Oh, Ye Of Little (Good) Faith: Questions, Concerns And Commentary On Efforts To Regulate Participant Conduct In Mediations, Roger L. Carter Jul 2002

Oh, Ye Of Little (Good) Faith: Questions, Concerns And Commentary On Efforts To Regulate Participant Conduct In Mediations, Roger L. Carter

Journal of Dispute Resolution

There are many types of mediation. This article focuses exclusively on mediations within Professor Lande's "liti-mediation culture" - those dealing with disputes that are or may become the subject of litigation. I address both court-connected and private mediations as I believe that the potential for bad faith exists in both. Following this Introduction, in Part II, I examine definitions of "good faith" in mediation, I then review commentary and case law on good faith requirements. In Part III, I argue that certain objectively determinable behavior ought to be proscribed. By contrast, some good faith standards adopted by courts or advocated …

The Effects Of Cooperative Learning On Mathematics Achievement For Third Grade Students, Angelina M. Carione

Theses and Dissertations

The purpose of this study was to examine the effects of cooperative learning on mathematics achievement. It was hypothesized that students who worked cooperatively during mathematics practice would achieve a higher test score on the post-test than students who did not work together. The subjects of the study were forty third grade students form a southern New Jersey school district. The study consisted of an experimental and a control group. Both groups were administered a pre-test. The experimental group then participated in cooperative learning during mathematics practice for a seven-week period. Both groups were post-tested after seven weeks.

"She Had Never Humbled Herself" Alexandra Bergson And Marie Shabata As The "Real" Pioneers Of O Pioneers!,/I>, Douglas W. Werden

Great Plains Quarterly (through 2013)

Willa Cather's O Pioneers! (1913) has traditionally been read within the twin contexts of Cather's pioneering childhood and her nostalgic reminiscences that glorify the lives of prairie settlers. These critics interpreted the novel in light of Walt Whitman's poem of the same name in Leaves of Grass, which celebrates the conquering American pioneer who "civilizes" the land for production.1 More recent critics have contextualized it within her family history, agricultural history, domestic plots, American migration, and women leaving the home.2 However, if we consider O Pioneers! in relation to the gender role redefinitions of Cather's adult life, …

Court Review: Volume 39, Issue 2 - The Parenting Of Men Who Batter, Lundy Bancroft

Court Review: Journal of the American Judges Association

The published research on children’s exposure to domestic violence focuses largely on two aspects of their experience: the trauma of witnessing physical assaults against their mother, and the tension produced by living with a high level of conflict between their parents. As important as these factors are, they reflect only one aspect of many complex problems that typically pervade the children’s daily lives. The bulk of these difficulties have their roots in the fact that the children are living with a batterer present in their home. The parenting characteristics commonly observed in batterers have implications for the children’s emotional and …

Court Review: Volume 39, Issue 2 - Making A Difference: Tools To Help Judges Support The Healing Of Children Exposed To Domestic Violence, Lavita Nadkarni, Barbara Zeek Shaw

Court Review: Journal of the American Judges Association

Domestic violence has emerged from the privacy of one’s own home, where only the victims were aware of the abuse, to more public domains, where one can witness the impact of such abuse on society through our court system. Judges, in both the civil and criminal arenas, exercise considerable power in instituting a wide range of possible dispositions in cases involving domestic violence. The Family Violence Prevention Fund’s National Judicial Education Advisory Committee concluded that judges made the most significant decisions affecting the lives of victims, abusers, and their children. Judges can also play a significant role in shaping society’s …

Court Review: Volume 39, Issue 2 - Screening For Domestic Violence: Meeting The Challenge Of Identifying Domestic Relations Cases Involving Domestic Violence And Developing Strategies For Those Cases, Julie Kunce Field Jul 2002

Court Review: Volume 39, Issue 2 - Screening For Domestic Violence: Meeting The Challenge Of Identifying Domestic Relations Cases Involving Domestic Violence And Developing Strategies For Those Cases, Julie Kunce Field

Court Review: Journal of the American Judges Association

Domestic abuse is common. It includes emotional and psychological abuse as well as physical assaults. Children are harmed by it, even if they are not the direct victims of the physical violence.
Because domestic abuse is so prevalent and its effects are so far-reaching, court personnel must educate themselves to understand domestic violence and determine strategies for handling cases where it is present. Even if domestic violence is present but does not seem to have a direct impact on the case at hand, one should be aware of the power and control dynamics of domestic abuse to provide effective intervention …

Gallery Of The Doomed: An Exploration Of Creative Endeavors By The Condemned, Roberta M. Harding

Law Faculty Scholarly Articles

This Article examines creative expressions produced by the death row faction of the incarcerated population. Looking at these works provide insights about what it means to live as a condemned person in our society, and about the people who occupy the death rows across our nation. After reviewing and analyzing a substantial amount of the enormous body of work of this genre, it became apparent that the condemned's creative endeavors reflect how they address and handle serious issues such as their executions and the ways spirituality influences their life. When the individual issues are examined, two general themes are evident: …
