Towards Tribal Sovereignty And Judicial Efficiency: Ordering The Defenses Of Tribal Sovereign Immunity And Exhaustion Of Tribal Remedies, Kirsten Matoy Carlson

Michigan Law Review

In 1985, the Narragansett Indian Tribe ("Tribe") created the Narragansett Indian Wetuornuck Housing Authority ("Authority"). The Authority, which acts on the Tribe's behalf in its housing development and operations, entered into a contract with the Ninigret Development Corporation for the construction of a low-income housing development. After construction began, disputes developed over how to proceed with the construction. When conciliation efforts failed, the Authority cancelled the contract. The Narragansett Tribal Council, the governing body of the Tribe, followed the forum selection clause in the contract and notified the disputants that it would hold a hearing to resolve the dispute. Ninigret …

A Reduced Model Clarifies The Role Of Feedback Loops And Time Delays In The Drosophila Circadian Oscillator, Paul Smolen, Douglas A. Baxter, John H. Byrne Nov 2002

A Reduced Model Clarifies The Role Of Feedback Loops And Time Delays In The Drosophila Circadian Oscillator, Paul Smolen, Douglas A. Baxter, John H. Byrne

Faculty, Staff and Student Publications

Although several detailed models of molecular processes essential for circadian oscillations have been developed, their complexity makes intuitive understanding of the oscillation mechanism difficult. The goal of the present study was to reduce a previously developed, detailed model to a minimal representation of the transcriptional regulation essential for circadian rhythmicity in Drosophila. The reduced model contains only two differential equations, each with time delays. A negative feedback loop is included, in which PER protein represses per transcription by binding the dCLOCK transcription factor. A positive feedback loop is also included, in which dCLOCK indirectly enhances its own formation. The model …

The Impact Of A Large Wage Increase On The Workforce Stability Of Ihss Home Care Workers In San Francisco County, Candace Howes Nov 2002

The Impact Of A Large Wage Increase On The Workforce Stability Of Ihss Home Care Workers In San Francisco County, Candace Howes

Economics Faculty Publications

This study is one of the very few large-scale empirical investigations of the effect of wages on labor market outcomes in any direct care industry, and possibly the only such study specifically addressing conditions in the homecare industry. It records the impact of the nearly doubling of wages for IHSS homecare workers in San Francisco County over a 52 month period. The project is based on a unique database, which matches approximately 18,000 San Francisco County homecare workers in 26,115 unique matches to 15,500 service recipients between November 1997 and February 2002.

Spotted Substrates For Focal Presentation Of Proteins To Cells, Terrance Kummer, Hiroshi Nishimune, Rachel Wong, Joshua Sanes Nov 2002

Spotted Substrates For Focal Presentation Of Proteins To Cells, Terrance Kummer, Hiroshi Nishimune, Rachel Wong, Joshua Sanes

Open Access Publications

Neurites and other cell processes encounter localized deposits of signaling factors as they grow. The difficulty in generating patterned artificial substrates has hindered the analysis of these instructive factors in vitro. Here we report a simple method for presenting cultured cells with small spots of protein on an otherwise uniform substrate. We use a biolistic device called a gene gun to deposit 0.1-5 microm fluorescent dots of pure protein on or beneath a growth-promoting substrate. Using this technique, we demonstrate local presynaptic differentiation of motoneurons in response to dots of a polycation. We also show that biotin-avidin and antibody-antigen interactions …

Knowledge About Hepatitis B And C Among Patients Attending Family Medicine Clinics In Karachi, A K. Khuwaja, R Qureshi, Z Fatmi

Community Health Sciences

Knowledge about hepatitis B and C was assessed in a cross-sectional study of 300 adults aged 18 or older attending family medicine clinics at The Aga Khan University Hospital, Karachi. Most knew that hepatitis B and C are viral diseases that primarily affect the liver, but knowledge about risk factors for disease transmission was poor. Approximately 70% knew that hepatitis B is vaccine preventable; 60% had the misconception that hepatitis C is also vaccine preventable. The majority incorrectly believed that people with hepatitis B or C should follow the diet 'parhaiz'. Generally women knew more than men about the diseases. …

Community Health Sciences

We evaluated the epidemiological differences with respect to demographics, drug use and sexual behaviours associated with lifetime risk of urethritis, genital ulcer disease (GUD) and urethritis and GUD together among 3395 male prisoners in Sindh. Factors associated with urethritis and GUD alone were sex with multiple females, sex with men, and ethnicity. Additional factors associated with urethritis alone were sex with prostitutes, sex with partners having multiple partners and sex with partners believed to be injecting drugs. Behaviours associated with lifetime risk for urethritis and GUD together were sex with multiple females, sex with prostitutes, sex with men, sex with …

Dual Resident Voting: Traditional Disenfranchisement And Prospects For Change, Ashira Ostrow Nov 2002

Dual Resident Voting: Traditional Disenfranchisement And Prospects For Change, Ashira Ostrow

Hofstra Law Faculty Scholarship

In modern times, a large and growing number of Americans qualify as bona fide residents of two or more locales. These dual residents are subject to local taxes and ordinances and are profoundly affected by policies that concern their second-home community. Yet, in most states, individuals are prohibited from voting in more than one location through voting statutes that equate residence with domicile. Recently, the Second Circuit upheld a New York election law that prevents second-home owners from voting in both of their residential districts. This Note argues that extending the franchise in local elections to individuals who qualify as …

Individual-Systemic Violence: Disabled Women’S Standpoint, Maria Barile Nov 2002

Individual-Systemic Violence: Disabled Women’S Standpoint, Maria Barile

Journal of International Women's Studies

This article presents an insider reflection on questions of violence and women with disabilities. We explore reasons for the systemic omission of women with disabilities from mainstream research and from services addressing non-disabled women’s experiences. Several questions are postulated. Has segregation of women with disabilities from the mainstream rendered a large part of their experiences, including the experience of violence, invisible? Have misconceptions about the lives of women with disabilities contributed to exclusionary practices within the women’s movement?

This article further submits that violence against women with disabilities assumes many forms, both individual and systemic. It explores several factors, among …

Cuba, Social Policy At A Crossroads: Maintaining Priorities, Transforming Practice, Miren Uriarte Nov 2002

Cuba, Social Policy At A Crossroads: Maintaining Priorities, Transforming Practice, Miren Uriarte

Gastón Institute Publications

From the beginning of the Cuban revolution in 1959, the model of social development has underscored equity across society and universal access. Full responsibility rests on government to fund and deliver social entitlements. These values have framed the development and implementation of social policy during the last 40 years. During this time Cuba has instituted free and universally accessible health care and education and has built on its formerly weak pension system to develop a universal and government sponsored one.

Cuba's safety net of benefits includes protection of workers' employment and housing, food subsidies, utilities and other necessities, and mechanisms …

Radiologic Features Of Hallervorden Spatz Disease, K B. Asumal, M Wasay, S N. Ali

Section of Neurology

Hallervorden Spatz Disease is a rare familial neurodegenerative disorder, which primarily affects children but also can occur in adults1 . Major clinical features are abnormal involuntary movements and cognitive impairment2 . Diagnosis is based on clinical and radiological features. The radiological features are hypointense signals in globus pallidus and substantia niagra on MR! of brain3 . Occasionally the pallidal hypointense signals surround hyperintense signals, this is known as “tigereye-sign”4 and is postulated to be specific for Hallervorden Spatz Disease. We report two brothers with such MRI findings.

Morphology Of The Minute Larva Of Ptinella Tenella, With Special Reference To Effects Of Miniaturisation And The Systematic Position Of Ptiliidae (Coleoptera: Staphylinoidea), Vasily V. Grebennikov, Rolf G. Beutel

All Peer-Reviewed Publications

External and internal features of minute reared ex ovo larvae of Ptinella tenella Erichson with the head widths ranging from 108 to 138 μm are described. In total 139 setae (trichoid sensilla), 18 pores (non-trichoid sensilla), and 60 muscles were identified. The complexity of the chaetotaxy, the musculature of the head, the tentorium, and the digestive tract are not affected by the extremely small size of the larvae. Specific features, which may have resulted from miniaturisation are the elongate shape of the brain reaching the mesothorax posteriorly, the reduced condition of the thoracic sclerites and endosternites, the simplified musculature of …

A Case Study In Volunteer Management: Volunteer Stress At A Northern California Rape Crisis Center, Holly Tedford

Master's Theses

This research project is a case study of a rape crisis center's volunteer program. Because the volunteers respond to recent victims of sexual assault in hospital emergency rooms, the study was designed to examine the stressors arising from their confrontation of such emotionally volatile situations. The study focused on the stressors volunteers experienced, how they coped, how the rape crisis center's training program prepared volunteers for job stress, what rape crisis center employees did to mitigate volunteers' job-related stress, and how effective volunteers perceived these efforts to be. The research project also compared the stress experienced by rape crisis volunteers …

Chapter 11 Reorganization Cases And The Delaware Myth, Harvey R. Miller Nov 2002

Chapter 11 Reorganization Cases And The Delaware Myth, Harvey R. Miller

Vanderbilt Law Review

Since the mid-1990s, there has been a spirited debate concerning the emergence of the United States Bankruptcy Court for the District of Delaware (the "Delaware Bankruptcy Court") as the virtual Chapter 11 capital for distressed debtor corporations. The "Delawarization" of corporate reorganizations under title 11 of the United States Code (the "Bankruptcy Code"), which occurred during the 1990s as a result of the migration of Chapter 11 cases of large enterprises from other venues to Delaware, has provoked a stream of academic articles debating the consequences of Delaware's emergence. Armed with statistics purporting to demonstrate a high rate of recidivism …
