Free Speech Rationales After September 11th: The First Amendment In Post-World Trade Center America, Marin Roger Scordato Jan 2002

Free Speech Rationales After September 11th: The First Amendment In Post-World Trade Center America, Marin Roger Scordato

Scholarly Articles

The tragic events of September 11th generated numerous proposals for greater security measures and increased police powers that might, if implemented, constrict the customary scope of free speech in the United States. Legitimate concerns for internal security have placed increased pressures on traditional constitutional protections for expressive activity. It is against this backdrop that this article presents a careful examination of the basic rationales for adopting constitutional level protections for free speech. The article analyzes the nature of, and many of the conflicts among, the traditional rationales for a constitutional right of free expression. It also suggests that much of …

The Transformation Of China's Health Care System And Accounting Methods: Current Reforms And Developments, David Chu, Kolleen Rask Jan 2002

The Transformation Of China's Health Care System And Accounting Methods: Current Reforms And Developments, David Chu, Kolleen Rask

Economics Department Working Papers

This paper is a case study of China’s recent reforms in hospital accounting. We analyze the Chinese health care system in transition to highlight the changing role and nature of accounting services before and after the recent reforms. Prior to reforms, the accounting system provided data solely for government central planning purposes. Reforms were supposed to decentralize hospital decision making, thus signaling a need for a new accounting system that would provide information to managers and resource providers. However, the government continues to maintain control by fixing basic medical service prices at levels below cost while allowing profit margins for …

Forensic Interviews Of Children: The Components Of Scientific Validity And Legal Admissibility, Nancy E. Walker

Law and Contemporary Problems

The problems associated with assessments of children's reports of victimization in criminal proceedings came to national attention during the 1980s and 1990s in a series of highly publicized trials of daycare staff. Walker describes information that professionals need to know if they are to conduct valid interview of children in forensic contexts.

Xml-Based Modeling And Simulation: Web Service Technologies And Their Synergy With Simulation, Senthilanand Chandrasekaran, Gregory S. Silver, John A. Miller, Jorge Cardoso, Amit P. Sheth

Kno.e.sis Publications

The World Wide Web has had an huge influence on the computing field in general as well as simulation in particular (e.g., Web-based simulation). A new wave of development based upon XML has started. Two of the most interesting aspects of this development are the Semantic Web and Web services. This paper examines the synergy between Web service technology and simulation. In one direction, Web service processes can be simulated for the purpose of correcting/improving the design. In the other direction, simulation models/components can be built out of Web services. Work on seamlessly using simulation as a part of Web …

Authorization And Access Control Of Application Data In Workflow Systems, Shengli Wu, Amit P. Sheth, John A. Miller, Zongwei Luo Jan 2002

Authorization And Access Control Of Application Data In Workflow Systems, Shengli Wu, Amit P. Sheth, John A. Miller, Zongwei Luo

Kno.e.sis Publications

Workflow Management Systems (WfMSs) are used to support the modeling and coordinated execution of business processes within an organization or across organizational boundaries. Although some research efforts have addressed requirements for authorization and access control for workflow systems, little attention has been paid to the requirements as they apply to application data accessed or managed by WfMSs. In this paper, we discuss key access control requirements for application data in workflow applications using examples from the healthcare domain, introduce a classification of application data used in workflow systems by analyzing their sources, and then propose a comprehensive data authorization and …

So Young And So Untender: Remorseless Children And The Expectations Of The Law, Martha Grace Duncan Jan 2002

So Young And So Untender: Remorseless Children And The Expectations Of The Law, Martha Grace Duncan

Faculty Articles

A nine-year-old speaks with apparent callousness as he walks by the body of the girl he has killed. A fourteen-year-old jokes about "body parts in her pocket" after bashing in her mother's head with a candlestick holder. And a fifteen-year-old laughingly names his accomplice ''Homicide" after participating in a robbery that culminated in the victim's death. Seemingly remorseless acts such as these can have a crucial impact on the way a child or adolescent fares in the juvenile justice or criminal system. Yet, when one looks closely at what the courts interpret as indicators of remorselessness -- taking into account …

Fbi Internet Surveillance: The Need For A Natural Rights Application Of The Fourth Amendment To Insure Internet Privacy, Catherine M. Barrett Jan 2002

Fbi Internet Surveillance: The Need For A Natural Rights Application Of The Fourth Amendment To Insure Internet Privacy, Catherine M. Barrett

Richmond Journal of Law & Technology

Last year, the Federal Bureau of Investigation (“FBI”) acknowledged that it used an Internet electronic surveillance system called Carnivore to investigate and prosecute criminal suspects in more than two dozen cases. Carnivore is a software program developed by the FBI that can be installed on the network of an Internet Service Provider (“ISP”), such as America Online, to monitor, intercept and collect e-mail messages and other Internet activity made and received by individuals suspected of criminal activity. To date, the full capability of Carnivore remains a secret—the FBI refuses to disclose the source code (computer language) that would reveal how …

Bloom V. Commonwealth: Identifying The Face Behind The Instant Message, Jessica Clair Cobaugh Jan 2002

Bloom V. Commonwealth: Identifying The Face Behind The Instant Message, Jessica Clair Cobaugh

Richmond Journal of Law & Technology

"You have an instant message from Naturalbornkiller2000. Would you like to accept it?" A similar message to this one flashes on computers throughout the United States and the world, inviting computer users to "chat" or "IM" with friends, family and perfect strangers alike. While the opportunity to engage in real-time conversation over the Internet provides an interesting and often less expensive way to keep in touch with friends or to meet new people, instant messages and other Internet communications increasingly appear as a means for adults to interact inappropriately with young children. The use of Internet communication for the solicitation …

A Counter-Pedagogy For Social Justice: Core Skills For Community Lawyering, Shin Imai Jan 2002

A Counter-Pedagogy For Social Justice: Core Skills For Community Lawyering, Shin Imai

Articles & Book Chapters

An important component of lawyering for social justice is working in communities. In addition to conventional skills, such as legal analysis and litigation, community-based lawyers need skills not taught in the mainstream curriculum. This article describes a counter-pedagogy for teaching students three core skills for community lawyering: how to collaborate with members of the community, how to acknowledge personal identity, race and emotion, and how to take a community perspective on legal problems. The author argues that these skills cannot be taught in isolation, but should be integrated into the teaching itself, including the teaching of substantive areas of the …

On Legalism, Popular Agency And "Voices Of Suffering": The Nigerian National Human Rights Commission In Context, Obiora Chinedu Okafor, Shedrack C. Agbakwa Jan 2002

On Legalism, Popular Agency And "Voices Of Suffering": The Nigerian National Human Rights Commission In Context, Obiora Chinedu Okafor, Shedrack C. Agbakwa

Articles & Book Chapters

The set of standards for the evaluation of National Human Rights Commissions (NHCs) formulated and applied by the UN constitute the dominant conception of an ideal NHC. Virtually every scholar, nongovernmental organization, and governmental body that has commented on the effectiveness of NHCs shares this dominant UN-driven conception of the ideal NHC. However, this dominant conception is significantly limited, and requires fundamental enlargement and revision if the NHCs animated by its vision are to have a significantly increased transformative potential. A performance assessment study of the Nigerian National Human Rights Commission (using the more holistic vision of ideal NHC developed …

Rape Risk Reduction Materials: How Do University Students Of Color Perceive The Cultural Relevancy Of These Materials?, Anita L. Vorreyer-Hedges Jan 2002

Rape Risk Reduction Materials: How Do University Students Of Color Perceive The Cultural Relevancy Of These Materials?, Anita L. Vorreyer-Hedges

UNF Graduate Theses and Dissertations

Few studies have investigated how race and ethnicity influence people's beliefs about rape, or what impact these beliefs have on what and how we teach college students in efforts to raise awareness about rape. The purpose of this study was to gain understanding of how students of color perceive the cultural relevance of materials commonly used on campuses for rape risk reduction education. Participants were African American and Hispanic students at a mid-sized state university. Focus group sessions and interviews were conducted with 23 student participants. Students reported that they found the rape risk reduction materials culturally relevant; however, other …

Defining Imaginary Audience Scores Via Gender Attributes Versus Biological Gender, George M. Freeman Jan 2002

Defining Imaginary Audience Scores Via Gender Attributes Versus Biological Gender, George M. Freeman

UNF Graduate Theses and Dissertations

Imaginary audience scores for males and females have not demonstrated consistent differences in the literature. In this study, scores on the Imaginary Audience Scale (lAS) and on the Imaginary Audience subscale of the Adolescent Egocentrism-Sociocentrism scale (ABS) were compared to self-rating of gender attributes on the Personality Attributes Questionnaire (PAQ). Results for 64 females and 32 males surveyed at a southeastern university indicate that one's self-rating of gender attributes correlates with imaginary audience scores while biological gender does not. As masculine attribute scores increase, lAS scores and Abiding Self subscale scores decrease. As masculine-feminine attribute scores (traits favored by both …

Transformational Leadership And Moral Discourse In The Workplace And Civil Society, John W. Frank Jan 2002

Transformational Leadership And Moral Discourse In The Workplace And Civil Society, John W. Frank

UNF Graduate Theses and Dissertations

This study was grounded in the theory and practice of transformational leadership, where leaders function as moral agents of change as they facilitate values talk (moral discourse) among their constituents. The study took its cue from Rost's call for a new paradigm for leadership ethics that calls for methods of group moral decision making to assess organizational and social ends. The inquiry sought to better understand how leaders engage others in moral conversation and how such processes influence organizational culture and democratic civil society.

The methodology was qualitative and phenomenological as it was centered on leaders' perceptions of their experiences …

A Moment In The The Times: Law Professors And The Court-Packing Plan, Kyle Graham Jan 2002

A Moment In The The Times: Law Professors And The Court-Packing Plan, Kyle Graham

Faculty Publications

When Franklin Roosevelt unveiled his "court-packing" plan, law professors found themselves in an unfamiliar position. For perhaps the first time ever, their professional opinions were being sought by journalists and politicians, for consumption by the general public. In faculty meetings and private correspondence, law professors considered the propriety of taking a stand for or against the President's plan. Ultimately, some professors chose to go public with their support (or opposition); others considered such commentary as a form of advocacy that was incompatible with their job descriptions. This article relates and examines the debate among law professors over both the court-packing …

A Theoretical Proposal For Reaching Irreligious Czech People Through A Mission Revitalization Movement, Petr Činčala Jan 2002

A Theoretical Proposal For Reaching Irreligious Czech People Through A Mission Revitalization Movement, Petr Činčala

Dissertations

The main goal of this study was to develop a theory of missionary outreach to unchurched Czech people which is biblically informed and culturally relevant. The theoretical proposal for a plausible model of churching in the Czech Republic builds on basic theological, philosophical, and conceptual assumptions (chapter 2), a societal analysis of the problem of Czech churching (chapter 3), and a review of the issues relating to the situation of existing churches and religious movements.

Based on Wallace’s theory of revitalization movements a model is developed for starting a missionary movement that aims at reaching today’s unchurched and seemingly irreligious …
