The challenge of contemporary health care distribution is to structure a framework for normative decision making whereby the goal of distributive justice is achieved equitably for as many citizens as possible. Establishing fair procedures for the distribution of health care resources is a crucial goal for contemporary society to set and, hopefully, to achieve. It is only by and through deliberate debate within a democracy that assumptions, for example, about aging, the value of life for the aged and intergenerational responsibilities of assisting them in their care can be set, tested or - as the case may be - rejected. …

The first theme can be found in many works of constitutional theory-the construction of a strong opposition between the supposedly debased behavior of elected representatives and the supposedly more elevated behavior ofjudges. The second theme emerges from Professor Eisgruber's distinction between comprehensive rights, which call for "an assessment of an entire system of social interaction," and discrete rights that "prescribe[] specific forms of government actions."'

Constitutional Self-Government And Judicial Review: A Reply To Five Critics, Christopher L. Eisgruber

Several of my critics argue as though the central purpose of Constitutional Self-Government were to defend an aggressive form of judicial review, in which all, or nearly all, moral issues are decided by judges. But that is not my goal. Instead, Constitutional Self-Government targets the common view that even if judges can protect rights or advance principles ofjustice better than can legislatures, judicial review is nevertheless at least problematic, and perhaps undesirable, because it is undemocratic.
