Please Forgive Me: Transgressors’ Emotions And Physiology During Imagery Of Seeking Forgiveness And Victim Responses, Charlotte Witvliet, Thomas Ludwig, David L. Bauer

We assessed transgressors’ subjective emotions and physiological responses in a within-subjects imagery study involving 20 male and 20 female participants. Two imagery conditions focused on the transgressor’s actions: participants 1) ruminated about a real-life transgression and 2) imagined seeking forgiveness from the victim. Three imagery conditions focused on the victim’s possible responses: participants imagined their victims responding with 1) a grudge, 2) genuine forgiveness, and 3) reconciliation. Compared to ruminations about one’s transgression or an unforgiving response from the victim, imagery of forgiveness-seeking and merciful responses from victims (forgiveness and reconciliation) prompted improvements in basic emotions (e.g., sadness, anger) and …

Scoring Sentences Developmentally: An Analog Of Developmental Sentence Scoring, Amy Seal

A variety of tools have been developed to assist in the quantification and analysis of naturalistic language samples. In recent years, computer technology has been employed in language sample analysis. This study compares a new automated index, Scoring Sentences Developmentally (SSD), to two existing measures. Eighty samples from three corpora were manually analyzed using DSS and MLU and the processed by the automated software. Results show all three indices to be highly correlated, with correlations ranging from .62 to .98. The high correlations among scores support further investigation of the psychometric characteristics of the SSD software to determine its clinical …

We tested a computer-based procedure for assessing reader strategies that was based on verbal protocols that utilized latent semantic analysis (LSA). Students were given self-explanation-reading training (SERT), which teaches strategies that facilitate self-explanation during reading, such as elaboration based on world knowledge and bridging between text sentences. During a computerized version of SERT practice, students read texts and typed self-explanations into a computer after each sentence. The use of SERT strategies during this practice was assessed by determining the extent to which students used the information in the current sentence versus the prior text or world knowledge in their self-explanations. …

Texas needs to reform its policy concerning referral fees. In Texas, an attorney is permitted to receive a fee for providing a referral to another attorney. In Brewer & Pritchard, P.C. v. Johnson, for example, the forwarding attorney received a referral fee for $3 million dollars. Proponents of referral fees argue that clients are better represented because referring attorneys have a greater economic incentive to seek out more capable attorneys. On the other hand, referring attorneys may also have the incentive to seek out attorneys who pay higher referral fees rather than those most qualified. In the end, the referred …

Infanticide is the most prevalent violent crime committed by women and has occurred throughout history for various reasons including sacrifice, birth control, eugenics, shame, and fear of punishment for adultery. Postpartum mood disorders have been recognized as a legitimate mental illness since the fourth century, and approximately fifty to eighty percent of new mothers experience some degree of depression after giving birth. Postpartum depression can progress into psychosis so quickly that new mothers may not even notice impairment of thinking skills. Environmental processes have been modelled for decades. However, the need for integrated assessment and modeling (IAM) has grown as the extent and severity of environmental problems in the 21st Century worsens. The scale of IAM is not restricted to the global level as in climate change models, but includes local and regional models of environmental problems. This paper discusses various definitions of IAM and identifies five different types of integration that are needed for the effective solution of environmental problems. In 1996, the Republican Congress and Democratic President enacted the Personal Responsibility and Work Opportunity Reconciliation Act (PRWORA), ushering in a new era of public benefits. This 1996 act’s fundamental change to the administration and substance of public benefits called into question the applicability of a substantial body of procedural due process doctrine. As a result, unanswered questions remain regarding the applicability of established due process doctrine in the welfare reform context. This Article analyzes the due process implications of the change in welfare administration from a federal statutory entitlement model to the devolved contractual model and posits that, despite the changes, due process protections still exist. These protections arise from the private law of contracts on two different levels. The first level is the macro, or implied, contract, that I refer to as the social contract between the government and the populace. Textualism's revival illuminated the judicial imagination at play behind the search for congressional intent through legislative history. The Supreme Court’s decision in Buckhannon Board & Care Home v. West Virginia Department of Health & Human Resources shows the Supreme Court’s mounting disregard for legislative history and concomitant attempt to erect replacement canons of statutory construction to guide textual interpretation. The opinion privileged a canon of statutory construction over the legislative record of congressional intent. This Article considers interdisciplinarity and the legal curriculum in the context of probability and statistics. Section D of Part II begins the discussion by sketching some multidisciplinary, pluridisciplinary, interdisciplinary, and transdisciplinary approaches. Part III is the workhorse of this Article. The recent downturn in the economy, particularly in the e-commerce sector, reveals many e-companies heading toward bankruptcy with cyberassets, such as domain names, as their most valuable corporate assets. I want to address my remarks to the students of the University of Maine School of Law who will face a great deal of unfinished legal business on the topics of salmon, Indian tribes, and environmental law.
Elsewhere, I have derived what I describe as the five virtues of effective action (genius, high-leveraging, symbolism, optimism, courage). People of achievement, lawyers or otherwise, are familiar with these virtues and display them in many creative forms.

My talk today will: (1) introduce the metaphor of geology, (2) suggest to you that complexity has "gainers" as well as "losers," and (3) show you how environmental laws can be defeated by these twin engines of complexity and clever human adversaries.
