Aids Caps, Contraceptive Coverage, And The Law: An Analysis Of The Federal Anti-Discrimination Statutes’ Applicability To Health Insurance, Sharona Hoffman

Faculty Publications

Traditionally, health insurers have enjoyed the freedom to determine their own terms of coverage, to decide to what extent, if any, patients should be reimbursed for different kinds of treatment, and to establish premium prices. Health insurers typically deny coverage for speech therapy, eye glasses, hearing aids, most foot care, and treatment for infertility. Many insurance providers also exclude or severely limit coverage for mental health, dental care, AIDS, diabetes mellitus, morbid obesity, epilepsy, and alcoholism or drug abuse. Therefore, while some Americans enjoy full coverage for all their health needs, others who have insurance and suffer from serious or …

Comment: Multi-Disciplinary Practice And Conflict Of Interest, Kevin C. Mcmunigal

Faculty Publications

My comments as part of this panel focus on the attitude of proponents of multi-disciplinary practice toward conflict of interest. Before turning to that topic, I would like to offer a general observation about the debate on multi-disciplinary practice as well as a suggestion for improving the quality of that debate.

Justice For Perpetrators And Victims Of Apartheid Who Fall Outside The Scope Of The Truth And Reconciliation Commission’S Mandate, Christopher J. Roederer, Kevin Hopkins Jan 2002

Justice For Perpetrators And Victims Of Apartheid Who Fall Outside The Scope Of The Truth And Reconciliation Commission’S Mandate, Christopher J. Roederer, Kevin Hopkins

School of Law Faculty Publications

The legislation that gave birth to the Truth and Reconciliation Commission provides for the possibility of amnesty to the perpetrators of certain crimes and delicts. It also provides for the possibility of reparations to the victims of apartheid who suffered as a result of their human rights being grossly violated. The problem with the legislation is that it is only competent to deal with matters falling within its ambit, but there are numerous issues that still need to be addressed which clearly fall outside of it. One might be tempted to say that such issues falling beyond the scope of …

Race Relations, Suzanne W. Jones Jan 2002

Race Relations, Suzanne W. Jones

English Faculty Publications

Since the early nineteenth century, when white southern writers began to defend slavery, relationships between blacks and whites became a central concern in southern literature. Many nineteenth-and early-twentieth-century works by white writers exacerbated racial prejudice by reproducing southern white society's racist ideology. But other southern writers, both white and black, have attempted to redress this problem by using literature to dismantle stereotypes and to imagine new relationships. The results of the 1960s Civil Rights Movement speeded up the process, suggesting new plots, new endings, and new points of view to southern writers of both races.

Rethinking The Legal Oversight Of Benefit Program Exclusions, Mark Berger Jan 2002

Rethinking The Legal Oversight Of Benefit Program Exclusions, Mark Berger

Faculty Works

Increasingly, American workers rely upon employers to provide employee benefit programs that include critical health insurance and retirement savings plans. However, employers are finding that providing benefits is a costly undertaking. As a result an increasing number of employers are making use of alternative workforce systems. These involve supplementing a core of full-time workers with contingent employees for whom no commitments are made other than payment for services rendered. Such contingent workers have no expectation of indefinite or continuous employment, and are generally excluded from whatever benefit programs the company may provide.

The increasing use of two-tier employment systems of …
