Justice For Perpetrators And Victims Of Apartheid Who Fall Outside The Scope Of The Truth And Reconciliation Commission’S Mandate, Christopher J. Roederer, Kevin Hopkins Jan 2002

Justice For Perpetrators And Victims Of Apartheid Who Fall Outside The Scope Of The Truth And Reconciliation Commission’S Mandate, Christopher J. Roederer, Kevin Hopkins

School of Law Faculty Publications

The legislation that gave birth to the Truth and Reconciliation Commission provides for the possibility of amnesty to the perpetrators of certain crimes and delicts. It also provides for the possibility of reparations to the victims of apartheid who suffered as a result of their human rights being grossly violated. The problem with the legislation is that it is only competent to deal with matters falling within its ambit, but there are numerous issues that still need to be addressed which clearly fall outside of it. One might be tempted to say that such issues falling beyond the scope of …

Race Relations, Suzanne W. Jones Jan 2002

Race Relations, Suzanne W. Jones

English Faculty Publications

Since the early nineteenth century, when white southern writers began to defend slavery, relationships between blacks and whites became a central concern in southern literature. Many nineteenth-and early-twentieth-century works by white writers exacerbated racial prejudice by reproducing southern white society's racist ideology. But other southern writers, both white and black, have attempted to redress this problem by using literature to dismantle stereotypes and to imagine new relationships. The results of the 1960s Civil Rights Movement speeded up the process, suggesting new plots, new endings, and new points of view to southern writers of both races.

Rethinking The Legal Oversight Of Benefit Program Exclusions, Mark Berger Jan 2002

Rethinking The Legal Oversight Of Benefit Program Exclusions, Mark Berger

Faculty Works

Increasingly, American workers rely upon employers to provide employee benefit programs that include critical health insurance and retirement savings plans. However, employers are finding that providing benefits is a costly undertaking. As a result an increasing number of employers are making use of alternative workforce systems. These involve supplementing a core of full-time workers with contingent employees for whom no commitments are made other than payment for services rendered. Such contingent workers have no expectation of indefinite or continuous employment, and are generally excluded from whatever benefit programs the company may provide.

The increasing use of two-tier employment systems of …

The Impact Of Expectations On Teaching And Learning, Barbara Glesner Fines Jan 2002

The Impact Of Expectations On Teaching And Learning, Barbara Glesner Fines

Faculty Works

Law schools are in a crisis of confidence in the abilities and motivations of their students. Conferences on law school teaching feature presentations such as "The Challenges of Connecting with 21st Century Students." Journal articles lament "The Happy Charade" that constitutes the learning and motivation of law students today. Professor Maranville of the Association of American Law Schools ("AALS") Section on Teaching Methods summarized these sentiments: "Many law students are so bored by the second year that their attendance, preparation, and participation decline precipitously; by graduation they have lost much of the passion for justice and the enthusiasm for helping …

Is The "Adequacy" Standard A More Political Question That The 'Equality' Standard?: The Effect Of Standards-Based Education On Judicial Standards For Education Finance Litigation, Avidan Y. Cover Jan 2002

Is The "Adequacy" Standard A More Political Question That The 'Equality' Standard?: The Effect Of Standards-Based Education On Judicial Standards For Education Finance Litigation, Avidan Y. Cover

Faculty Publications

This Note argues that the recent shift in state court litigation from an equality claim to one of adequacy has compelled many courts to insert themselves in the discussion and creation of educational policy that was previously viewed as unacceptable. This evolution may render courts vulnerable to appellate challenges and criticisms of nonjusticiability and political question doctrine violations regarding institutional competence and judicial prudence. In addition, the demise of the equality argument diminishes the moral strength of the court's normative valuation capacity. Section I examines the history of education finance cases and reviews the three waves of litigation strategies, which …

Anti-Trafficking Programs In South Asia: Appropriate Activities, Indicators And Evaluation Methodologies, Dale Huntington Jan 2002

Anti-Trafficking Programs In South Asia: Appropriate Activities, Indicators And Evaluation Methodologies, Dale Huntington

Reproductive Health

Throughout South Asia, men, women, boys, and girls are trafficked within their own countries and across international borders against their wills in what is essentially a clandestine slave trade. The Congressional Research Service and the U.S. State Department estimate that between 1 to 2 million people are trafficked each year worldwide with the majority originating in Asia. Root causes include extreme disparities of wealth, increased awareness of job opportunities far from home, pervasive inequality due to caste, class, and gender bias, lack of transparency in regulations governing labor migration, poor enforcement of internationally agreed-upon human rights standards, and the enormous …
