better polity. Both center around his pervasive reliance on the concept of moral judgment.

The Enigma Of Stigma: A New Environmental Contamination Challenge Facing Canada's Judiciary, Jodie Hierlmeier

Would you buy previously contaminated property? The average citizen, given the choice between property with no history of contamination and one with prior environmental problems (even if they have been remediated), will instinctively choose the former over the latter. This is the phenomenon known as stigma. The recent case, Tridan Developments Ltd. v. Shell Canada Products Ltd. marks the first time that Canadian courts have squarely addressed the issue of stigma with the trial judge awarding damages for the diminution in property value over and above the costs of remediation for a contaminated property on the basis of stigma. JMU's Mine Action Information Center (MAIC) held a workshop on May 13-14, 2002 to examine issues related to landmine victim data collection. The U.S. Department of State, Office of Humanitarian Demining Programs was the sponsor of the two-year long casualty database project conducted by the MAIC, of which the workshop was the culminating phase. Based on its research and the workshop activities, the MAIC has developed a list of "action items" which it recommends to improve the collection and management of landmine casualty data. That list immediately follows this executive summary.

The Availability Heuristic In Judgments Of Research Findings: Manipulations Of Subjective Experience, Michele A. Shams

Previous studies have demonstrated that what is easy to call to mind will influence judgments. The impact of a person's subjective experience was tested for its influence on judgments of social psychological research findings. Eighty three college students generated examples of 40 research findings. Students subsequently judged the ease with which the examples came to mind and the probability of experiencing similar examples. Students then evaluated the obviousness and importance of and their interest in the research outcomes. The hooded pitcher plant, Sarracenia minor, is an important member of bog and seepage savanna communities of the southeastern United States. Unfortunately these wetland communities have been damaged and are disappearing at an alarming rate. The goal of this study was to collect baseline data, which will be ultimately used to develop a model of the survivorship, growth rate, morphology and population dynamics of four populations of Sarracenia minor.
