Suppose It's Not True: Challenging Mediation Ideology, Deborah R. Hensler Jan 2002

Suppose It's Not True: Challenging Mediation Ideology, Deborah R. Hensler

Journal of Dispute Resolution

Across the country, people who file lawsuits are being diverted from adjudication to mediation. Whereas once mediation was seen as the preferred means of resolving family disputes (especially those involving child custody), now it is mandated for a broad range of civil disputes. Whereas once citizens were called upon to volunteer as mediators in community justice centers outside the courts, now mediation is a line of business for lawyers whose customers are sent to them by the courts. Whereas once dispute resolution theorists called on courts to provide a variety of procedural choices for civil disputants, now courts order litigants …

Disputants' Decision Control In Court-Connected Mediation: A Hollow Promise Without Procedural Justice, Nancy A. Welsh Jan 2002

Disputants' Decision Control In Court-Connected Mediation: A Hollow Promise Without Procedural Justice, Nancy A. Welsh

Journal of Dispute Resolution

Such a uniform commitment to procedural justice might seem natural for the courts. However, the procedural due process jurisprudence indicates that the courts' appreciation of procedural justice is unlikely to translate easily to processes in which the disputants, not the courts, are deemed to exercise control over outcomes. Given the current state of procedural due process jurisprudence, courts may lack both the desire and the ability to demand procedural justice in third party processes that are classified as "consensual." Ironically then, disputants' decision control, which is meaningful to mediation advocates and the courts but a rather hollow promise for disputants, …

The Rules Of Inference, Lee Epstein, Gary King Jan 2002

The Rules Of Inference, Lee Epstein, Gary King

University of Chicago Law Review

Although the term "empirical research" has become commonplace in legal scholarship over the past two decades, law professors have in fact been conducting research that is empirical--that is, learning about the world using quantitative data or qualitative information--for almost as long as they have been conducting research. For just as long, however, they appear to have been proceeding with little awareness of, much less compliance with, many of the rules of inference, and without paying heed to the key lessons of the revolution in empirical analysis that has been taking place over the last century in other disciplines. The tradition …

The Creative Destruction Of Copyright: Napster And The New Economics Of Digital Technology, Raymond Shih Ray Ku Jan 2002

The Creative Destruction Of Copyright: Napster And The New Economics Of Digital Technology, Raymond Shih Ray Ku

University of Chicago Law Review

To determine whether sharing music over peer-to-peer networks such as Napster should be considered copyright infringement, we must first conclude that digital works are entitled to copyright protection. This Article argues against copyright protection for digital works because the economics of digital technology undercuts prior assumptions about the efficacy of a private property regime for information, a public good. Questioning the conventional wisdom that the two interests served by copyright, creation and public dissemination, are aligned, the Article reveals that the argument for copyright is primarily an argument for protecting content distributors in a world in which middlemen are obsolete. …

Medical, Social And Legal Implications Of Treating Nausea And Vomiting Of Pregnancy, Robert L. Brent Jan 2002

Medical, Social And Legal Implications Of Treating Nausea And Vomiting Of Pregnancy, Robert L. Brent

The Selected Works of Robert Brent

This article will deal with medical, social, and legal implications of treating nausea and vomiting of pregnancy (NVP). Clinical problems occur when the symptoms become exaggerated and result in debilitation, dehydration, and hospitalization. The treatment of NVP in its early stages has the implication that it will prevent the more serious complications, including hospitalization. Therapeutic modalities discussed in this conference that have been used or are being tested are primarily symptomatic treatments (antihistamines, Bendectin (Merrell Dow; Cincinatti, Ohio), phenothiazines, hyponosis, accupressure, relaxation behavioral modification, audiogenic feedback training, newer medications, diet, and nutritional support). Bendectin is probably the most studied medication …

All-Inclusive List of Electronic Theses and Dissertations

The purpose of this study was to determine if there is a significant difference between administrators' and adult students' perceptions of quality indicators for off-campus programs at Eastern Illinois University. The focus of the research was based on the perceptions of two distinct groups: administrators at Eastern Illinois University and adult students enrolled in off-campus courses at Eastern Illinois University. The study also sought to provide a list of designated quality indicators to be used by Eastern Illinois University and other higherEducation institutions with similar characteristics to evaluate off-campus programs. There are twenty-six quality indicators that this research identified grouped …
