This article offers a critical analysis of the traditional maxim that motive is irrelevant to criminal liability. It retraces the history of this principle to show how its meaning has changed and its validity has declined over time. Originally promoted by reformers, the irrelevance of motive maxim derived meaning from their efforts to codify criminal law. In this context, the irrelevance of motive stood for two related reforms: (1) legislators should condition criminal liability on expectations of harm rather than desires, and (2) courts should require proof of statutory mental elements. The New Environmental Law: Forest Certification, Errol E. Meidinger

This paper argues that the rapidly expanding practice of forest certification, together with similar developments in other sectors, is creating a new template for environmental law. Nongovernmental organizations and some industry actors are establishing binding regulatory standards, systems for monitoring compliance, sanctions for non-compliance, and, when things work well, methods for assessment and revision. It locates these developments as a part of “phase 3” of environmental law, which also involves a proliferation of other initiatives beyond traditional regulation. Finally, it offers a preliminary discussion of the efficacy, adaptability, coherence, and legitimacy of the emergent system.

Groundwater circulation wells (GCWs) are a quasi-in-situ method for remediating groundwater in areas where remediation techniques that limit the water available for municipal, domestic, industrial, or agricultural purposes are inappropriate. The inherently resource-conservative nature of groundwater circulation wells is also philosophically appealing in today's culture, which is supportive of green technologies. Groundwater circulation wells involve the circulation of groundwater through a dual screen well, with treatment occurring between the screens. The wells are specifically designed so that one well screen draws in groundwater and the second returns the groundwater after it has been treated within the well. Historically, the treatment …

Many computer systems are designed according to engineering and technology principles and are typically difficult to learn and use. The fields of human-computer interaction, interface design, and human factors have made significant contributions to ease of use and are primarily concerned with the interfaces between systems and users, not with the structures that are often more fundamental for designing truly human-centered systems. Software for use with patient records is challenging to design and difficult to evaluate because of the tremendous variability of patient circumstances. A method was devised by the authors to overcome a number of difficulties. The method evaluates and compares objectively various software products for use in emergency departments and compares software to conventional methods like dictation and templated chart forms. The technique utilizes oral case simulation and video recording for analysis. The methodology and experiences of executing a study using this case simulation are discussed in this presentation.

Is the solution for medical errors medical or cognitive? In this AMIA2001 panel on medical error, we argued that medical error is primarily an issue for cognitive science and engineering, not for medicine, although the knowledge of the practice of medicine is essential for the research and prevention of medical errors. The three panelists presented studies that demonstrate that cognitive research is the foundation for theories of medical errors and interventions of error reductions.

Healthcare has been slow in using human factors principles to reduce medical errors. The Center for Devices and Radiological Health (CDRH) recognizes that a lack of attention to human factors during product development may lead to errors that have the potential for patient injury, or even death. In response to the need for reducing medication errors, the National Coordinating Council for Medication Errors Reporting and Prevention (NCC MERP) released the NCC MERP taxonomy that provides a standard language for reporting medication errors. The corrosion behavior of Cr2O3 and TiO2 based surface treatments in 0.5N NaCl solution was investigated. These surface treatments are used for adhesive bonding of SS3 l 6L both to itself, other metals and non-metals. In order to quantify corrosion behavior and determine their ability to passivate in a chloride environment, a poteniodynamic test was employed.

To measure the adhesive strength of bonds using the different surface treatments, a standard test method, ASTM D 1002, was used. This measured the apparent shear strength of single lap joints made by adhesively bonding metals specimens together. A general-purpose …

The Clean Air Act requires the use of complex photochemical models to predict future ozone concentrations and the impact of current and future regulations. In many instances uncertainty in the data input parameters used to operate these models results in uncertainty in the prediction of future air quality. The degree of this uncertainty is often greater than the degreee of air quality improvements proposed by regulations. This study evaluates the sensitivity of a photochemical model to predict future ozone air quality with respect to the uncertainty of several critical input parameters. This paper discusses the trend of academic achievement and retention for Latino immigrant youth. Research indicates that the general trend for Latino youth is negative – generally achievement is lower than any other immigrant ethnic group, and the drop out rate is higher than for any other ethnic group. Factors such as language and methods of learning, segregation, poverty, low parental involvement in education, discrimination, and stress due to immigration have been identified as factors contributing to low academic success.

The ways in which schools deal with immigrant students is also discussed. Further research is needed on immigrant Latino families …
