Genetic Diversity And Competitive Abilities Of Dalea Purpurea (Fabaceae) From Remnant And Restored Grasslands, Danny J. Gustafson, David J. Gibson, Daniel L. Nickrent Nov 2002

Genetic Diversity And Competitive Abilities Of Dalea Purpurea (Fabaceae) From Remnant And Restored Grasslands, Danny J. Gustafson, David J. Gibson, Daniel L. Nickrent

Publications

Allozyme and randomly amplified polymorphic DNA (RAPD) analyses were used to characterize the genetic relationships of Dalea purpurea from remnant and restored Illinois tallgrass prairies and a large remnant tallgrass prairie in Kansas. The remnant Illinois populations were less genetically diverse than the restored Illinois populations and the Kansas population. These restored Illinois populations were established with at least two seed sources that were locally collected. There was little population divergence (Fst = 0.042), which ST is consistent with other perennial forbs, while the genetic relationships among populations reflected geographic proximity. In a greenhouse competition experiment, differences in performance …

Corporate Governance Reform And Reemergence From Bankruptcy: Putting The Structure Back In Restructuring, Charles M. Elson, Paul M. Helms, James R. Moncus Nov 2002

Corporate Governance Reform And Reemergence From Bankruptcy: Putting The Structure Back In Restructuring, Charles M. Elson, Paul M. Helms, James R. Moncus

Vanderbilt Law Review

A company's descent into bankruptcy may result from one or more troubling factors. Often the failing enterprise has adopted a poor business model, been led by deficient management, or labored under an unworkable capital structure. More often than not, a business failure is also accompanied by a less-than-ideal corporate governance structure within the organization. The failure to adopt an effective corporate governance model often leads to a sterile, inactive board of directors and may hasten a firm's demise. Conversely, proper corporate governance may prevent a business's slide into Chapter 11. Indeed, several studies have demonstrated a strong relationship between corporate …

"Delaware Is Not A State": Are We Witnessing Jurisdictional Competition In Bankruptcy?, Marcus Cole

Vanderbilt Law Review

Over the last twelve years, the United States District Court for the District of Delaware has experienced exponential growth in the number of bankruptcy filings for large corporate debtors. This relatively recent rise in Delaware bankruptcy venue cannot, on its face, be explained by Delaware's eighty-five-year preeminence in the race for corporate charters, since the advantages most often postulated for Delaware's dominance in corporate law do not carry over to corporate bankruptcy. The state has limited influence over federal bankruptcy law and virtually no control over the selection of federal bankruptcy judges. This rise of Delaware bankruptcy venue, or Delawarization …

Employer Notice Requirements Under The Family And Medical Leave Act, Richard Bales, Sarah Nefzger Nov 2002

Employer Notice Requirements Under The Family And Medical Leave Act, Richard Bales, Sarah Nefzger

Missouri Law Review

This Article argues that Department of Labor regulations should continue to require employers to make a pre-leave designation of whether FMLA leave will run concurrently with, or consecutive to, the employer’s leave and give notice to their employees, but that the penalty for an employer’s noncompliance should be modified to comply with the Supreme Court’s decision in Ragsdale v. Wolverine World Wide, Inc. These conflicting positions are evaluated by analyzing the rationales behind the dicisions to impose or not to impose employer notice requirements. This Article argues that the courts should require employers to notify employees whether employer-provided leave runs …

Complex congenital anomalies of the mullerian ducts can occur in isolation or in association with other developmental disorders. They result from non-development or non-fusion of the mullerian ducts or the failure of reabsorption of the uterine septum. Early diagnosis is necessary to relieve symptoms, optimize preservation of the genital organs and prevent the development of endometriosis. We present a case report to highlight this phenomenon.

Treatment Of Tuberculous Spondylitis At The Cervicothoracic Junction. Clinical Impact Of Surgery By Means Of A Sternotomy, Stefan M. Knoeller, Ludwig F. Brethner

Saudi Medical Journal

The operative treatment of tuberculous spondylitis remains a challenge with regard to the surgical approach to the cervicothoracic junction. In addition, it is difficult to restore the resected vertebral bodies. Two cases of tuberculous spondylitis in this area are presented. The first case concerns a 25-year-old African patient suffering from the effects of tuberculous spondylitis: Destruction of vertebral bodies dorsal (D)1, D2, and D3, kyphosis coupled with compression of the spinal cord, as well as incomplete motor and sensory paraplegia (Frankel grade C). The operative treatment of tuberculous spondylitis that is described, approached the cervicothoracic junction by means of a …

Effect Of Sucrose Esters And Sunflower Oil Addition On Microstructure Of A High-Melting Milk Fat Fractions, Silvana Martini, M. C. Puppo, R. W. Hartel, M. L. Herrera Nov 2002

Effect Of Sucrose Esters And Sunflower Oil Addition On Microstructure Of A High-Melting Milk Fat Fractions, Silvana Martini, M. C. Puppo, R. W. Hartel, M. L. Herrera

Nutrition, Dietetics, and Food Sciences Faculty Publications

The effects of sunflower oil (SFO) and the sucrose esters (SE) P-1670, P-170, and S-170 on crystalline microstructure of a high-melting milk fat fraction (HMF) was studied by polarized-light microscopy (PLM) and confocal laser scanning microsopy (CLSM). The addition of SFO markedly diminished crystal size and delayed crystallization kinetics, as observed in PLM images. Addition of P-1670 modified crystallization behavior only slightly. Addition of P-170 and S-170, however, markedly diminished crystal size and led to more transparent crystals, with lower amount of solids in each crystal. These results show that the microstructural properties of HMF were modifed by addition of …

Spillover Effects Of Fdi On Innovation In China : An Analysis Of Provincial Data, Kui Yin Cheung, Ping Lin Nov 2002

Spillover Effects Of Fdi On Innovation In China : An Analysis Of Provincial Data, Kui Yin Cheung, Ping Lin

CAPS Working Paper Series

We use the provincial data from 1995 to 2000 to test the impact of inward FDI on innovation activity in China. We found a positive effect of FDI on the number of patent applications filed by the domestic firms. This positive relationship persists when we divide the patents by types (invention, utility model and external design) and when we group the provinces into regions (the coastal, central, and the western regions). This positive spillover effect is much stronger for minor innovations such as external design and utility model, highlighting a "demonstration effect" of FDI. However, FDI into the coastal region …

The US National Science Foundation has established a program to create a National Science, Mathematics, Engineering and Technology Education Digital Library (NSDL). One of the subsidiary NSDL libraries under development is the National Civil Engineering Educational Resources Library (NCERL). The first phase of NCERL is the creation and collection of digital resources in three areas of civil engineering—geotechnical (soil), rock, and water engineering (GROW). The concept of interactivities guides the design, development, and evaluation efforts of the GROW digital collection. This article describes the salient features of GROW, defines and discusses interactivities as an emerging, integral part of teaching and …

A Semi-Infinite Interfacial Crack Between Two Bonded Dissimilar Elastic Strips, Xiang-Fa Wu, E. Lilla, W.-S. Zou Nov 2002

A Semi-Infinite Interfacial Crack Between Two Bonded Dissimilar Elastic Strips, Xiang-Fa Wu, E. Lilla, W.-S. Zou

Department of Engineering Mechanics: Faculty Publications

This paper is concerned with a semi-infinite interfacial crack between two bonded dissimilar elastic strips with equal thickness. Solutions for the complex stress intensity factor (SIF) and energy release rate (ERR) are obtained in closed form under in-plane deformations. During the procedure, the mixed boundary-value problem is reduced by means of the conformal mapping technique to the standard Riemann–Hilbert problem. In some limiting cases, the present solutions can cover the results found in literature.

Individual, Temporal, And Seasonal Variation In Sperm Concentration In Tree Swallows, Michael P. Lombardo, Armetris N. Forman, Matthew R. Czarnowski, Patrick A. Thorpe Nov 2002

Individual, Temporal, And Seasonal Variation In Sperm Concentration In Tree Swallows, Michael P. Lombardo, Armetris N. Forman, Matthew R. Czarnowski, Patrick A. Thorpe

Peer Reviewed Publications

We determined sperm concentrations in Tree Swallows (Tachycineta bicolor) by manually expressing semen samples from males during prelaying, egg-laying, incubation, and nestling periods. Sperm concentrations varied by orders of magnitude (0-109 sperm mL-1) among males. Sperm concentrations were highest during the incubation period and lowest during the prelaying period. None of the samples collected during the prelaying, egg-laying, and incubation periods were devoid of sperm. In contrast, 45% of samples collected during the nestling period lacked sperm. Sperm concentrations (1) did not vary over the course of the morning during prelaying, egg-laying, and incubation periods …

Historical Perspectives On Violence Against Women, Vivian C. Fox Nov 2002

Historical Perspectives On Violence Against Women, Vivian C. Fox

Journal of International Women's Studies

Three great bodies of thought have influenced western society’s views and treatment of women: Judeo-Christian religious ideas, Greek philosophy and the Common Law legal code. All three traditions have, by and large, assumed patriarchy as natural – that is male domination stemming from the view of male superiority. As part of the culture perpetuated by these ideologies, violence towards women was seen as a natural expression of male dominance. This paper contains three main themes. The first establishes patriarchy as an early pattern of military societies and the subsequent emergence of the Judeo-Christian, Greek and legal cultural paradigm as ideological …

How Was It For You? The Oligarchic Structure Of International Relations And Feminist Theory, Leonard A. Stone Nov 2002

How Was It For You? The Oligarchic Structure Of International Relations And Feminist Theory, Leonard A. Stone

Journal of International Women's Studies

It is my purpose to show that radical humanist and feminist theorising have much to offer each other. Central to this article’s thesis is the oligarchic structure of international relations; that is, a small, oligarchic clique of states exercising power in its own interests to the detriment of the overwhelming majority of the world’s population. The core position and borders of radical humanist theorising are examined, along with an assessment of some of the major the theoretical divergences between radical humanist and feminist theorising. Areas for theoretical alliance are also located which indicate the necessity of an inter-disciplinary approach that …

Faculty lectures are enhanced by guest lectures and class field trips. Guest lecturers include a prosthetist and a lower extremity amputee client, an engineer/prosthetist specializing in the upper extremity, and a rehabilitation engineer. The lower extremity prosthetist and his client present a case study for prosthetic prescription, fabrication, fitting, alignment, and evaluation. The engineer/prosthetist contrasts body-powered versus externally powered upper extremity prostheses and associated design, fitting, and functional considerations; he also discusses …

The Virtue Of Vagueness In Takings Doctrine, Marc R. Poirier Nov 2002

The Virtue Of Vagueness In Takings Doctrine, Marc R. Poirier

Cardozo Law Review

In discussions of regulatory takings law, there appears to be an almost universal assumption that its vagueness is a bad thing, a mysterious dysfunction. This article argues that the vagueness in takings doctrine is quite functional and entirely appropriate. Since considerable vagueness turns out to be inevitable, this is just as well. Happily, over time, specific resource use conflicts and transitions sometimes do crystallize out into more predictable forms of law - new rules and customs about specific types of property. Within these specific and limited regimes, we can and should aspire to rules defining the circumstances under which the …

Conformity And Dissent, Cass R. Sunstein Nov 2002

Conformity And Dissent, Cass R. Sunstein

Public Law and Legal Theory Working Papers

Much of the time, human beings do what others do. This is perfectly sensible, because the actions and statements of other people convey valuable information about what should be done. In addition, most people want the good opinion of others, and this desire promotes conformity. But conformity can lead both groups and institutions in unfortunate and even catastrophic directions. The most serious problem is that by following others, people fail to disclose what they know and believe, thus depriving society of important information. Those who dissent, and who reject the pressures imposed by others, perform valuable social functions, often at …
