What happens to adolescents once placed in the criminal justice system and the potential violations of human rights that ensue is the focus of this essay. The pace of change, the severity of the new laws, the potential for unintended negative outcomes, and the empirical reality of adult punishment of juvenile offenders creates new urgency to these questions. Unfortunately, there has been little analysis of the comparative effects of statutes and administrative laws that relocate juvenile offenders to the adult court, and there has been virtually no research on the efficacy, impact and consequences of sentencing juveniles as adults. In this Lecture I shall discuss the reasons that officials and citizens should rely upon in American politics. In recent years, various theorists have claimed that people in liberal democracies should rely in politics on "public reasons," reasons that are accessible to all citizens. Others have objected that such a counsel is unreasonable, if not incomprehensible. I shall concentrate on two facets of this issue. The Harlem Community Justice Center (Justice Center) officially opened in July 2000 with all the fanfare of a major civic event. The Chief Judge of the State of New York, Judith Kaye, and the Mayor of the City of New York, Rudolph Guiliani, were keynote speakers, lauding the combined efforts of private administrators and public officials in reopening a deteriorating but magnificent 1892 court building in the center of Harlem. The ceremony began and ended with gospel sung by the Addicts Rehabilitation Center Choir, a musical reflection of one component of the Justice Center's jurisdiction. This article focuses on ethics problems related to hourly billing by analyzing the results of a survey of 1000 randomly selected associates in Texas firms who (1) had been licensed for ten or fewer years as of June 1999, and (2) worked in private law firms with more than ten attorneys (the Associate Survey). This article addresses the need for firm managers to clarify how and what their attorneys should bill. The article reports the results from the Associate Survey relating to billing guidance and ethics systems. From the empirical data, the article identifies a need for supervising attorneys to …

Property Rights, Pesticides, & (And) Public Health: Explaining The Paradox Of Modern Pesticide Policy, Andrew P. Morriss, Roger E. Meiners

The lesson of DDT's rise and fall is that property rights play a critical role in checking public policy abuses. Respect for property rights requires public actors to obtain property owners' consent before they take actions (e.g. pesticide spraying) that affect the property owners. When property rights are respected, spillover impacts are minimized. Public policies imposed without consent, even if done with good intentions, may produce bad effects. Those effects may result in the policy being rightly abandoned, but may also spur other policies that produce more bad effects. In this paper, we argue that market access issues associated with the question of the optimal mandate of the World Trade Organization should be separated from nonmarket access issues. We identify race-to-the-bottom and regulatory-chill concerns as market access issues and suggest that the WTIO should address these concerns. We then describe ways that WTO principles and procedures might be augmented to do so. As for nonmarket access issues, we argue that as a general matter these are best handled outside the WTO, and that, while implicit links might be encouraged, explicit links between the WTO and other labor and environmental …

Policing Guns And Youth Violence, Jeffrey A. Fagan

To combat the epidemic of youth gun violence in the 1980s and 1990s, law enforcement agencies across the United States adopted a variety of innovative strategies. This article presents case studies of eight cities' efforts to police gun crime. Some cities emphasized police-citizen partnerships to address youth violence, whereas others focused on aggressive enforcement against youth suspected of even minor criminal activity. Still others attempted to change youth behavior through "soft" strategies built on alternatives to arrest. Finally, some cities used a combination of approaches. Turnover due to repatriation is an increasingly costly occurrence for multinational corporations. Understanding why repatriates decide to leave their companies upon being called back from abroad may help to devise ways in which organizations can mitigate such turnover and reduce cost in hiring and training new personnel. To that end, this study examines the impact of training and orientation programs on the job satisfaction of repatriated managers. Supervisor Leadership Style And Counselors' Burnout: A Comparative Study Of High School Counselors And Rehabilitation Counselors, David J. Lubofsky Edd

This quantitative study investigated whether the perceived leadership style of high school principals and rehabilitation supervisors had an effect on the burnout of high school and rehabilitation counselors. Demographic and work related characteristics were also assessed to determine if these factors affected burnout rates. Survey data from the three separate scales of the Maslach Burnout Inventory (MBI), and the Multifactor Leadership Questionnaire (MLQ) were combined with demographic data to estimate a series of three regression models. The models focused on the effects of demographic, work-related and leadership variables on counselor burnout. Data were collected from 96 high school counselors and …

The purpose of this study was to determine if there was significant differences in changes of knowledge, attitudes, and practices between elementary school teachers who took part in an in-service physical education training program and those who did not take part. The in-service training program utilized a model health-related physical education program. The setting for the study was a school district on Saipan whose teachers were required to teach physical education. Teachers in five of nine public elementary schools were placed in the in-service training program. Theft Of Time: Disciplining Through Science And Law, Laureen Snider

This commentary traces the genealogy of "theft of time," a newly discovered offence committed by employees against employers. A Foucauldian perspective is used to examine how truth claims from science, technology, and law constitute categories through which groups are sorted, classified, and censured: the processes of naming, blaming, and shaming. This commentary argues that to understand why some truth claims are heard and acted upon, while others are ignored or silenced, it is necessary to link the power/knowledge nexus to political economy, the structural dominance of capital, and the power relations thereby created and reinforced.

Diffractive dissociation of virtual photons, γ*p → Xp, has been studied in ep interactions with the ZEUS detector at HERA. The data cover photon virtualities 0.17 < Q2 < 0.70 GeV2 and 3 < Q2 < 80 GeV2 with 3 < MX < 38 GeV, where MX is the mass of the hadronic final state. Diffractive events were selected by two methods: the first required the detection of the scattered proton in the ZEUS leading proton spectrometer (LPS); the second was based on the distribution of MX. The integrated luminosities of the low- and high-Q2 samples used in the LPS-based analysis are ≃ 0.9 pb-1 and ≃ 3.3 pb-1, respectively. The sample used for the MX-based analysis corresponds to an integrated luminosity of ≃ 6.2 pb-1. The dependence of the diffractive cross section on W, the virtual photon-proton centre-of-mass energy, and on Q2 is studied. In the low-Q2 range, the energy dependence is compatible with Regge theory and is used to determine the intercept of the Pomeron trajectory. The W dependence of the diffractive cross section exhibits no significant change from the low-Q2 to the high-Q2 region. In the low-Q2 range, little Q2 dependence is found, a significantly different behaviour from the rapidly falling cross section measured for Q2 > 3 GeV2. The ratio of the diffractive to the virtual photon-proton total cross section is studied as a function of W and Q2. Comparisons are made with a model based on perturbative QCD.

This thesis examines the role and status of the tourist in the present day. It argues that the tourist, and the touristic experience, is emblematic of the consumption-based economy of late capitalism. It analyses tourism as a practice of, rather than opposed to, everyday life, for many subjects in late-capitalist Western society. The argument is developed by comparing and contrasting the tourist with the flâneur. The flâneur is regarded as a representative subjectivity of early modernity who developed visual and spatial practices, methodologies of movement and observation, which interpreted the city. This thesis investigates the Cultural Studies paradigm 'hybridity' through an analysis of Hong Kong culture. In Cultural Studies, 'hybridity' is usually applied to cultures that have been influenced by another culture, resulting in a loss of identity, leading to a cultural mixture. As a former Colony comprising predominantly of a southern Chinese population, Hong Kong has been influenced by British culture.
