Who's Talking? Disentangling Government And Private Speech, Leslie Gielow Jacobs

Several different constitutional rules apply to government actions that influence the content of speech. The government has far more discretion to determine speech content when the government itself is the speaker than when it regulates private speakers. Specifically, in the former circumstance, the government can discriminate according to viewpoint, whereas in the latter circumstance it cannot. While the application of the rules may be obvious when either the government or private entities speak alone, increasingly, through various different types of interactions, government and private groups or individuals are speaking together. One For A, Two For B, And Four Hundred For C: The Widening Gap In Pay Between Executives And Rank And File Employees, Susan J. Stabile
University of Michigan Journal of Law Reform
This Article, focuses on executive pay in relation to that of rank and file workers. It examines the standard justifications for the vast and increasing pay gap between executives (particularly CEOs) and rank and file workers and finds that such arguments do little more than attempt to justify in economic terms a situation that exists for a very different reason. Instead, the author argues, the real reason such a huge and widening gap in pay between executive and rank and file workers exists is market failure in the mechanisms of setting executive pay, aggravated by the shareholder primacy norm, which …

Menstrual beliefs and practices in Bali defy simple classification. Menstruation may be relegated to the dump, as when a woman had to undergo a rite on a street midden when her monthly period coincided with the ritual time for a purification ceremony. But menstruation is also viewed as conferring raja status, and women do exhibit agency in this supposedly passive process. Experiences of menstruation, furthermore, may vary according to caste status.

In deciding whether to issue a preliminary injunction, courts today focus on three factors: the likelihood that plaintiff will ultimately prevail on the merits; the harm defendant will suffer if the injunction is wrongly issued; and the harm plaintiff will suffer if the injunction is wrongly denied. The idea is to account for the possibility that the court might err in its prediction on the merits. If wrongful denial would be particularly harmful and there is a real chance of wrongful denial, the court is more reluctant to deny. By contrast, if wrongful issuance poses the greater threat, the court …

Purpose. The purpose of this case-control study was to determine whether long-term ultrasonic noise exposure via the dental office environment is related to dental hygienists' hearing status.
Methods. Registered dental hygienists (N - 698) who live in the Hampon Roads areas of Virginia were mailed a Dental Hygiene Word History Questionnaire to determine who would meet the inclusion criteria and would be willing to participate in the study. Consenting subjects were categorized into one of two groups, according to ultrasonic sealer usage rate, and matched on age. The role of religion in American politics and civil society has drawn significant scholarly focus, but most of the recent attention has fallen on the religious rights political influence and, more recently, on new initiatives to broaden the channeling of social service funding through faith- based organizations. These are important issues, but they exclude another historically important face of religiously-grounded public engagement: religious pressure for deeper political and economic democracy. We examine a widespread contemporary aspect of such engagement, faith-based community organizing (FBCO), through which poor and middle-income religious congregations advance the interests of their members. Colombia’S War: Toward A New Strategy, John A. Cope

This Strategic Forum paper analyzes the protracted internal conflict in Colombia and evaluates emerging strategic approaches to U.S. and Colombian policy at the onset of President Álvaro Uribe’s administration. It examines how the interplay of narcotics trafficking, insurgent violence, and state authority has shaped Colombia’s insecurity and constrained governance. The author argues that existing U.S. policy, traditionally framed through counterdrug and counterterrorism lenses, must evolve toward a comprehensive strategy that integrates governance, security cooperation, and institutional reform. The paper assesses how Washington and Bogotá can craft a cohesive campaign that strengthens public security, supports democratic institutions, and weakens illegal armed …

Mechanism Of Toxt-Dependent Transcriptional Activation At The Vibrio Cholerae Tcpa Promoter, Robin R. Hulbert, Ronald K. Taylor

The AraC homolog ToxT coordinately regulates virulence gene expression in Vibrio cholerae. ToxT is required for transcriptional activation of the genes encoding cholera toxin and the toxin coregulated pilus, among others. In this work we focused on the interaction of ToxT with the tcpA promoter and investigated the mechanism of ToxT-dependent transcriptional activation at tcpA. Deletion analysis showed that a region from −95 to +2 was sufficient for ToxT binding and activation, both of which were simultaneously lost when the deletion was extended to −63. A collection of point mutations generated by error-prone PCR revealed two small regions required …

Beef carcass sponge samples collected from July to August 1999 at four large processing plants in the United States were surveyed for the presence of non-O157 Shiga toxin-producing Escherichia coli (STEC). Twenty-eight (93%) of 30 single-source lots surveyed included at least one sample containing non-O157 STEC. Of 334 carcasses sampled prior to evisceration, 180 (54%) were found to harbor non-O157 STEC. Non-O157 STEC isolates were also recovered from 27 (8%) of 326 carcasses sampled after the application of antimicrobial interventions. Altogether, 361 non-O157 STEC isolates, comprising 41 different O serogroups, were recovered. O serogroups that previously have been associated with …

How Important Are Classroom Peer Effects? Evidence From Boston's Metco Program, Joshua David Angrist, Kevin Lang

Most integration programs transfer students between schools within districts. In this paper, we study the impact of Metco, a long-running desegregation program that sends mostly black students out of the Boston public school district to attend schools in more affluent suburban districts. We focus on the impact of Metco on the students in one of the largest Metco-receiving districts. In the 2000 school year, Metco increased the proportion black in this district from about 7.5 percent to almost 12.5 percent. Because Metco students have substantially lower test scores than local students, this inflow generates a significant decline in scores, with …

Governments in every developed industrial economy administer programs that partially replace the earnings of workers who suffer job loss or on-the-job injury. In addition, governments administer programs to help job losers gain reemployment, either through direct job placement (for those who are job-ready) or through retraining (for those who are not). This chapter describes and discusses current policy issues surrounding the main social insurance and reemployment programs in Michigan: Unemployment Insurance (UI), which partially replaces lost earnings following loss of a job; Workers' Compensation (WC), which pays for medical treatment, vocational rehabilitation, and lost earnings following a work-related injury or …
