Why Negligence Dominates Tort, James A. Henderson Jr. Dec 2002

Why Negligence Dominates Tort, James A. Henderson Jr.

Cornell Law Faculty Publications

The last several decades of tort scholarship in this country reflect enthusiasm favoring strict enterprise liability as the end position toward which American tort law, appropriately enough, is moving. This Article argues that no such trend is underway; negligence does now, and will in the future, dominate tort. Professor Gary Schwartz reached these same conclusions in a body of work spanning twenty-plus years, culminating in the Restatement (Third) of Torts: Liability for Physical Harm (Basic Principles) project on which he served as Reporter until his untimely death in 2001. This Article describes his work and supports his conclusions with two …

Consolidating Power: Technology, Ideology, And Philadelphia's Growth In The Early Republic, Andrew M. Schocket Dec 2002

Consolidating Power: Technology, Ideology, And Philadelphia's Growth In The Early Republic, Andrew M. Schocket

History Faculty Publications

Considers how during the 1780's-1820's wealthy Philadelphians adopted the British institutional structure of the corporation for purposes of organizing Philadelphia's economic and political life and how the corporate form was used to reconstruct and consolidate economic and political power. The corporation was part of a variety of "nexus technologies" that included canals and markets. These new social technologies allowed the coordination of physical and financial activities across greater distances, without relying on older forms of face-to-face control and coordination, thus permitting new elites to gain power as older, local patrician elites were displaced. These new corporate forms needed the legal …

Using Culturally And Linguistically Appropriate Assessments To Ensure That American Indian And Alaska Native Students Recieve The Special Education Programs And Services They Need, John W. Tippeconnic Iii, Susan C. Faircloth

Disabilities

The American Indian and Alaska Native Education Research Agenda (Research Agenda Working Group, Strang & von Glatz, 2001) represents the most recent formal call for research leading to improved assessments for American Indian and Alaska Native (AI/AN) students with special learning needs. Similar calls were recorded at hearings and published in commissioned papers in the early 1990s (Cahape, 1993; Johnson, 1991). The disproportionate number of AI/AN students receiving special education services and identified as limited English proficient (LEP) indicates an ongoing need for the research. This Digest briefly reviews the legislation and literature pertaining to the influence of language and …

From Paper To Action: State-Level Interagency Agreements For Supported Employment Of People With Disabilities, Deborah Metzel, Susan M. Foley, John Butterworth

All Institute for Community Inclusion Publications

Over the past decade there has been an increasing national emphasis on the participation of individuals with disabilities in the labor force. This concern was recognized through Executive Order No. 13078 signed by President Bill Clinton in March 1998, establishing the Presidential Task Force on Employment of Adults with Disabilities. The Task Force was charged with a mission "to create a coordinated and aggressive policy to bring adults with disabilities into gainful employment at a rate that is as close as possible to that of the general adult population" (Section 1 (c)). Legislation and policy changes have also been directed …

Census As A Techology Of Empire, David W. Darrow Dec 2002

Census As A Techology Of Empire, David W. Darrow

History Faculty Publications

A census is an example of the social construction of knowledge and the politics of measurement. Measuring people assumes a political significance because it entails converting heterogeneous populations into numbers—stable pieces of knowledge that can be easily combined and manipulated. In constructing such numerical representations, census officials claim to be creating an objective portrait of the population. Censuses, however, also contribute to something less tangible by playing a key role in the creation of what Benedict Anderson has termed an “imagined community.” General censuses provide states with a unique opportunity to unify space and populations with a single instrument. Furthermore, …

Common Fallacies In Medical Records For Bedside Evaluation, Gee-Gwo Yang Dec 2002

Common Fallacies In Medical Records For Bedside Evaluation, Gee-Gwo Yang

Journal of Medical Education

Medical records must be accurate and informative. Medical records reflect a doctor's logic of reasoning. The most common fallacies noted in medical records in Taiwan include the failure to know the differences between facts and personal theory, the failure to record complete medical history and to complete physical examination, the failure to chronologically organize the data, the failure to list all problems and summarize problems according to syndrome, the failure to consider all possible diseased for etiology during the evaluation of a syndrome, the failure to list each possible causative disease by probability, and failure to assess the severity of …

A Measurement Of Job Satisfaction Indicators Of North Dakota Long Term Health Care Givers, Deborah Moreno Dec 2002

A Measurement Of Job Satisfaction Indicators Of North Dakota Long Term Health Care Givers, Deborah Moreno

Theses and Dissertations

Long term care facilities in North Dakota and across the nation are experiencing a shortage of Registered Nurses (RNs), Licensed Practical Nurses (LPNs), and Certified Nurse Assistants (CNAs). This shortage is significant as it directly affects the quality of care provided to long term care residents. As long term care is labor intensive, recruitment and retention efforts are critical to these facilities. In a highly competitive labor market, although recruitment is important, retention of current employees is crucial. An integration retention strategy is necessary for the retention of employees. Numerous studies have suggested that job satisfaction is directly related to …

The Awara Verbal System, Susan R. Quigley Dec 2002

The Awara Verbal System, Susan R. Quigley

Theses and Dissertations

Awara is a language in the Wantoat family spoken by the Awara people of Papua New Guinea. Though it has been mentioned in papers written about the Finisterre-Huon languages and about the Wantoat language (another language in the Wantoat family), it has not been described in depth.

This paper presents a description of the verbal system of the Awara language. The major grammatical constructions described are 1) the verbal morphology, 2) serial-verb constructions, 3) clause chaining, and 4) subordination.

Interesting aspects of the language shown here are 1) the variety of clause types based on the type of subject-indexing suffix, …

Closely Held Firms As Going Concerns, Michael S. Long, Stephan E. Sefcik Dec 2002

Closely Held Firms As Going Concerns, Michael S. Long, Stephan E. Sefcik

The Journal of Entrepreneurial Finance

This current GAAP determination of a going concern is shortsighted for two important reasons. The most important deals with creditors and other stakeholders involved with the business. Do they enter into contracts with the business or with the individual owner/manager? Currently, they contract with both since, in reality, they make no determination whether a separate firm (entity) exists. The second deals with valuing a business. If the business is not really a separate going concern, it would typically be valued as the sum of its individual assets instead of the present value of its future cash flows. Many times when …

Entrepreneurship, Innovation And Growth: The David-Goliath Symbiosis, William J. Baumol Dec 2002

Entrepreneurship, Innovation And Growth: The David-Goliath Symbiosis, William J. Baumol

The Journal of Entrepreneurial Finance

Investment in innovation in industrialized economies increasingly is taken over by large firms that operate their own R&D divisions and transform technological change into a routine bureaucratized process. Powerful competitive forces require firms to do this for survival. But such routinized innovation has not replaced the individual independent innovator, the traditional source of technical change. The latter have tended to provide the more revolutionary breakthroughs, to which corporate research has added reliability, enhanced power and ease of utilization. Thus, both make a vital contribution to growth. While the results of big business research are often less spectacular, they have typically …

Collegiate Athletic Directors As Entrepreneurs, Michael A. Leeds Dec 2002

Collegiate Athletic Directors As Entrepreneurs, Michael A. Leeds

The Journal of Entrepreneurial Finance

One can define entrepreneurship, at its most basic level, as rent-seeking behavior. This behavior can be productive, as when firms innovate to create new or better products or when they enter a market to increase output where price exceeds marginal cost. Rent-seeking can also be unproductive, particularly when it interfaces with the public sector. In such cases, firms may try to create or preserve rents by securing monopoly power from the government. Traditionally, economists have analyzed rent-seeking behavior solely in the private and government sectors of the economy. I extend the concept to the not-for-profit sector, in particular to the …

New Bank Start-Ups: Entrepreneurs Funding Other Entrepreneurs, Robert Deyoung Dec 2002

New Bank Start-Ups: Entrepreneurs Funding Other Entrepreneurs, Robert Deyoung

The Journal of Entrepreneurial Finance

There has traditionally been a symbiotic link between new business ventures and new banking ventures. This article finds that the traditional link between small businesses and small banks – the small business loan – has weakened in recent years. While new banks have intensified their reliance on small business customers, small business borrowers have become less reliant on small banks for their credit needs. These findings are consistent with rapid changes in the structure of the banking industry, financial instruments and markets, and communications and information technology over the past two decades.

Entrepreneurship, Firm Size And The Structure Of The Italian Economy, Pellegrino Manfra Dec 2002

Entrepreneurship, Firm Size And The Structure Of The Italian Economy, Pellegrino Manfra

The Journal of Entrepreneurial Finance

Since World War II, Italy's economic growth has been one of the highest in the world. The objective of this study is to examine the structure of the Italian economy and causes of this growth. It was found that small and medium-sized firms, most of them family-owned, have been the dynamic force behind the country?s extraordinary economic performance. The vital role of the family and that of the entrepreneur – as the supreme spirit of enterprise and initiative - has been paramount in this process. Production by small and medium-sized firms have concentrated in a specific geographical area called “industrial …

During late spring through summer of 1994 and 1995, 290 randomly selected stream sites in Nebraska, Kansas, and Missouri were sampled once for several parameters including conductivity, turbidity, total phosphorus, nitrate-nitrite nitrogen, the index of biotic integrity, and a habitat index. Based on landscape data from watersheds that were delineated for each sampling location, interrelationships were examined between these water quality parameters and land use/land cover, the normalized difference vegetation index (NDVI), and vegetation phenological metrics derived from the NDVI. Statistically significant relationships were found between NDVI values and the derived metrics with the stream condition parameters (r values to …

Dynamic Yield Analysis And Enhancement Of Fpga Reconfigurable Memory Systems, Minsu Choi, Nohpill Park Dec 2002

Dynamic Yield Analysis And Enhancement Of Fpga Reconfigurable Memory Systems, Minsu Choi, Nohpill Park

Electrical and Computer Engineering Faculty Research & Creative Works

This paper addresses the issues of field programmable gate arrays (FPGA) reconfigurable memory systems with faulty physical memory cells and proposes yield measurement techniques. Static yield (i.e., the yield which does not take into account the inherited redundancy utilization for repair) and dynamic yield (i.e., the yield which takes into account the inherited redundancy utilization for repair) of FPGA reconfigurable memory systems and their characteristics are extensively analyzed. Yield enhancement of conventional memory systems relies on additional redundancy, but FPGA reconfigurable memory systems have inherited redundancy and customizability. Thus, they can accommodate numerous target memory configurations, and redundant memory cells, …

Shedding Rights, Shredding Rights: A Critical Examination Of Students' Privacy Rights And The Special Needs Doctrine After Earls, Meg Penrose

Faculty Scholarship

On June 27, 2002, the United States Supreme Court held that all students participating in extracurricular activities in public schools may be subjected to random, suspicionless drug testing. The holding, in itself, is not terribly remarkable, as the decision in Board of Education of I.S.D. 92 of Pottawatomie County, Oklahoma v. Earls follows a developing pattern among public schools in this country. Further, the Earls case simply broadens the right of the state to randomly drug test students, without individualized suspicion, that this same court announced a mere seven years earlier in Vernonia v. Acton. What is remarkable about …
