"Our System Is Broken": A Study Of The Crisis Facing The Death-Eligible Defendant, Kelly Reissmann

Northern Illinois University Law Review

Courts have been reluctant to find instances of ineffective assistance of counsel in death penalty cases. Most ineffective assistance claims are dismissed as "tactical decisions" or nonprejudicial error. This comment examines the inadequacy of counsel at capital trials. The author examines and discusses the current standard for determining whether a defendant's attorney was ineffective, and through a survey of common errors and examples argues that the standard does not protect against even egregious examples of ineffective assistance. The comment discusses reasons why capital defendants often receive low quality representation and some legislative solutions that have been attempted. Concluding that these …

The Case For Requiring A Proportionality Test To Assess Compliance With Title Ix In High School Athletics, Patrick N. Findlay

The debate over Title IX and athletics has neglected the impact that Title IX could have on high school athletic programs. An increased focus on high school athletic opportunity is important because the benefits for girls that participate in athletics as they grow up, and for society, are so significant. In this article, the author proposes that compliance with Title IX in high school athletics is only appropriately measured by way of a test that requires schools maintain athletic participation rates for each sex in proportion to the population of each sex within the school. Preference And Perceived Danger In Field/Forest Settings, Thomas R. Herzog, Glenn E. Kutzli

The authors investigated preference, perceived danger, and fear for a sample of 70 field/forest settings. Predictor variables included perception-based variables (visual access, penetration,movement ease), information-based variables (mystery, concealment, refuge), and variables thought to intervene between concealment and danger (entrapment, rearview concern). All variables were rated by independent groups. Danger and fear were strongly positively correlated for these settings, but preference and danger had a more modest negative correlation. Factor analysis of the strongly inter-correlated predictor variables yielded two factors, interpreted as Visibility and Locomotor Access. Both factors were positive predictors of preference and negative predictors of danger. Further analyses suggested …

This paper looks at a recent historical moment in which the American national identity was defined and contested in the public arena. The Persian Gulf crisis of 1990-91 presents a case in point in which official actors attempted to define the American character and in doing so prescribed particular actions necessary to fulfill what it means to be an American. President George Bush’s discourse used the crisis to rejuvenate US prestige and American confidence. He described Americans as unique in esteemed values and America as the only country capable of leading the world. In so doing, he invited American participation …

Fragmentation Processes Following Core Excitation In Acetylene And Ethylene By Partial Ion Yield Spectroscopy, Maria Novella Piancastelli, Wayne C. Stolte, Gunnar Ohrwall, S-W Yu, D. Bull, K. Lantz, Alfred S. Schlachter, Dennis W. Lindle

Chemistry and Biochemistry Faculty Research

Partial ion yield spectroscopy provides a very detailed picture of fragmentation processes following core excitation in isolated molecules. We exploit this potential in the analysis of decay processes following C1s→π and C1s→Rydberg excitations in ethylene and acetylene. We show that the relative intensity of spectral features related to the excitation to empty molecular orbitals or to Rydberg states is a function of the time variation of the fragmentation process. Namely, we see an intensity increase in the Rydberg states compared to the molecular orbitals as the fragmentation process becomes more extensive, a result attributable to the diffuse nature of the …

OSGi (Open Service Gateway initiative) is an emerging technology to address the missing point in the value chain to deliver services (pay-per-view TV programs, energy management, security management, etc.) to home premises. It offers an open platform and contacting point to allow service providers (cable companies, utility companies, etc.) to easily and quickly develop, download and update services to customers in a home or SOHO/ ROBO (Small Office Home Office / Remote Office Branch Office) environment. Expansive clay soils-those that change significantly in volume with changes in water content-are the cause of distortions to structures that cost taxpayers several billion dollars annually in the United States. Much has been learned about their behavior over the past 60 years, and relatively successful methods have been developed to modify and stabilize them. This paper reviews some of the key advances developed over the past 60 years in improving our understanding of the nature and methods of modifying and stabilizing expansive clay soils. New work on heuristics and biases has explored the role of emotions and affect; the idea of “dual processing”; the place of heuristics and biases outside of the laboratory; and the implications of heuristics and biases for policy and law. This review-essay focuses on certain aspects of Heuristics and Biases: The Psychology of Intuitive Judgment, edited by Thomas Gilovich, Dale Griffin, and Daniel Kahneman. An understanding of heuristics and biases casts light on many issues in law, involving jury awards, risk regulation, and political economy in general.
