The choice between "de jure" and "de facto" standards of review arises whenever a legal standard is needed to identify violations of specific constitutional rights or norms in particular cases. The issue is methodological in the sense that the question is faced regardless of the particular right or norm at issue (although it is not really true that the choice between these methodologies would have no influence on the choice of rights or norms to apply). Throughout South Asia, men, women, boys, and girls are trafficked within their own countries and across international borders against their wills in what is essentially a clandestine slave trade. The Congressional Research Service and the U.S. State Department estimate that between 1 to 2 million people are trafficked each year worldwide with the majority originating in Asia. Root causes include extreme disparities of wealth, increased awareness of job opportunities far from home, pervasive inequality due to caste, class, and gender bias, lack of transparency in regulations governing labor migration, poor enforcement of internationally agreed-upon human rights standards, and the enormous …

Do modem Canadian playwrights have a better chance of controlling the production of their plays? The original copyright for a play belongs to the playwright who may sell or assign it. Surabaya is Indonesia’s second largest city but is not well known to the outside world. Yet in 1900, Surabaya was a bigger city than Jakarta and one of the main commercial centers of Asia. Collapse of sugar exports during the 1930s depression, followed by the Japanese occupation, revolution, and independence, brought on a long period of stagnation and retreat from the international economy. Not until the export boom of the 1990s did Surabaya regain prominence as Southeast Asia’s leading non–capital–city industrial area. This Article offers a critical reassessment of U.S. approaches to intellectual property protection for plant innovation. Three developments make this reassessment timely. First, the Supreme Court has finally confirmed that utility patent claims to plants and seeds satisfy the 35 U.S.C. Section 101 subject matter eligibility requirement. Plant innovation in the United States is now subject to utility patent protection, as well as concurrent protection under the Plant Variety Protection Act (PVPA). However, little work has been done to explain the role of PVPA protection in a system of concurrent protection, or to develop a coherent policy vision within which …

The decade of the 1980s has often been considered a reactionary artistic wasteland in film studies, but it was nonetheless a period of volatile changes for the film industry. This period saw the decline of the mainstream horror film and the rise of the family film, two currents that reflect and illuminate the enormous changes in film production, marketing, and distribution. The hybrid genre of the childrens horror film, born in the 1980s, is particularly apt for discussing both the industry changes in this period and childrens relationship as viewers to the medium of film. In 1933, Sharon's Cultural, Educational, Recreational Association (SCERA) was founded by the Sharon Stake of the Church of Jesus Christ of Latter-day Saints in Orem, Utah. When founded, its purpose was to provide wholesome family-oriented events, theatrical productions, and showcase Community talent. Today, in a world of declining morals, SCERA continues to provide clean entertainment for families. This paper has its roots in Old Chief v. United States, a case the Supreme Court of the United States decided in 1997. I will begin by describing this case; then comment on its implications for the Supreme Court’s conception of the jury, and conclude by examining the agenda one may draw from it for empirical jury research. This essay, written for the National Association of Environmental Law Societies' (NAELS) annual meeting, explains how patent law operates generally with an emphasis on how it may impact the environment in particular. In so doing, the essay addresses from a patent perspective some representative concerns relating to patents that appear to be prevalent in the environmental literature and shows how the patent system may provide substantial benefit for those favoring the environment.

Ralph Waldo Emerson's publication of Nature in 1836 began a process of creating a new condition of American thinking, severed from European cultural and intellectual influences. The subsequent lectures The American Scholar and The Divinity School Address furthered this process, calling for an original American literature. Emerson's writing called consistently for poets with the ability to "see" past the material, apparent world to the world of eternal forms, which shaped nature in accordance with a divine moral imperative. Through this connection, man-as-poet would discover God in himself. In short, Emerson effectively transferred divinity from Unitarian doctrine to the individual, thereby …

Neo-Onnagata: Professional Cross-dressed Actors and Their Roles on the Contemporary Japanese Stage explores the representation of male and female gender in the contemporary Japanese theatre. I particularly discuss a specialized subset of Japanese actor: the neo-onnagata, a contemporary theatre counterpart to Japan's highly stylized classical kabuki tradition of cross-dressed representation. This dissertation represents my attempt to provide these basic aims: to situate the contemporary Japanese cross-dresser in Japanese tradition, to show how cross-dressing acts as a sharp social commentary and mirror, and to introduce some little-represented cross-dressing actors of the contemporary Japanese stage to the academic community at large. This dissertation addresses the problem of the denigration of the voice in poststructural theory and contemporary performance criticism. The problem has antecedents in twentieth-century language philosophy. Saussure defines language as a compendium of arbitrary words recognized according to the degrees of phonetic difference between them. Since for Saussure the arbitrary words of language also designate arbitrary concepts, he concludes that the sounds of words cannot be thought constituent of their sense. After Saussure, structuralism dislodges the voice from its privileged position in the phonologic discourses of Western thought. Poststructuralism views meaning as a product of socially constructed language systems, and …

A given organization may participate in the coalition only at the stage where its expertise or resources are most needed, while other organizations may participate through the entire course of the operation. The Youngstown holding is widely admired. One reads with pride those passages in which the Supreme Court denies to a president with whom they are in considerable political sympathy the power to enlarge executive authority by militarizing the homeland. And yet one wonders, as we confront in the 21st century a lethal foreign enemy who has demonstrated the ability to infiltrate and assault the domestic environment, precisely what restraints ought to govern a presidential response to that enemy.

The main purpose of this study was to investigate the development of the problem-solving skills of eleven year olds in a Western Australian Primary school when the teacher and the children were in-role within the drama. The teacher, as teacher in-role, and the students role-played a variety of situations in which effective problem-solving skills were used. As the study progressed the nature of the children's use of symbol and metaphor became an important issue.
