The mere notion of bankruptcy, liquidation or reorganisation of industrial enterprises was long considered anathema in the People's Republic of China (PRC or China), and directly contrary to the underlying logic of a centrally planned, state-owned economy and industrial system. The state's reluctance to allow bankruptcies was rooted in the ideology of the governing Communist Party but also reflects fiscal constraints with respect to payments to unemployed workers and the recapitalisation of state-owned commercial banks forced to write off loans as bad debts. Teenage Childbearing In Maine: Positive Trends But More To Be Done, Leslie King, Stephen Marks

Teen birth rates in Maine have fallen by 34% over the past decade, the fourth highest decline in the nation. However, as King and Marks point out, a low birthrate of 29.8% in 1999 still exceeds the teenage birthrate in most other industrialized countries in the world by a substantial margin. Moreover, when the authors compared Maine’s predominantly white population with non-Hispanic whites in other states, Maine’s success is not as remarkable. Indeed, the teenage birthrate of Maine’s non-Hispanic white population is higher than every other state in the Northeast corridor with the exception of Delaware. All of this is …

Crisci V. Security Insurance Co.: The Dawn Of The Modern Era Of Insurance: Bad Faith And Emotional Distress Damages, Jeffrey E. Thomas

Crisci v. Security Insurance Co. typifies the doctrine of "bad faith," one of the most interesting and important contributions of insurance law to the general body of law. It "typifies" the doctrine with its classic, if somewhat extreme, fact pattern, and with its reliance on the implied covenant of good faith and fair dealing for the recognition of a cause of action that sounds in tort. Yet it also represents a potential for bad faith law that has not yet been fulfilled: the promise of emotional distress damages for an insurer's failure to settle.

The sequencing of the human genome is a great scientific accomplishment that opens the door to further scientific inquiry of a sort that would otherwise be impossible. In addition to being passionately interested in the patent issues this research presents, as a legal scholar I have a long-standing interest in the role of intellectual property in interactions between the public and private senators and between universities and private firms in research science, with a focus on biomedial research. Minnesota law has long recognized the agency law principle of apparent authority. Minnesota law also provides that an agent is liable for the contractual obligations of an undisclosed or partially disclosed principal. Both of these well-recognized principles provided a basis for the plaintiff’s suit in Bagot, and both ought to provide a basis for similar suits in the future.

This scientific monograph provides a comprehensive summary of the clinical characteristics of Jadelle levonorgestrel (LNG) rod implants, as observed during clinical trials conducted by the Population Council. The monograph also reviews lessons learned about how to provide Jadelle, based partly on conclusions gleaned from the extensive experience with Norplant, the earlier implant system, and suggests practical ways in which to introduce Jadelle into family planning programs.

As of December 2001, the number of people living with HIV/AIDS is estimated at 40 million, and most live in the developing world. Advances in the development and availability of antiretroviral (ARV) drugs have led to a paradigm shift in most of the industrialized world, where highly active ARV therapy has resulted in a significant reduction in the prevalence of AIDS-related morbidity and mortality. This report summarizes baseline and midterm findings of an intervention pilot study conducted by Horizons, LINKAGES, National Food and Nutrition Commission, District Health Management Team, Hope Humana, and the Zambia Integrated Health Program in Ndola District, Zambia. The aim of the research is to investigate how integrating services for the prevention of mother-to-child transmission (PMCT) of HIV into low-resource maternal and child health (MCH) and antenatal care (ANC) settings influences women’s ability to make and implement informed decisions about HIV. This article explores whether the longevity phenomenon experienced by entrepreneurial women born between 1720 and 1940 can be explained by the life circumstances of these women or whether other research may provide better insights into their remarkable tenacity. The characteristics of hardiness, resiliency, and self-efficacy should be examined as well as the newly developing research theories of perseverance in the face of adversity to determine which are most appropriate in explaining what is clearly female entrepreneurial endurance.

Boards of directors often attempt to foster corporate entrepreneurship by replacing a firm’s chief executive officer (CEO). Compelling theoretical arguments and anecdotal evidence suggest that when firm performance has suffered, a new CEO is best suited to lead the firm’s creative endeavors. On the other hand, among firms that retain their existing CEO after a decline in performance, manipulating the CEO’s compensation package is a common governance practice used by boards to encourage innovation. In these cases, some have argued that increasing the CEO’s pay will encourage corporate entrepreneurship, because the CEO has been compensated for assuming additional risk. Counter …

While considerable attention has been devoted to the personality traits of entrepreneurs, less attention has been given to their values, especially outside of a Western context. Values are instrumental in the decision to pursue entrepreneurship, and have implications for the entrepreneur’s approach to creating and managing the venture. The role of values would seem especially relevant in the context of ethnic subcultures. Values traditionally associated with entrepreneurship, such as risk, individualism, competitiveness, wealth generation, and growth, may be more consistent with Western cultures, and may conflict with closely held values within various ethnic subcultures the world over. Failure Analysis Research Summary: Mitigating The Effects Of Prolonged Darkness With Low Temperature And Low Light, Julie K. Chard, Giridhar Akula, Bruce Bugbee

Power loss is a common failure in controlled environments. The duration of power loss can be several days – and even weeks – in space environments. Long-duration power loss and the resulting darkness can cause plants to die unless remedial measures are taken during the power outage. Emergency back-up power from batteries could provide low light and reduced air temperature. Plant metabolism and growth are reduced in low temperature. As metabolism slows, energy requirements are reduced and less light is needed. The temperature should be maintained above the chilling temperature for the plant, which is species dependent.
