This study explored the transcending experience as described by visual artists that sometimes occurs during the art-making process. The exploration was conducted within a philosophical framework informed by the researcher's practice of Transcendental Meditation (TM). From this perspective, transcending is related to personal, inner (subjective), and ephemeral aesthetic experiences which never-the-less make a powerful contribution to the visual artist's experience of the creative process and to a lesser extent, the final product. This study focuses on how a group of seven Kindergarten teachers perceive their practices to support the language learning of young children. From a socio-cultural perspective, developing language competency at Kindergarten is a priority because of its pivotal role across all learning areas and the opportunity it creates for all children to add to their linguistic capital in an informal setting prior to formal schooling. This study is based on a collaborative, participatory model built on a mutually beneficial relationship between researcher and participants. Bottle-Feeding Mothers' Experiences Of Coping In A Pro-Breastfeeding Context : The Case For A Caring-Options-Responsive Model Of Midwifery Services, Elizabeth P. Duffy

The original contribution of this qualitative study is that it sketches the front-line of the contested domain of infant feeding choices by exploring the under-researched experiences and perceptions of mothers who actively choose to bottle-feed their babies. Twelve bottle-feeding mothers in Western Australia participated in open-ended, in-depth interviews. The interview findings were further explored using participant observations of relevant hospital practices and critical, hermeneutic re-readings of midwifery's professional and policy documents. The thesis argues that bottle-feeding is marginalised by the midwifery profession that currently defines its practices in accordance with policies such as the Baby Friendly Hospital Initiative. Learning involves cognitive, psychological, sociological, historical, philosophical, aesthetic, emotional and spiritual aspects. This study argues that the spiritual dimension of the psyche is overlooked in the research into education. Spirituality in education is not easily addressed in secular settings and needs exploration and explication. The thesis probes the interstice between the act of dramatic performance and the spiritual awareness of the individual. Case studies allow the exploration of the experience of performance for senior high school drama students, drama teacher trainees and an adult actor. National measures of achievement among Australian school children suggest that Aboriginal students, considered as a group, are those most likely to end their schooling without achieving minimal acceptable levels of literacy and numeracy. In view of the fact that many Aboriginal students dwell in metropolitan areas and speak English as a first language, many educators have been unconvinced that linguistic and cultural difference have been significant factors in this underachievement. Photographic artists have a continuing desire to express intimately aspects of their social world through the genre of portraiture. However, in attempting to make known the lives of those around them, portraitists encounter a range of complexities inherent in the representation of the human subject in a two-dimensional visual field. Portraits were initially an indicator of social class until the introduction of photography, when more and more people became involved in their production and ownership. The study of fatigue in the health and transport sectors has predominantly been focused on night shift or day shift operations. This study has been applied to the hours of operation of Ambulance Officers who perform both night and day shifts, while also being required for on-call. The Officer on-call is on stand-by between shifts, to be available to respond for duties from the completion of one shift until the commencement of the next, usually a ten-hour shift. This study investigates the ways in which four Year One children engage in the literacy events of their regular and Reading Recovery classrooms. It explores how these children perceived their beginning reading instruction and possible relationships between the children's perceptions and the ways in which they ‘did' literacy in each setting. The Anglo-Indian community and Anglo-Indian women in particular have been described as 'mixed-race' and 'hybrid'. This study seeks to explore the identity of Anglo-Indian women through the process of migration and settlement in Australia, by following the lives of twenty-six women. Twenty of these women emigrated from India between 1963 and 1977; one arrived in Australia significantly earlier in 1947 and another significantly later, in 1996. Four women were Australian-born. Over twenty years ago, the Journal of the Copyright Society of the U.S.A. reprinted my article, "Fair Use as Market Failure" (82 Columbia Law Review 1600 (1982), available at: https://ssrn.com/abstract=3577724. That 1982 piece suggested that an underlying pattern governs the protean forms of "fair use", and I employed the notion of market failure to reveal and explain how the pattern functioned. The article seeks to clarify what is at stake - and what is not - in the litigation challenging the constitutional validity of the Sonny Bono Copyright Term Extension Act (CTEA). First, the article distinguishes between the CTEA's retrospective term extension of copyright term and the retrospective extensions enacted by prior Congresses. The article suggests that the CTEA provisions are constitutionally questionable in ways that earlier retrospective extensions may not have been. To hold the CTEA unconstitutional would not make all other term extensions vulnerable.

This study of the entire phenomenon of civil litigation commenced with the sole aim of ascertaining the extant gaps in the available knowledge about litigation from the perspectives of those who are by far affected most by it: the litigants. What does litigation mean for those who are directly embroiled and whose lives may consequently be radically transformed? Serious lacunas exist. However, extensive readings worldwide throughout the research process result in a stark elucidation of an overlooked, yet crucially important and somewhat egregious state of affairs, making surprisingly clear just how pernicious litigation is for the average 'nonrepeat player'.

In this article, we first use existing research evidence to contextualize more clearly the place of civil case mediation in the litigation process. When we understand civil mediation as part of adversarial litigation - rather than as distinct from it - we see the importance of comparing mediation and unassisted negotiation. Next, we discuss research and commentary on the barriers to negotiation and the ways in which mediation might help overcome them. This experience stands in stark contrast to the thesis of Professor Deborah Hensler in her article, Suppose It's Not True: Challenging Mediation Ideology. Therein, Professor Hensler attempts to link social psychological research that she interprets as showing dissatisfaction with the use of mediation compared to adjudication, which, in turn, leads her to conclude that clients should prefer counsel who ordinarily can resolve cases successfully without the help of mediation.7 The fallacy of Professor Hensler's argument is evident in several respects. This article explores two related questions: First, does mood7 shape how well lawyers succeed at negotiation?" Second, can lawyers succeed better at negotiation by understanding and managing the role of mood? We begin by exploring what scientific evidence we currently have about how mild changes in mood are associated with significant differences in success at negotiation. Ultimately, we argue that existing scientific evidence shows mood plays a far more complicated role than negotiators and negotiation scholars usually imagine, but that further research needs to address more carefully exactly how mood works and how it affects lawyers and legal negotiation.
