Disability, Doctors And Dollars: Distinguishing The Three Faces Of Reasonable Accommodation, Elizabeth Pendo Jun 2002

Disability, Doctors And Dollars: Distinguishing The Three Faces Of Reasonable Accommodation, Elizabeth Pendo

Articles

Despite a decade of litigation, there is no consistent understanding of the reasonable accommodation requirement of Title I of the ADA. Indeed, there are three inconsistent distributive outcomes that appear to comport with the reasonable accommodation requirement: cost-shifting, cost-sharing, and cost avoidance.

One reason for such inconsistent outcomes is a failure to develop a coherent and consistent theory of disability. Because disability has been and continues to be medicalized, this Article takes a fresh look at the medical literature on health, illness, and disability. It recommends the use of the experiential health model over the currently accepted functional health model …

Crisci V. Security Insurance Co.: The Dawn Of The Modern Era Of Insurance: Bad Faith And Emotional Distress Damages, Jeffrey E. Thomas

Nevada Law Journal

I have chosen Crisci v. Security Insurance Co. as "my favorite insurance case" for this symposium issue because it typifies the doctrine of "bad faith," one of the most interesting and important contributions of insurance law to the general body of law. It "typifies" the doctrine with its classic, if somewhat extreme, fact pattern, and with its reliance on the implied covenant of good faith and fair dealing3 for the recognition of a cause of action that sounds in tort. Yet it also represents a potential for bad faith law that has not yet been fulfilled: the promise of …

Tweaking Nato: The Case For Integrated Multinational Divisions, Raymond A. Millen Ltc Jun 2002

Tweaking Nato: The Case For Integrated Multinational Divisions, Raymond A. Millen Ltc

Books, Monographs & Collaborative Studies

As the North Atlantic Treaty Organization (NATO) adapts to the emerging strategic environment, it must consider innovative organizational structures that will allow it to harness the potential of its European partners. NATO's enduring deficiencies and their detrimental effect on military capabilities are examined. The decade following the end of the Cold War has revealed a far different world than envisioned. As the United States ruefully discovered, the reduced threat did not diminish security obligations. NATO's European members hoped otherwise and paid insufficient attention to military capabilities. NATO enlargement exacerbates the existing problems. NATO's integrated military structure does not easily accommodate …

Unexpected Ecological Effects Of Distributing The Exotic Weevil, Larinus Planus (F.), For The Biological Control Of Canada Thistle, Svata M. Louda, Charles W. O'Brien

Svata M. Louda Publications

Rhinocyllus conicus, a weevil introduced for biological control of exotic weeds, has had major nontarget ecological effects on native thistles. Some practitioners have argued that this is an isolated case. We report, however, that another Eurasian weevil (Larinus planus), currently being distributed in North America for the control of Canada thistle (Cirsium arvense), is significantly reducing seed production by a native thistle (Tracy’s thistle, Cirsium undulatum var. tracyi) in Colorado. In 1999 we discovered L. planus feeding in flower heads of Tracy’s thistle near a 1992–1993 biocontrol release site. Of the heads collected, 74% …

Overstreet, Stephen S. Curran, Linda M. Pote, D. Tommy King, Charles K. Blend, Walter D. Grater

Harold W. Manter Laboratory of Parasitology: Faculty Publications

The common pathogenic prodiplostomulum metacercaria in the flesh, mostly near the skin, of pond-produced channel catfish Ictalurus punctatus has been demonstrated to be Bolbophorus damnificus Overstreet & Curran n. sp. The catfish acquires the infection from the snail Planorbella trivolvis, the only known first intermediate host, and the species is perpetuated through the American white pelican Pelecanus erythrorhynchos, as confirmed by experimental infections with nestling and dewormed adult pelican specimens in conjunction with molecular data. It differs from the cryptic species Bolbophorus sp., also found concurrently in the American white pelican, by having eggs 123–129 μm rather …

Thyroid Disease And Pregnancy, Omar M. Malkawi Jun 2002

Thyroid Disease And Pregnancy, Omar M. Malkawi

Saudi Medical Journal

Several important issues must be considered when thyroid disorders occur during pregnancy. These include establishing the diagnosis (including an understanding of the effect of pregnancy and its hormonal changes on the immune system in general and the thyroid function in particular) treatment and uneventful maternal and neonatal outcome. The evaluation and treatment of women with thyroid disease during pregnancy parallels that of nonpregnant women and men, but presents unique problems. In addition some types of thyroid disorders occur only during pregnancy and the postpartum period. Pregnancy complicated by some thyroid disorders is associated with an increased rate of complications to …

Point Prevalence Of Type B Tympanogram In Children, Siraj M. Zakzouk, Khariya A. Abduljawad

Saudi Medical Journal

OBJECTIVE: Otitis media with effusion is a common disease; it is primarily a disease of children. Otitis media with effusion was found as the most common cause of hearing impairment among children. The prevalence varied in different populations. Using otoscopy and tympanometry usually gives a valuable indication of the presence of otitis media with effusion. The aim of this study is to determine the point prevalence of type B tympanogram as a diagnostic and indication of the presence of otitis media with effusion. METHODS: This study was carried out during the period September 1997 through to May 2000. The study …

Malignant Familial Long Qt Syndrome, Raghavan Subramanyan, Poothirikovil Venugopalan Jun 2002

Malignant Familial Long Qt Syndrome, Raghavan Subramanyan, Poothirikovil Venugopalan

Saudi Medical Journal

We report a family with congenital long QT syndrome, an inherited disorder of myocardial repolarization in which affected individuals have prolongation of corrected QT interval on the electrocardiogram and a tendency to develop ventricular arrhythmia, leading to syncope, convulsion or sudden death. Our family is characterized by several affected members (11/16), early onset of symptoms, malignant course prior to diagnosis and good response to beta-blocker therapy. The genetic basis of long QT syndrome has been traced to defective proteins encoding cardiac ion channels. Diagnosis is based on an unexplained prolongation of QT interval >0.45 second in the presence of suggestive …

Membranoproliferative Glomerulonephritis Due To Hepatitis C In Renal Allograft, Ahmed S. Al-Arrayed, Sara M. George, Kamaraju S. Ratnakar Jun 2002

Membranoproliferative Glomerulonephritis Due To Hepatitis C In Renal Allograft, Ahmed S. Al-Arrayed, Sara M. George, Kamaraju S. Ratnakar

Saudi Medical Journal

Membranoproliferative glomerulonephritis type 1 is an etiologically divergent disorder. Hepatitis C with or without cryoglobulinemia is considered one of the principal causes of de novo and post transplant membranoproliferative glomerulonephritis type 1. A 49-year-old male who underwent renal allograft for end stage renal disease developed proteinuria and positive hepatitis C serology during the post-transplant period. This was associated with moderate hepatic dysfunction, which necessitated both liver and renal biopsies. Features of both chronic active hepatitis and membranoproliferative glomerulonephritis type 1 were seen as a result of histological examination of both liver and renal biopsies. Ultra structural studies showing mesangial and …
