Defining The Family In The Millenium: The Troxel Follies, John Dewitt Gregory

This Article addresses the ways in which the law primarily state law-has significantly redefined the American family in its response to third-party claims against parents for visitation rights with the children of those parents. Part II briefly addresses statutory and case law relating to visitation by grandparents, the most favored group of petitioners for visitation rights, and stepparents who have not fared nearly as well. After placing third-party visitation in its constitutional context, Part II also examines how the courts have treated "coparent" claims of a right to visitation, brought by former companions of natural parents who insist that they …

Feminists involved in international human rights law have long recognized that reproductive rights are an essential part of any larger struggle for women's human rights. As noted at the World Conference on Population in Cairo in 1994 and reiterated at the World Conference on Women in Beijing in 1995, control over their own reproduction is a prerequisite for any meaningful conception of women's human rights. At the same time, feminists have recognized that reproductive rights, in fact, involve a range of related but distinct rights -- from access to birth control for minors to environmental safeguards that protect women from …

Ronald Dworkin's' latest might well seem sharply discontinuous with his other work. The formal theoretical apparatus that kicks off the book is a forbiddingly abstract - some will say arcane - hypothetical auction, coupled with a hypothetical insurance market. There is simply nothing like it in Taking Rights Seriously, or A Matter of Principle, or Law's Empire, or Life's Dominion, or Freedom's Law. The Supreme Court of the New Deal era continues to captivate American lawyers and historians. Constitutional jurisprudence changed rapidly during the period. Moreover, some of the most significant changes appeared - whatever the reality - to result from pressure imposed in 1937 by President Franklin Roosevelt's plan to pack the Court with Justices amenable to his programme. The structure of constitutional law that emerged within a few years of Roosevelt's death remains intact in significant respects today.

To illustrate the importance of ethics advisors playing an active role in building a law firm's ethical infrastructure, this article focuses on ethics problems related to hourly billing. Ethics experts who have studied hourly billing recognize attorneys' reluctance to report billing misconduct, In the book, THE HONEST HOUR, Professor William G. Ross refers to the inclination of attorneys to close their eyes when they suspect billing irregularities. Professor Lisa G. Lerman made a similar observation in noting that firm attorneys who share income may "turn a blind eye to misconduct" by another firm attorney.' Both Professors Lerman and Ross recommend …

Social Movement Unionism And Economic Unionism In Thailand, Napaporn Ativanichayapong

After the student uprising in 1973, Thai trade unions adopted social unionism. They allied with other forces, especially students, and promoted issues of benefit to other social classes. This phase ended with the coup of 1976. When union activity again became possible in the 1980s, the unions turned to economic unionism. They campaigned on issues of specific worker benefit (wages, social security), but allowed their alliances to decay, and forfeited broad support. In the 1990s, female workers again forged broad social alliances to fight campaigns on issues of specific female interest (maternity leave, occupational health). Because of its weakness, the …

The Social Welfare Of Advertising To Children, Dennis D. Crouch

The aim of this Comment is to approach the issue of advertising to children through an examination of economic incentives and efficiency. The Comment ultimately makes the claim that televised advertisement of products, such as junk food, directed toward children may be inefficient and tend to decrease social welfare. Although they may be compelling, this paper does not rely on the secondary negative externalities often associated with television, such as the cost of treating diabetes and heart disease. Rather, the inefficiency discussed in the Comment involves the informational qualities of advertising. Advertising directed towards young children can be thought of …

Investigation Of Techniques To Improve Measurement Accuracy Of Nitric Oxide, Nitrogen Dioxide And Nitrogen Oxide Emissions From Heavy-Duty Diesel Engines., Praveen Rampatna Narasimhamurthy

Nitric oxide (NO) and nitrogen dioxide (NO2), commonly referred to as NOx, are known to be harmful to human health. Oxides of nitrogen also rate among the principal agents of photochemical smog. Consequently, the Federal standards for NOx emissions have become increasingly stringent and have been lowered from 6.0 g/bhp-hr in 1990 to 0.2 g/bhphr in 2007. Engine out NOx emissions from diesel engines are typically composed of about 95% of NO and 5% NO2. However, under low load and speed conditions, as in present urban day driving, the NO2 component of NOx can be as high as 30%. Considering …
