Need Intellectual Property Be Everywhere? Against Ubiquity And Uniformity, David Vaver

Intellectual property is more prevalent in every corner of our working and leisure lives. International pressure, through both bilateral treaties and multilateral treaties is causing intellectual property law to standardize at high levels throughout the world. Legal standardization may be beneficial in general but is not so for intellectual property in either the developed or the developing world. The law in developed countries is currently incoherent and itself requires major reconsideration. The imposition of such a defective law on the developing world is helpful to neither side. The paper argues that current intensification and harmonization trends are therefore undesirable, and …

Indigenous planting design, the practice of incorporating regional native plant species into new landscape projects, is little studied. This trend is counter to the more known and accepted American practice of using exotic ornamental plant species. This thesis studies the work and context of one Texas landscape architect, H. Dan Heyn. Beginning in the 1950's and continuing through the 1980's, Heyn became committed to, and specialized in, the use of indigenous plants in his landscape architectural design practice.

Unfair Competition Under The Trips Agreement: Protection Of Data Submitted For The Registration Of Pharmaceuticals, Carlos María Correa

Before the entry into force of the TRIPS Agreement, countries had considerable latitude to determine rules for the protection of test data. The Agreement introduced the first international standard on the subject, as contained in its Article 39.3. But the Agreement is not a uniform law (it only establishes broad parameters for national rules). An important question is the extent to which the Agreement allows World Trade Organization ("WTO") members freedom to apply different approaches for test data protection and, in particular, the extent to which a competitive model- protection without exclusivity-is compatible with the minimum standards set forth by …

From The Core To The Peripheries: Multilateral Governance Of Malaria In A Multi-Cultural World, Obijiofor Aginam

This article discusses multilateral malaria control strategy, the RBM, its mission, vision, and relationship with traditional therapies in malaria-endemic societies, especially in Africa, where malaria is one of the biggest contributors to the burdens of disease. Because big multilateral partnerships like the RBM are almost always guilty of the charges of non-transparency, non-responsiveness, and insensitivity to the local constituencies they serve, I use Richard Falk's twin concepts of "globalism-from-above" and "globalism-from-below" to explore the interaction between the RBM and traditional therapies in malaria-endemic societies. In September of 2001, the United Nations placed the topic of human cloning on its agenda at the request of France and Germany. These countries hope that negotiations regarding human cloning will prompt the UN to adopt "an international legal instrument banning the reproductive cloning of human beings." Currently, scientists can travel to one of the many countries lacking restrictions on cloning and attempt to clone humans without facing legal repercussions. An international regulatory regime, therefore, seems necessary if a prohibition on cloning is to be effective. An international treaty banning human cloning may not be the perfect solution; it …

Does it make sense to invest the time, labor and equipment in harvesting hay and then lose 30% of it during storage? With a 1l50 # round bale, worth $65/ton, this would amount to a loss of 345 # of hay, valued at $11.21, per bale. A producer who feeds his own hay is not only out the value of the damaged hay, but may have to purchase additional feed to replace that lost, doubling his expense.

Install a water meter to measure the volume of water being used by the household (or other facility) to determine the flow released into the on-site treatment system. If the system has a pump/lift station delivering septic tank effluent to the soil treatment unit, install an electrical event counter on each lift station. Benthic macrofauna are an important component of estuarine ecosystems. These organisms are a food source for higher trophic levels including fishes and crabs (Virnstein 1977, 1979; Holland et al. 1980; Dauer et al. 1982) and birds (Botton 1984; Quammen 1984). Benthic macrofauna affect both the physical and chemical properties of the sediment and the overlying water column (e.g., Rhoads and Young 1970; Rhoads 1973; Aller 1978, 1980), influence nutrient cycling (Rowe et al 1975; Zeiteschel 1980; Flint and Kamykowski 1984), and are capable of directly controlling phytoplankton biomass in the water column (Cleorn 1982; Officer et al 1982; Cohen et …
