A Partial Defense Of An Anti-Discrimination Principle, Michael C. Dorf

Over a quarter century ago, Professor Fiss proposed that the constitutional principle of equal protection should be interpreted to prohibit laws or official practices that aggravate or perpetuate the subordination of specially disadvantaged groups. Fiss thought that the anti-subordination principle could more readily justify results he believed normatively attractive than could the rival, anti-discrimination principle. In particular, anti-subordination would enable the courts to invalidate facially neutral laws that have the effect of disadvantaging a subordinate group and also enable them to uphold facially race-based laws aimed at ameliorating the condition of a subordinate group. Structured Multifaceted Cognitive Behaviorally Oriented Assessment And Treatment Of Nonadherence To Medical Advice : A Case Study, Cheryl A. Patchin

The incidence of nonadherence to medical advice is estimated to be as high as 98%, with a typical range of 30% to 60%. This case study focused on the assessment and treatment of a patient suffering from uncontrolled essential hypertension, who was inconsistent in her adherence to the prescribed medical regimen and who demonstrated a significant health risk as a result. From baseline (pretreatment) to termination (followup), the patient attended a total of 9 sessions over a 12-week period. Assessment involved clinical interviews and an original self-administered instrument, the Health Behavior Profiling Questionnaire (HBPQ). The HBPQ was designed to assess …

Global business initiatives, increasingly diverse populations, and permeable geographical boundaries have catapulted interest in studying the impact of these events on multi-national companies, and to a lesser degree, small businesses along the South Texas and Mexican border. The enactment of the North American Free Trade Act agreement that exists between Mexico, Canada, and the United States amplifies these issues. Consequently, companies may face a changing business landscape. However, one constant factor is the owner. In this Article, the Author attempts to demonstrate that bankruptcy courts regularly hear cases in which the court and the parties could benefit from the services of a special master and that bankruptcy courts are hampered in their ability to handle cases in the most just and efficient manner possible because of their inability to appoint special master. Conceptualizing Privacy, Daniel J. Solove

In this Article, Professor Solove develops a new approach for conceptualizing privacy. He begins by examining the existing discourse about conceptualizing privacy, exploring the conceptions of a wide array of jurists, legal scholars, philosophers, psychologists, and sociologists. Solove contends that the theories are too narrow or too broad. With a few exceptions, the discourse seeks to conceptualize privacy by isolating one or more common essential or core characteristics of privacy. Expounding upon Ludwig Wittgenstein's notion of family resemblance, Solove contends that privacy is better understood as drawing from a common pool of similar characteristics.
