How The "Equal Opportunity" Sexual Harasser Discriminates On The Basis Of Gender Under Title Vii, Kyle F. Mothershead May 2002

How The "Equal Opportunity" Sexual Harasser Discriminates On The Basis Of Gender Under Title Vii, Kyle F. Mothershead

Vanderbilt Law Review

Americans commonly know that federal law prohibits workplace sexual harassment. Many might be surprised to find, however, that generally courts have not found liability in the case of the so-called "equal opportunity" harasser.' A simple hypothetical will explain the nature of this peculiar species of harasser. Suppose Ken and Carol are both employed at Happyfun, Inc. as manufacturers of reindeer Christmas ornaments under the direction of their supervisor, Fred. Fred corners each of them daily and asks, "How about some sex today?" No doubt he is sexually harassing both Ken and Carol. If they sue for relief, however, a judge …

Focal Temperature Change Facilitates The Peak-To-Peak Soleus Hoffmann Reflex And Muscle Response, Bentley Andrew Krause May 2002

Focal Temperature Change Facilitates The Peak-To-Peak Soleus Hoffmann Reflex And Muscle Response, Bentley Andrew Krause

All-Inclusive List of Electronic Theses and Dissertations

Objective: Cryotherapy is a widely used rehabilitative modality in sports medicine. Cooling joint tissues has been observed to facilitate active exercise following injury. Mechanisms effecting motoneuron recruitment during and following cryotherapy are presumed to be both local and central in nature. Focal cooling facilitates motoncuron pool recruitment and may alter the excitability of motoncurons. The purpose of this investigation was to determine if changes in focal temperature alter the characteristics of the maximum peak-to-peak Hoffmann reflex (Hmax) and muscle response (Mmax). Design and setting: A 4x5 factorial design with repeated measures on time was used in this study. Hmax and …

The Disappearing Settlement: The Contractual Regulation Of Smith & Wesson Firearms, Charles C. Sipos May 2002

The Disappearing Settlement: The Contractual Regulation Of Smith & Wesson Firearms, Charles C. Sipos

Vanderbilt Law Review

Consider three transactions: (1) federal legislation passed by Congress; (2) an order of judgment in a private lawsuit; and (3) a contractual arrangement between private parties. If one were asked to rank those transactions in order of the potential impact they should have on public and social policy, they would probably appear in the order that they are listed. Intuition, experience, and plain common sense might likely lead to the conclusion that legislation has the greatest impact on public policy, private agreements the least,' and final judgments in litigation somewhere in between. Democratic principles provide very good reasons for this …

The Nature And Nurture Of Economic Outcomes, Bruce Sacerdote May 2002

The Nature And Nurture Of Economic Outcomes, Bruce Sacerdote

Dartmouth Scholarship

The relative importance of biology and envi- ronment is one of the oldest and most prominent areas of scientific inquiry and has been exam- ined by researchers as diverse as David Hume (1748), Charles Darwin (1859), and Sigmund Freud (1930). Social scientists are particularly interested in the degree to which family and neighborhood environmental factors influence a child’s educational attainment and earnings. The stakes in this debate are quite high and far-reaching. As Richard Herrnstein and Charles Murray (1994) point out, the effectiveness of anti- poverty and pro-education policies is largely de- pendent on the degree to which environment matters. …

The Importance Of Bequests And Life-Cycle Saving In Capital Accumulation: A New Answer, Karen E. Dynan, Jonathan Skinner, Stephen P. Zeldes May 2002

The Importance Of Bequests And Life-Cycle Saving In Capital Accumulation: A New Answer, Karen E. Dynan, Jonathan Skinner, Stephen P. Zeldes

Dartmouth Scholarship

As the workhorse of consumption and saving research for the past four decades, the life-cycle model has proved flexible and useful for exam- ining a variety of questions. In a classic paper, Albert Ando and Franco Modigliani (1963 p. 56) stated a key assumption of the basic model: “[t]he individual neither expects to receive nor desires to leave any inheritance.” Although the authors contended that the absence of a bequest motive was not critical to the heart of their results, the assumption set off a long-standing battle over the relative importance of different motives for saving. In an influential study, …

In Vitro Genotoxicity Investigations Of Jet Fuel, Shawna M. Jackman May 2002

In Vitro Genotoxicity Investigations Of Jet Fuel, Shawna M. Jackman

Graduate Theses, Dissertations, and Problem Reports (ETD)

The 60 billion gallons of jet propulsion fuels consumed worldwide create an exposure situation to over two million military and civilian personnel per year. The potential mutagenic, genotoxic and cytotoxic potency of military jet fuel was investigated in this study through in vitro systems such as human peripheral lymphocytes and metabolically competent hepatic cell lines. A battery of genotoxicological evaluations is employed, focusing on the comet assay to examine the induction of DNA damage. Cellular exposures to fuel were carried out directly and indirectly with an ethanol (EtOH) carrier. The fuel was found to be nonmutagenic with and without metabolic …

A demographic data sheet and King Drug Doping in Sport Questionnaire (KDSQ) (King, 1991) was administered to 93 athletes in CHAMPS/Life Skills classes at an Eastern Division I institution. To scale reliability and construct validity, Cronbach's alpha coefficients were obtained and a principal components factor analysis with varimax rotation was run. Findings revealed weak Cronbach alpha …

Effects Of Intertrial Interval And D-Amphetamine On Temporally Organized Behavior Of Pigeons, Lori Marie Lieving May 2002

Effects Of Intertrial Interval And D-Amphetamine On Temporally Organized Behavior Of Pigeons, Lori Marie Lieving

Graduate Theses, Dissertations, and Problem Reports (ETD)

The present experiment examined the effects of intertrial interval and d-amphetamine on pecking of pigeons maintained by an interval bisection task. The side-tracking group responded based on the location of the key and the color-tracking group responded based on the color of the key. Intermediate stimulus durations were tested, separated by either a 10- or 100-s intertrial interval and a range of d-amphetamine doses and saline were administered. Acquisition of performance in the side-tracking group occurred in fewer sessions relative to the color-tracking group. In both groups, the proportion of long responses increased as a function of stimulus duration. These …

The Nonprofit Sector And The New State Activism, Mark Sidel May 2002

The Nonprofit Sector And The New State Activism, Mark Sidel

Michigan Law Review

The burgeoning field of nonprofit and philanthropic law has a new and superb history in Norman Silber's pathbreaking A Corporate Form of Freedom: The Emergence of the Nonprofit Sector. In confronting "the history of efforts to control the creation and permissible purposes for nonprofit corporations by states, and ... the relocation of these efforts to the Internal Revenue Service" (p. 5), Professor Silber effectively deliniates the rich history of our ambiguous, often conflicted attempts to regulate the American nonprofit sector, and points clearly to the ways in which history influences the current complexities of state regulation. From a discredited …

The Case Against Assisted Suicide Reexamined, Ani B. Satz May 2002

The Case Against Assisted Suicide Reexamined, Ani B. Satz

Michigan Law Review

In Toni Morrison's acclaimed novel Beloved, Sethe, a runaway slave woman on the brink of capture, gruesomely murders one of her infant children and is halted seconds before killing the second. Cognizant of the approaching men, Sethe's actions are deliberate, swift, confident, and unflinching. Afterwards, she sits erect in the Sheriff's wagon. The reader is left to struggle, situating the horror of the event within the context of the reality of slavery. Was this an act of mercy tQ prevent the suffering Sethe's child would know as a slave? Is loss of autonomy, even rising to the condition of slavery, …

Nucleation And Coagulation Of Particulate Matter Inside A Turbulent Exhaust Plume Of A Diesel Vehicle, Donghee Kim May 2002

Nucleation And Coagulation Of Particulate Matter Inside A Turbulent Exhaust Plume Of A Diesel Vehicle, Donghee Kim

Graduate Theses, Dissertations, and Problem Reports (ETD)

The objective of this study is to develop a physical model to accurately predict the nucleation, coagulation, and dynamics of particulate matter emission from diesel-fueled engines. The uniqueness of this research is that measured particulate matter (PM) size distribution data is not required a priori to solve the nucleation/coagulation equations; instead the PM concentration is predicted based on the fuel sulfur content, fuel to air ratio, exhaust flow rate, and the ambient conditions. This study presents the CFD modeling of an exhaust plume dispersed from a stack pipe of a tractor truck powered by a 330 HP diesel engine. This …

A Study Of Obstacles To Use Of Methane Gas Produced In Landfills For Energy, Sharee Lynn Bowdidge

UNLV Theses, Dissertations, Professional Papers, and Capstones

The purpose of this study is to examine why landfill generated methane gas is not being treated as a resource, and used more widely as an energy source in the Southwestern United States. In this thesis, I have identified four possible barriers that may describe why this resource is not being used more often at landfill operations: 1) technological difficulties, 2) economic limitations, 3) regulatory constraints, and 4) insufficient desire to use. I have explored each of the possibilities in depth through case study interviews with individuals employed at six landfill operations, and individuals associated with landfill policy making. Although …

Biosecurity research reports

Fluoroacetate, the active ingredient of 1080, occurs naturally in toxic plants in Australia, South Africa, and South America. Manufactured I080 underpins most vertebrate pest control programs in Australia and New Zealand. Fluoroacetate occurs naturally in about 40 plant species in Australia with most of these plants restricted to the south-west of WA.

I080 was introduced to rabbit control programs in the early 1950s and therefore has a long history of proven effectiveness and safety in Australia. There have been few repo1ted problems associated with human safety, environmental persistence, bioaccumulation or impact on populations of non-target species.

In particular, I080 baits …

Inhibition Of Apoptosis By Gamma Interferon In Cells And Mice Infected With Chlamydia Muridarum (The Mouse Pneumonitis Strain Of Chlamydia Trachomatis), Jean-Luc Perfettini, Toni Darville, Alice Dautry-Varsat, Roger G. Rank, David M. Ojcius

All Dugoni School of Dentistry Faculty Articles

The effect of gamma interferon (IFN-γ) on apoptosis due to infection by Chlamydia muridarum (the mouse pneumonitis strain of Chlamydia trachomatis) was studied in epithelial cells in culture and in the genital tracts of mice. IFN-γ concentrations that induce the formation of aberrant, persistent chlamydiae inhibit apoptosis due to C. muridarum infection. In cells treated with an IFN-γ concentration that leads to the development of a heterogenous population of normal and aberrant Chlamydia vacuoles, apoptosis was inhibited preferentially in cells that contained the aberrant vacuoles. The inhibitory effect of IFN-γ appears to be due in part to expression of host …
