Motivations And Gratifications For Selecting A Niche Television Channel: Byu Television, Diena L. Simmons Jan 2002

Motivations And Gratifications For Selecting A Niche Television Channel: Byu Television, Diena L. Simmons

Theses and Dissertations

The growth of direct broadcast satellite television distribution to the home as a viable competitor to cable and terrestrial broadcast has fostered the availability of special interest or niche channels and therefore provided greater choice to the viewer. This study, based on uses and gratifications theory, examined the relationships among ritual and instrumental viewing motivations and satisfactions, viewer religiosity, and viewing attentiveness as they related to the selection of a niche television channel, Brigham Young University Television.
The uses and gratification approach provides an appropriate framework for studying "media consumption, the interrelated nature of television user motives, and the relationships …

Reparations And The Colonial Dilemma: The Insurmountable Hurdles And Yet Transformative Benefits, Ediberto Román

Faculty Publications

The Seventh Annual Latina and Latino Critical Race Theory ("LatCrit") Conference held in May 2002 at the University of Oregon, not unlike other efforts in the movement, addressed a panoply of challenging, provocative, and controversial issues. Perhaps one the most intellectually interesting and yet troubling panels addressed reparations for the inhabitants of United States' colonial territories. Specifically, the panel was titled "Reparations, Redress, and Remedies: Undoing the Legacy of Colonialism and Imperialism." Members of the academy as well as a representative of Puerto Rico's Independence Party participated in a lively discussion and debate. Although the articles resulting from this panel …

Who's Not Dieting In America And Who Should Be? Results From The 1994-1996 Diet And Health Knowledge Survey (Dhks 1994-1996), Emily York-Crowe

LSU Master's Theses

The rising rates of obesity and overweight are contributing to higher costs for the individual and the nation, both medically and financially. There is a greater need for education and other preventive measures, but in order to tailor such programs effectively to the individuals most in need, it is important to examine the current trends, knowledge, and practices of adults in the United States. Previous research has examined the prevalence rates and practices of specific populations and individuals in limited geographical locations but, due to obvious constraints, few nationally representative samples have been examined. This study analyzed the results of …

Retributive Justice: Its Social Context, Neil Vidmar Jan 2002

Retributive Justice: Its Social Context, Neil Vidmar

Faculty Scholarship

Until relatively recently, social psychologists have given less attention to retributive justice than to other forms of justice, such as distributive and procedural justice. Although interest in retributive justice is increasing, the fact remains that social psychological research on retribution has tended to ignore, or at least downplay, the insights of sociologists in deference to an approach that examines how individuals respond to deviant acts. Without rejecting psycholgical analyses, this chpater draws attention to the social context and social consequences of retributive justice. Group dynamics are at play in a wide array of settings in which people respond to rule …

The Fable Of Entry: Bounded Rationality, Market Discipline, And Legal Policy, Avishalom Tor Jan 2002

The Fable Of Entry: Bounded Rationality, Market Discipline, And Legal Policy, Avishalom Tor

Journal Articles

Legal scholars have recently advanced a behavioral approach to the law and economics school of thought, replacing the traditionally assumed rational actor with an empirically based, boundedly rational decision maker. In response, advocates of traditional law and economics have asserted that boundedly rational behavior is of little significance for the analysis of economic activities in market environments, most notably because competitive pressures will eliminate such behavior. This article argues, however, that bounded rationality has important effects on the market even under conditions of intense competition. Through a study of the competition among new entrants into industry, this analysis examines the …

Empirical Work In Family Law, Margaret F. Brinig Jan 2002

Empirical Work In Family Law, Margaret F. Brinig

Journal Articles

Until fairly recently, researchers have not done much theoretical work on the subject of family law. Although the move towards theoretical work is a positive one, unfortunately, most of the latest reforms in family law have been uninformed by empirical studies. Furthermore, the few empirical studies that have been conducted are replete with intractable problems.

In this essay, Margaret Brinig discusses some of the problems researchers have encountered in their attempts to conduct empirical work in the area of family law. For example, most researchers have used state cross-sectional data for their experiments. Reliance on this type of data can …

Using Therapeutic Jurisprudence To Bridge The Juvenile Justice And Mental Health Systems, Michael S. Jenuwine, Gene Griffin Jan 2002

Using Therapeutic Jurisprudence To Bridge The Juvenile Justice And Mental Health Systems, Michael S. Jenuwine, Gene Griffin

Journal Articles

The article reviews the concept of therapeutic jurisprudence, integrating mental health principles into the juvenile justice system and the sentencing of juveniles. It discusses reasons why mental health and juvenile justice systems have not worked well together in the United States. The author describes current theories of juvenile justice and community health that would allow these systems to work better together, such as Balanced and Restorative Justice and the Child and Adolescent Service System Program. He explains how these theories can be better integrated into the juvenile justice system and argues that the best hope for therapeutic jurisprudence lies in …

How Much Does Legal Status Matter? Adoptions By Kin Caregivers, Margaret F. Brinig, Steven L. Nock Jan 2002

How Much Does Legal Status Matter? Adoptions By Kin Caregivers, Margaret F. Brinig, Steven L. Nock

Journal Articles

Virtually all the legislation dealing with families that include children begins with a "best interests of the child" premise.' Most, if not all, of the litigated results at least seem to maximize the outcomes for adults. This discrepancy should not be surprising, for both substantive and procedural reasons.

The substantive reason, as even the Supreme Court has noted, is that most of the time, what is good for parents will also be good for children. Moreover, having parents who possess many "rights" allow them to better exercise their parental responsibilities. From a procedural perspective, adults are usually the named parties …

Domestic Partnership: Missing The Target?, Margaret F. Brinig Jan 2002

Domestic Partnership: Missing The Target?, Margaret F. Brinig

Journal Articles

Chapter 6, Domestic Partnerships, like many other parts' of the ALI Principles of the Law of Family Dissolution, functions as a set of default rules. Under the ALI Principles for domestic partnerships, therefore, if the parties meet state presumptive requirements for domestic partnerships and have not otherwise contracted, the rules of Chapter 6 apply. Usually, law sets default provisions to 1) what most parties would want; or 2) to what will promote efficiency. I will discuss these two concepts in turn, illustrating how the ALI domestic partnerships provisions satisfy neither ex ante hypothetical bargaining nor efficiency criteria, and thus that …

An Unconstitutional Stereotype: Catholic Schools As Pervasively Sectarian, Gerard V. Bradley Jan 2002

An Unconstitutional Stereotype: Catholic Schools As Pervasively Sectarian, Gerard V. Bradley

Journal Articles

The Supreme Court first held public assistance to religious schools unconstitutional in 1971 in Lemon v. Kurtzman. From then until now the concept of “pervasively sectarian” has played a central role in “parochaid” jurisprudence; every holding against “direct” aid has rested upon it as a necessary premise. “Pervasively sectarian” refers to the assertedly religious (“sectarian”) character of the entire curriculum at parochial schools. Religion, it is said, so permeates the whole educational program that “direct aid” to any aspect of that program inescapably aids religion itself. And that, it is said, violates the Establishment Clause. Because aid statutes typically aim …

Veteran Teacher Perceptions Of The Grossmont Model Of Peer Assistance And Review. Is It A Viable Alternative To Traditional Evaluation?, Edwin L. Basilio Edd Jan 2002

Veteran Teacher Perceptions Of The Grossmont Model Of Peer Assistance And Review. Is It A Viable Alternative To Traditional Evaluation?, Edwin L. Basilio Edd

Dissertations

This study looked at factors that influenced veteran teacher perceptions of the newly implemented Peer Assistance and Review (PAR) program in the Grossmont Union High School District. More specifically, the study explored (1) reasons why teachers with at least five years of successful teaching experience voluntarily chose to forfeit their regularly scheduled traditional evaluation and substitute it with a peer review, (2) factors that contributed to positive perceptions of the PAR program, (3) factors that contributed to negative perceptions of the PAR program, and (4) perceived differences between the traditional and PAR methods of teacher evaluation. This study incorporated multiple …

Introduction: The Virtues And Vices Of Skeptical Environmentalism, Jonathan H. Adler, Andrew P. Morriss

Faculty Scholarship

Introduction Extract:

The Skeptical Environmentalist: Measuring the Real State of the World by Bjorn Lomborg' is the most talked about environmental book in recent memory. Lomborg's central thesis is relatively straightforward: "Our doomsday conceptions of the environment are not correct." To the contrary, in recent decades humanity's lot has "improved in terms of practically every measurable indicator." Lomborg is not the first author to make this argument,4 but his book is the first to spark such a maelstrom of public attention. Its publication ignited controversy and debate on both sides of the Atlantic. Lomborg himself, an associate professor of statistics …

Persistence And Visibility Of Group Faultlines: A Theoretical Model Of The Effect Of Group Culture And Team Identity On The Group Faultlines-Organizational Conflict Link, Katerina Bezrukova, Karen A. Jehn, Madhan Gounder Jan 2002

Persistence And Visibility Of Group Faultlines: A Theoretical Model Of The Effect Of Group Culture And Team Identity On The Group Faultlines-Organizational Conflict Link, Katerina Bezrukova, Karen A. Jehn, Madhan Gounder

Psychology

We expand the group faultline theory by taking into account the relative importance of various demographics within the group that can trigger the formation of strong group faultlines. We draw on group faultline theory (Lau & Murnighan, 1998), social identity and categorization theories (Turner & Tajfel, 1986), social dominance theory (Sidanius & Pratto, 1999), and evolutionary psychology (Kurzban & Leary, 2001) to predict how group faultlines affect conflict. We propose that the visible demographic characteristics (age, race, and gender) will be more influential than the non-visible (education, tenure, and function) in determining the interaction patterns within the group (Thatcher & …

The Effects Of Cross-Level Conflict: The Moderating Effects Of Conflict Culture On The Group Faultlines - Performance Link, Katerina Bezrukova, Karen A. Jehn Jan 2002

The Effects Of Cross-Level Conflict: The Moderating Effects Of Conflict Culture On The Group Faultlines - Performance Link, Katerina Bezrukova, Karen A. Jehn

Psychology

We examine how task, relationship, and process conflicts arise from group faultlines. We define group faultlines as hypothetical dividing lines that split a group into subgroups based on the group members' attributes (adapted from Lau & Murnighan, 1998). We further link group conflict to performance, and predict different effects for individual performance, group performance, and employee satisfaction. We also examine the moderating effect of the organizational conflict culture on the relationship between group faultlines and group conflict. We define conflict culture as employees' beliefs about the amount and intensity of a certain type of conflict (i.e. task conflict, relationship conflict, …
