Carve-Outs In Workers' Compensation: An Analysis Of The Experience In The California Construction Industry, David I. Levine, Frank Neuhauser, Richard Reuben, Jeffrey S. Petersen, Cristian Echeverria

Employers and unions in several states during the 1990s were allowed to "carve out" their own workers' compensation systems. These innovative reforms gave the parties the right to collectively bargain their own systems outside the statutory systems. In addition, alternative dispute resolution (ADR) systems were implemented in order speed the legal process and reduce litigation costs. This book offers an evaluation of the first few years' experience with these organizational reforms in California.

We have investigated the transmission characteristics of an alternative all-optical-waveguide system for x-ray delivery to a precise tissue area. The delivery system includes two basic optical elements: a funnel-shaped uncoated hollow glass taper and a flexible hollow delivery waveguide. The hollow taper provides direct launching of the input x-ray radiation into a delivery waveguide. It is an uncoated glass taper whose operating principle is based on the grazing-incidence effect. We investigated both experimentally and theoretically how the transmission properties of the hollow taper depend on its geometrical parameters such as cone shape, length, input and output core diameters. Does The Missouri Safe Schools Act Past The Test - Expelling Disruptive Students To Keep Missouri's Schools Safe, Cathi M. Kraetzer

The Missouri Court of Appeals for Easter District of Missouri interpreted the Missouri Safe Schools Act of 1996 in Hamrick ex rel. Hamrick v. Affton School District Board of Education to require a public school to admit for enrollment a student who had been expelled from a non-public school. Shortly after the court’s decision, the Missouri General Assembly amended the dispositive language of Section 167.171.4. It is not clear that public school districts in Missouri can deny enrollment to students suspended or expelled from both public and non-public schools. Should Government Be Allowed To Recover The Costs Of Public Services From Tortfeasors?: Tort Subsidies, The Limits Of Loss Spreading, And The Free Public Services Doctrine, Timothy D. Lytton

The free public services doctrine (also known as the municipal cost recovery rule) states that a government entity may not recover from a tortfeasor the costs of public services occasioned by the tortfeasor's wrongdoing. This article traces the history of the doctrine and argues for its elimination. The article criticizes case law supporting the doctrine and raises objections based on fairness, efficiency, and institutional concerns about the proper limits of judicial policy making. The article discusses the implications of eliminating the doctrine for tobacco litigation, gun litigation, and tort reform.

Psychiatric Admission In A General Hospital. Patients Profile And Patterns Of Service Utilization Over A Decade, Mahdi S. Abumadini, Sheik I. Rahim

OBJECTIVE: To analyze the socio-demographic and clinical characteristics of admitted patients and the patterns of their service utilization over a decade from March 1988 to March 1998. METHODS: Prospective data compilation using a structured questionnaire, hospital records and follow-up observations at King Fahd Hospital of the University in Al-Khobar, Kingdom of Saudi Arabia. RESULTS: A total of 1366 patients (683 of each sex) had 2217 admissions in 10 years. By the International Classification of Diseases, 10th edition criteria, 19.5% had schizophrenia, 15.2% bipolar disorder, 9.9% depressive episodes, 8.6% acute and transient psychotic disorders, 7.7% adjustment disorders and 7.6% dissociative disorders. …

The primary purpose of the researcher this study was to determine what, if any, unexpected benefits, spin-offs, and other "serendipitous" events occurred as a result of the year 2000 remediation process undertaken by businesses, industry, and other organizations. This was measured through the use of an online survey instrument comprised of a series of questions designed to measure and discover those benefits. The survey was sent to approximately 50 different businesses/organizations during the pilot stage of this study and 250 during the main stage of this study. These businesses/organizations were randomly selected from the sampling frame using random sampling techniques. …
