How Extra-Copyright Protection Of Databases Can Be Constitutional, Justin Hughes

Following the Supreme Court's 1991 Feist decision, intellectual property and Constitutional law scholars have debated whether extra-copyright protection of databases can be established by Congress under its Commerce Clause power. This article presents the problem as one of the gravitational zone of the Commerce Clause versus that of the Copyright and Patent Clause. The article reasons that the Supreme Court decisions in International News Service v. Associated Press, Zacchini v. Scripps-Howard, and the 19th century Trademark Cases all point to the possibility of limited protection of databases under the Commerce Clause. Retroviruses exhibit high genetic variability, which is generated by mutations and recombination during viral replication. This can lead to rapid emergence of viral variants resistant to antiretroviral drugs. A better understanding of retroviral replication may lead to the development of improved antiviral drug therapy and effective vaccines to retrovirus-related diseases. The fact that retroviral nucleocapsid protein (NC) is multifunctional and plays crucial roles in viral replication makes it a good target for antiviral drug development. This dissertation conducted a comparative examination of executive-appointed national study (advisory) commissions utilized by Canada and the United States. Such commissions of inquiry are ad hoc bodies which are established by executive authority, assigned a specific issue, crisis or incident to investigate, conduct their affairs openly, and conclude with a publicly issued final report. In the Canadian context there has been very little study of the more than 350 Royal Commissions of Inquiry created since Confederation. American presidential study commissions from Truman to the first Nixon administration were the subject of a 1974 study. This study expanded on that earlier …

Nicholas Rowe was a playwright of some success during the first quarter of the eighteenth century in London. Rowe's importance to the theatre can be seen in his contribution to the development of strong female roles. He was part of that group of Whig writers who championed individual freedom, some rights for women, and a stronger parliament. It is my contention that Rowe was an "incipient" feminist and an innovator of theatrical practice through his use of the female protagonist. By "feminist" I mean that Rowe wrote about the plight of women in a society that afforded very few rights …

Very little research has been conducted to assess the effects of sorority membership on undergraduate sorority women. While there have been numerous studies conducted concerning fraternity men, there has been limited research concerning sorority women only and no studies that explore the effects of ritual on the sorority experience. Does ritual have an impact on the values and behavior of contemporary sorority women? In complementary response to socio-historisists who discuss the concept of "freedom" in William Wordsworth's poetry as determined from without — be it by socio-historical conditions, gender, or imposed ideology — I draw from the theory of Nicholas Berdyaev, one of the prominent continental existentialists of the twentieth century, tracing the development of Wordsworth's understanding of freedom towards "genuine liberty" as progressively determined from within. Thus focusing on "existentia" rather than "essentia," I pay particular attention to shaping inner efforts and developing visions of the growing and conscious personality as they are described in The Prelude. This study integrates and expands two models of organizational support perceptions, job attitudes, effort, and employee behavior (i.e., Brown & Leigh, 1996; Netemeyer, Boles, McKee, & McMurrian, 1997). An integrated model was hypothesized, in which Perceived Organizational Support and Perceived Opportunity for Reward impacted job satisfaction, organizational commitment, and job involvement, which in turn influenced effort (work intensity and time commitment), which subsequently impacted Organizational Citizenship Behaviors (OCBs) and in-role performance. Employee – supervisor dyads were surveyed (n = 279), and structural equation modeling was used to test the hypothesized model and several alternative models. Results indicated that the hypothesized …

In the past several years, companies have discovered the importance of strategic social alliances, particularly in the form of cause related marketing (CRM) programs. Varadarajan and Menon (1988) describe the key feature of CRM as is that the firm’s contribution is linked to consumers’ engagement in revenue producing transactions with the firm. It is essentially a way for a firm to “do well by doing good” and provides several benefits to both the firm and the non-profit organizations receiving the donations. The traditional view of the agricultural community as a good steward of the environment has been challenged by increasing concerns about the complex relationship between agricultural production activities and environmental quality. Agriculture provides a large range of products to satisfy human needs. It has also been singled out as major source of water pollution. Largely improved surface water quality has been assessed in the U.S. since the enactment of the Clean Water Act. This dissertation examines how Southern literary representations of the natural world were influenced by, and influenced, the historical, social, and ecological changes of the 1930s and 1940s. Specifically, I examine the ways that nature is conceived of and portrayed by four authors of this era: Erskine Caldwell, Marjorie Kinnan Rawlings, Zora Neale Hurston, and William Faulkner; through their works, I investigate the intersections of race, class, and gender with the natural environment. Critical discourse regarding musical theatre takes, for the most part, the form of a profound silence, due presumably to a dismissal of the genre as simplistic and insubstantial. Not only have the elements of musical theatre been present in the majority of theatrical history, but many of the greatest theories regarding theatre have included these elements, including Brecht and Wagner. The present study investigated the nature and extent of changes in body image following weight loss treatment in an obese sample and examined the role of weight loss in predicting body image improvement. Participants were 53 obese individuals (BMI > 30) recruited from the Pennington Biomedical Research Center in Baton Rouge, the Scripps Clinic in San Diego, CA, and the Weight Management Center at the St. Charles Hospital in New Orleans. This dissertation investigates the implications of different methods of identifying exogenous shocks to defense purchases for estimating the macroeconomic effects of shocks to government purchases. Four identification schemes are examined: the narrative approach of Ramey and Shapiro (1997), a more comprehensive narrative approach that tries to isolate exogenous reductions in defense purchases as well as exogenous increases in defense purchases, the Choleski decomposition, and long-run restrictions. The effects of alternative methods of identifying policy shocks are examined within two common VAR systems estimated over specific sample periods.
