Comparative Pension Policy Outcomes In Social Democratic Nations: The Case Of Finland, Kevin Clay Lomax
Comparative Pension Policy Outcomes In Social Democratic Nations: The Case Of Finland, Kevin Clay Lomax
University of Kentucky Doctoral Dissertations
Issues of pension viability are at the forefront of gerontological debate. The uncertainty of long-term effects of the societal aging process on public pensions and the constant public policy struggle to maintain income levels among pensioners are critical points of discussion. As existing pension policies are examined and amended, policymakers increasingly rely on experts of pension research and income inequality for policy frameworks. Gosta Esping-Andersen's (1990) Three Worlds of Welfare Capitalism has provided the seminal typology for nearly two decades. His typology consists of three regimes: liberal, conservative, and social-democratic. The purpose of this research was to examine and compare …
Discrimination And Human Capital: A Challenge To Economic Theory & Social Justice, Richard K. Caputo
Discrimination And Human Capital: A Challenge To Economic Theory & Social Justice, Richard K. Caputo
The Journal of Sociology & Social Welfare
This article reports findings of a study using the National Longitudinal Survey of Youth (NLSY79) to test the rational choice theory that discrimination discourages investments in human capital. Nearly 60% of the study sample (N=5585) reported job-hiring discrimination (race, nationality, sex, or age) between 1979 and 1982 and they were found to invest more in job training programs and additional schooling between 1983 and 1998 than those reporting no such discrimination. White males were found to have the greatest advantage over black males and females in regard to job training and over black females in regard to additional schooling. Findings …

The Rules Of Inference, Lee Epstein, Gary King
The Rules Of Inference, Lee Epstein, Gary King
University of Chicago Law Review
Although the term "empirical research" has become commonplace in legal scholarship over the past two decades, law professors have in fact been conducting research that is empirical--that is, learning about the world using quantitative data or qualitative information--for almost as long as they have been conducting research. For just as long, however, they appear to have been proceeding with little awareness of, much less compliance with, many of the rules of inference, and without paying heed to the key lessons of the revolution in empirical analysis that has been taking place over the last century in other disciplines. The tradition …
The Creative Destruction Of Copyright: Napster And The New Economics Of Digital Technology, Raymond Shih Ray Ku
The Creative Destruction Of Copyright: Napster And The New Economics Of Digital Technology, Raymond Shih Ray Ku
University of Chicago Law Review
To determine whether sharing music over peer-to-peer networks such as Napster should be considered copyright infringement, we must first conclude that digital works are entitled to copyright protection. This Article argues against copyright protection for digital works because the economics of digital technology undercuts prior assumptions about the efficacy of a private property regime for information, a public good. Questioning the conventional wisdom that the two interests served by copyright, creation and public dissemination, are aligned, the Article reveals that the argument for copyright is primarily an argument for protecting content distributors in a world in which middlemen are obsolete. …

Charter Insights For American Equality Jurisprudence, Stephen F. Ross
Faculty Scholarship
Although both the Canadian Charter and the United States Constitutions protect persons from denial of equal protection of the law, the interpretation of the broad language of the two equality guarantees has been quite different. The Supreme Court of Canada has adopted an approach of substantive equality, concluding that section 15 is designed to prevent the loss of human dignity that accompanies discrimination based on disadvantage and stereotype. At least with regard to race, a majority of the justices on the United States Supreme Court adhere to a jurisprudence of formal equality, concluding that the Fifth and Fourteenth Amendments prohibit …

Australia: An Integrated Curriculum Unit, Grades 2-4, Institute For The Development Of Gifted Education, Ricks Center For Gifted Children, University Of Denver
Ricks Curriculum Units Series
An integrated curriculum is an instructional approach that connects the disciplines to an underlying theme or topic. Immersing students in an integrated-thematic unit provides the backdrop for experiences to occur across the disciplines. Shaping coursework around integrated themes is especially appropriate for gifted students, however using an integrated-thematic curriculum is appropriate for all learners as it develops students' abilities to make connections, to solve problems by looking at multiple perspectives, and to integrate information from different fields of experience. An integrated-thematic curriculum permits students to be active participants in their own learning as they design their own explorations and take …

A Case Study Of An Agency's Three Family Preservation Contracts, Mark Ezell
A Case Study Of An Agency's Three Family Preservation Contracts, Mark Ezell
Journal of Family Strengths
This article presents a case study of a nonprofit child welfare agency that delivered family preservation services under three different purchase-of-service (POS) contracts. The research specifically focuses on how certain POS contract provisions and reimbursement rates influence the delivery of family preservation services. The three contacts examined differed on criteria, such as reimbursement mechanism, service volume, definition of clientele, and reimbursement rate. The study found that as reimbursement rates decline and as administrative costs increase, the service provider struggled with cash flow, staffing, fundraising, and service provision, among other things. It is concluded that contract-related resources, policies, and procedures impact …

Does Ec Pregnancy And Maternity Legislation Create Equal Opportunities For Women In The Ec Labor Market? The European Court Of Justice's Interpretation Of The Ec Pregnancy Directive In Boyle And Lewen, Petra Foubert
Michigan Journal of Gender & Law
This article discusses the EC's legal accommodation of pregnancy in the workplace and the interpretation thereof by the European Court of Justice. The leitmotiv is the question to what extent such accommodation enhances women's position in the labor market. The suspicion being that, in a well-intentioned attempt to fight discrimination of women, the EC institutions entrench gender discrimination. In other words, in their attempt to fight sex discrimination (by accommodating pregnancy), the EC often places women in a position that confirms the traditional perception of women as childbearers and caregivers.
Does Information And Agreement Equal Informed Consent?, Carl E. Schneider, Michael H. Farrell
Does Information And Agreement Equal Informed Consent?, Carl E. Schneider, Michael H. Farrell
Law Quadrangle (formerly Law Quad Notes)
The following essay is based on a talk delivered last summer in England and on the chapter "Information, Decisions, and the Limits of Informed Consent," in (Michael Freeman and Andrew D. E. Lewis, eds.) Law and Medicine: Current Legal Issues 2000, Volume 3 (Oxford University Press, 2000). This version appears with permission of the publisher.
For many years, a principal labor of bioethics has been to find a way of confiding medical decisions to patients and not to doctors. The foremost mechanism for doing so has been the doctrine of informed consent. Anxious as bioethicists and courts have been to …

HIV and AIDS
A study conducted in Dakar, Senegal by researchers from the National AIDS Council, Cheikh Anta Diop University, and the Horizons program obtained information on the needs, behaviors, knowledge, and attitudes of men who have sex with men (MSM). This study offers important insights into the sexuality of MSM, their vulnerability to STI/HIV, and the role of violence and stigma in their lives. The results also highlight the lack of sexual health services and information available to cover the specific needs of MSM. The results of this study were summarized during a meeting held in April 2001 in Dakar and raised …

Juvenile Justice Reform: A Tale Of Two Systems, Erika Gebo
Juvenile Justice Reform: A Tale Of Two Systems, Erika Gebo
Doctoral Dissertations
This study examines two juvenile justice reform efforts in one state. The first initiative, a detention risk assessment tool, is embedded within the second initiative, a family court pilot project. Detention screening tools have been developed primarily to alleviate detention center overcrowding and to reduce disproportionate minority confinement in those centers. The instrument under analysis limits discretion by judges in the detention decision making process. The second reform effort, family court, is premised on the rehabilitative ideal. In these courts, judges are presumably given wide latitude in deciding cases in order to meet the individual needs of each offender. These …
Implementation And Evaluation Of Group -Based Prevention Of Eating Concerns Using Self -Efficacy And Knowledge Enhancement, Lindsey Erin Laplant
Implementation And Evaluation Of Group -Based Prevention Of Eating Concerns Using Self -Efficacy And Knowledge Enhancement, Lindsey Erin Laplant
Doctoral Dissertations
The project implemented and evaluated a prevention program for eating concerns with first year college women. Two prevention conditions were examined. One condition provided information about eating concerns, from definitions to biopsychosocial risks and consequences. The second condition built self-efficacy and skills in the participants along with presenting information. The evaluation component was unique compared to other evaluations in the eating concerns prevention literature. It used pre and post intervention assessments, a control group, and had a larger sample of participants compared to other similar published programs. Both quantitative and qualitative assessment techniques were used to evaluate participants' experience in …
Breaking The Norm: Family Characteristics Associated With The Avoidance Of Corporal Punishment, Wendy Ann Walsh
Breaking The Norm: Family Characteristics Associated With The Avoidance Of Corporal Punishment, Wendy Ann Walsh
Doctoral Dissertations
Corporal punishment (CP) is an acceptable and frequently used discipline tactic, with 94% of parents of 2- to 4-year-olds using it (Straus, 2001). Much of the parenting literature indicates that there are more positive ways to discipline a child (May, 2000; Sears & Sears, 1995; Spock & Parker, 1998). Yet, only a minority of parents raise children without CP.
Using Belsky's (1984) model of parenting, this study analyzed the 1985 National Family Violence Survey to compare this minority group of parents with those who use CP in order to understand the experiences and context associated with avoiding it. The extent …
