Technological breakthroughs occasionally set off floods of inventions and associated patents. The decline of the business method exception to patentability is likely to increase the frequency of patent floods. Future technological breakthroughs might now cause two different patent floods: a flood of patents covering the relevant technology, and a flood of patents covering business methods in the new market opened by the breakthrough. Furthermore, a technological breakthrough is no longer a precondition for a patent flood. Any factor that opens a new market might cause a future flood of business method patents.

This paper develops an account of the role and significance of managerial power and rent extraction inexecutive compensation. Under the optimal contracting approach to executive compensation, which has dominated academic research on the subject, pay arrangements are set by a board of directors that aims to maximize shareholder value. In contrast, the managerial power approach suggests that boards do not operate at arm's length in devising executive compensation arrangements; rather, executives have power to influence their own pay, and they use that power to extract rents. Jürgen Habermas's recent work on law and democracy divides into two parts. With his "discourse theory of law and democracy," Habermas seeks to explain the conditions under which modern constitutional legal and political orders may claim legitimacy. Here Habermas's method is primarily philosophical and legal-theoretical. The second part of the project – the part on which this article focuses – develops what Habermas calls his "communication theory of society." Here Habermas seeks to "translate" the normative conclusions of his discourse theory into a substantive social-theoretical model. The war on drugs has spawned a second front-a war on education. The casualties of this war are all poor or lower-income people who cannot afford to buy a private education. This article details the consequences of this other war, and explores some legislative and litigation strategies for reclaiming educational opportunity for all Americans. First, however, we must set out in more detail the laws and policies that now deploy educational privation as punishment in public schools, colleges, and prisons.

Discusses the Native American view of Crater Lake, Oregon, as a place of religious significance and the misunderstandings with whites as to its importance to Oregon's Indian tribes. Created some 6,500 years ago by volcanic eruption, Crater Lake has long been seen by Indians as a sacred place. Their hunting, berry gathering, and vision quests in the lake area were tied to their religious view of the lake. Since the 1850's, whites have treated the lake with a lack of understanding of its significance to the Klamath tribes. Governmental agencies have set regulatory values on the concentration of dye-related color that can be released in textile mill effluents. A proprietary biotic and abiotic technology treatment train was built at a candidate facility in northwestern Georgia to reduce the organic content and dye-related color content in the textile mill’s effluent. Laboratory experimentation began with bench scale 4 L immobilized microbe (IMBR) bioreactor tests to biologically treat primary wastewater streams, namely skein dye and space dye, from this candidate facility. The biological treatment reduced the organic content levels, expressed as chemical oxygen demand (COD), from 3185±30 to 290±20 mg/L (COD …

This seepage can cause weakening in the levee structure, which in turn can cause sudden levee failure or overtopping of the levee due to levee depression. In speaking to The Enigma of the First Assignment. the premise of this paper is explained with a studio in which a design project is addressed through sets of rules. Rules fall into three categories: for program, for site, and for assembly. These rules were left open-ended and they provided the first footholds for a student to get to work designing and not ponder the much larger problem of design itself.

The thesis of this Article is that the distinction between voluntary student prayer, and state-sponsored prayer, has arguably become the central consideration in analyzing school prayer cases. Not only was this distinction emphasized by the Court in Santa Fe and prior cases, but it perhaps best explains the Court's results in the cases. The distinction is one which best balances the competing constitutional concerns potentially present in school prayer cases. In particular, it guards against the primary Establishment Clause concerns. The distinction is also one which overlaps substantially with concerns about state coercion and endorsement of religion. The objectives of the first experiment were to ascertain if there were any differences between two mouse areola and adipose tissue cell lines. These cell lines differed only in the presence or absence of the hypoxanthine phosphoribosyl transferase (HPRT) gene. It was found that the cell lines were similar for all parameters. The objectives of the second experiment were to determine if the HPRT gene had an effect on the development of preimplantation mouse embryo. To test this transgenic mouse lines were created. The purpose of this study is to examine the predictors that influenced the interactivity of U.S. daily newspapers Web sites, namely the market size of newspapers, newspapers ownership, the number of online newspaper technical staff, length of newspaper Web site existence. Whether a national newspaper has different interactive Web site from a local newspaper is also studied. A content analysis of 106 U.S. daily newspapers Web sites found that market size and length of time newspapers having Internet presence sites are correlated to the interactive level of newspapers Web sites. Split-beam hydroacoustic sampling with two, 420 KHz, 2x6 degree elliptical transducers was evaluated as a tool to quantify nekton movements in a Louisiana estuary. I measured the effects of atmospheric cold front passages on nekton in a tidal creek in Port Fourchon, LA during the fall of 2000. Six “fronts” were sampled between October 6 and December 18, 2000. Nekton density ranged from 0 to 24.4 fish/m3 with an overall mean of 2.44 fish/m3. Net samples were taken to supplement the acoustic data with species composition data. All-Optical Networks employing Dense Wavelength Division Multiplexing (DWDM) are believed to be the next generation networks that can meet the ever-increasing demand for bandwidth of the end users. This thesis presents some new heuristics for wavelength assignment and converter placement in mesh topologies. Our heuristics try to assign the wavelengths in an efficient manner that results in very low blocking probability. We propose novel static and dynamic assignment schemes that outperform the assignments reported in the literature even when converters are used. The proposed on-line scheme called "Round-Robin" assignment outperforms previously proposed strategies such as first-fit and random assignment schemes. …

Coptotermes formosanus was used as “bait” to isolate pathogenic fungi from soil. Fifteen pathogenic fungal isolates were obtained, all either Metarhizium anisopliae (six isolates) or Beauveria bassiana (nine isolates). There were no differences in numbers of fungal isolates from the three sampling locations. However, significantly more isolates were found in woodlands (eleven) than in pastures (four). Median lethal doses (LD50s) of these fungal species to C. formosanus were interspersed, indicating that fungal isolates rather than species had the greatest effect on virulence. In vitro growth characteristics were significantly correlated with virulence against termites, suggesting that fungal virulence might be predicted …

Sperm from zebrafish, Danio rerio, and Nile tilapia, Oreochromis niloticus, were microinjected directly into egg cytoplasm to evaluate the potential for developing a novel method of fertilization. In zebrafish, the sperm of two lines (wild-type and gold, long-fin) were injected with or without activation into activated and non-activated eggs. No significant difference (P = 0.997) in fertilization by intracytoplasmic sperm injection (ICSI) was observed between the two lines or when the sperm were activated or not (P = 0.057). There was significance difference in fertilization between activated and non-activated eggs (P = 0.010). The highest fertilization rate was achieved by …

Welfare, a mainstay of legal services practice, is cutting edge again. Clients need help negotiating a system that devolution, discretion, and privatization have changed radically. Public officials need help in this new environment to "get it right," so that programs achieve the laudable goals ascribed to them.

Privatization creates special challenges for welfare advocates. New players, ranging from neighborhood nonprofit organizations to churches to multinational corporations, are making decisions that affect clients' vital interests. In this essay, the authors seek to dispel the myth that the juvenile court was never intended to deal with serious and violent offenders; a myth that has largely been unchallenged, especially in the mainstream media, and one that critics of the juvenile court have used to undermine its legitimacy. Due to its high market value, Florida pompano (Trachinotus carolinus) has long been regarded as a promising species for aquaculture. Although pompano exhibit several favorable traits for culture, previous studies have indicated that fish larger than 200 g exhibit poor growth. This study was conducted to determine the effects of different feeding strategies on production characteristics of pompano raised in closed recirculating systems. The kinetics of fecal coliforms (FC) decay and regrowth were analyzed under laboratory conditions using filtered dairy wastewater under anaerobic conditions. The mean specific growth rates during the regrowth phase, µr , in the batch study were 1.79, 1.46, and 1.27d-1 for initial organic carbon concentrations of 478, 235 and 127 mg/L COD, respectively. The substrate concentrations had a significant impact on the FC regrowth. A maximum specific growth rate (mmax) of 1.92 d-1, and half-saturated coefficient (ks) of 60.92mg/L were determined from these data. In recent years, biofiltration technology has been used at numerous locations worldwide as an air pollution control technology for treating gases contaminated with low concentrations of biodegradable volatile organic compounds (VOCs). At the same time, there have been many reports in the literature of contaminant emissions from biofilters during transient loading conditions. There is currently a need to develop methods for controlling such emissions. This thesis, through an experiment of 108 subjects, studies the relationship between the presence of a Uniform Resource Locator (URL or web address) in newspaper advertisements and perception of the product advertised as well as the likelihood to act on the advertisement. The findings reveal URLs do in fact have an effect on perception, although, as it is suggested in the theoretical framework, it does not necessarily induce the subjects to act on the ad. Although considered private recreational matters by some, gambling and having sex are gaining spotlight in the addiction arena.
