Comparative Criminalization: Cultural Meanings Of Adultery And Gender Violence In Hawai‘I In 1850 And 1990, Sally Engle Merry Mar 2002

Comparative Criminalization: Cultural Meanings Of Adultery And Gender Violence In Hawai‘I In 1850 And 1990, Sally Engle Merry

Pacific Studies

This essay analyzes the impact of court cases concerning sexuality and adultery on customary understandings of kinship and gender in Hilo, Hawai‘i. During the periods covered the nature of the cases, the content of the law, and the implementation of punishment changed radically. Nevertheless, there are similarities in modes of criminalization during the 1840s and 1850s, on the one hand, and during the 1990s, on the other. Both used the authority and sanctioning power of the law to redefine marriage and gender relations. Both were implemented through local practices of police, courts, and corrections/treatment officials, which provided incentives for compliance …

The Predictive Validity Of The Afit Graduate Engineering And Environmental (Geem) Admission Requirements, Charles C. Zitzmann

Theses and Dissertations

Recognizing that a strong commitment to advanced technical and management education (Van Scotter, 1993, p. 1) serves to maintain the capability and strength of the United States Air Force (USAF), the Air Force Institute of Technology (AFIT) Graduate School of Engineering and Management (GSEM) offers a full-time, eighteen-month, Graduate Engineering and Environmental Management (GEEM) program to military officers and Department of Defense (DoD) civilian employees. The AFIT uses the applicant's undergraduate grade-point average (UGPA), Graduate Record Examination (GRE) General Test verbal and quantitative scores, and undergraduate mathematics course grade-point average (UMGPA) to select applicants for admission. This study analyzed how …

(E)Racing The Fourth Amendment, Devon W. Carbado Mar 2002

(E)Racing The Fourth Amendment, Devon W. Carbado

Michigan Law Review

It's been almost two years since I pledged allegiance to the United States of America - that is to say, became an American citizen. Before that, I was a permanent resident of America and a citizen of the United Kingdom. Yet, I became a black American long before I acquired American citizenship. Unlike citizenship, black racial naturalization was always available to me, even as I tried to make myself unavailable for that particular Americanization process. Given the negative images of black Americans on 1970s British television and the intra-racial tensions between blacks in the U.K. and blacks in America, I …

Whither Securities Regulation? Some Behavioral Observations Regarding Proposals For Its Future, Robert Prentice Mar 2002

Whither Securities Regulation? Some Behavioral Observations Regarding Proposals For Its Future, Robert Prentice

Duke Law Journal

Respected commentators have floated several proposals for startling reforms of America's seventy-year-old securities regulation scheme. Many involve substantial deregulation with a view toward allowing issuers and investors to contract privately for desired levels of disclosure and fraud protection. The behavioral literature explored in this Article cautions that in a deregulated securities world it is exceedingly optimistic to expect issuers voluntarily to disclose optimal levels of information, securities intermediaries such as stock exchanges and stockbrokers to appropriately consider the interests of investors, or investors to be able to bargain efficiently for fraud protection.

Regulating Federal Prosecutors' Ethics, Bruce A. Green, Fred C. Zacharias Mar 2002

Regulating Federal Prosecutors' Ethics, Bruce A. Green, Fred C. Zacharias

Vanderbilt Law Review

To what extent should federal prosecutors be regulated by states, by federal courts, or by the U.S. Department of Justice ("DOJ) as a matter of self-regulation? This Article concludes that, subject to congressional oversight, federal courts should have the ultimate authority to regulate federal prosecutors. However, it also acknowledges the legitimacy of competing claims by the states and DOJ. Sometimes, federal courts should defer to state court regulation, given traditional state regulation of the practice of law and a host of practical considerations. At other times, federal prosecutors have compelling reasons to seek freedom from both state regulation and regulation …

Law On The Rocks: The Intoxication Defenses Are Being Eighty-Sixed, Meghan P. Ingle Mar 2002

Law On The Rocks: The Intoxication Defenses Are Being Eighty-Sixed, Meghan P. Ingle

Vanderbilt Law Review

The ever-controversial voluntary intoxication defense faces possible elimination by statutory abrogation. Originally developed by nineteenth-century common law courts, the defense recognizes that an intoxicated defendant may be incapable of possessing the mens rea specified by an offense. Increasingly criticized in recent years, the defense received a substantial blow to its continued vitality in the 1996 Supreme Court decision Montana v. Egelhoff. In a sharply divided opinion," a plurality of the Court held that a defendant does not possess a constitutional right to present evidence of voluntary intoxication in his defense. The Egelhoff decision has caused much commentary, both positive and …
