Reparations Theory And Postcolonial Puerto Rico: Some Preliminary Thoughts, Pedro A. Malavet

This article primarily focuses on the plight of the Puerto Ricans on the island because, in addition to their flawed social construction by the United States and lack of national political power, they are also legally constructed as second-class citizens. In defining the legal rights of Puerto Ricans, the U.S. Supreme Court has held that territorial citizens are entitled to fewer constitutional protections than U.S. citizens residing in any of the fifty states. The racist and essentialist social construction of the Puerto Ricans as inassimilable, the denial of legal rights by the courts, along with the democratic deficit which deprives …

This article investigates the competitive landscape enhanced by the outburst of the information technology [IT] and addresses its impact on businesses in Africa. Also, the article identifies problems encountered in Africa and discusses their systematic characteristic and impact on businesses. In sum, the analysis offers some recommendations for solving each problem.

Pattern And Incidence Of Cancer In Northern Saudi Arabia, Ramesh Katchabeswaran, Lawrence C. Chiedozi, Sharanamma M. Kollur

OBJECTIVE: To study the pattern and incidence of cancer in the Al-Jouf region of Saudi Arabia. METHODS: The record of all confirmed cancer cases were retrieved and studied from the files of the Histopathology and Cytology Department, Prince Abdulrahman Al-Sudairy Central Hospital, Al-Jouf, Kingdom of Saudi Arabia (KSA) during the period 1994 to 2001. The major types of cancer were ranked in order of relative frequency. The crude incidence rate and age standardized rate were then calculated. RESULTS: The age standardized rate in Al-Jouf was 38.5 per 100,000, a figure lower than the Saudi Arabian national average of 71.7 per …

The implementation of the Workforce Investment Act (WIA) requires major organizational change for employment and training agencies. The initiative emphasizes coordination, collaboration and communication among organizations for better service delivery. At this time, states are developing systems that will enable them to address the needs of all customers seeking employment. The Institute for Community Inclusion (ICI) has conducted state case studies for two purposes: (1) to identify how states have begun the process of collaboration under the new mandates of WIA; and (2) to understand the impact on customers with disabilities. Using Managed Care Tools In Traditional Medicare — Should We? Could We?, Robert A. Berenson, Dean M. Harris

Law and Contemporary Problems

Berenson and Harris consider whether the most controversial tools of managed care, including selective contracting, gatekeeping, and prior authorization, should be adopted in the Medicare program. On policy and practical political grounds, they do not recommend selective contracting or gatekeeping. Nevertheless, Medicare should be granted the authority to have preferred providers and case management programs that could treat providers differently and could permit certain beneficiaries to receive additional, off-policy benefits.

The Internet In India And China, Larry Press, William Foster, Peter Wolcott, William Mchenry

Information Systems and Quantitative Analysis Faculty Publications

This article compares the diffusion of the Internet in China and India. Using a six–dimension framework for characterizing the state of the Internet in a nation, we observe that, while both nations have made significant progress since our last comparison (in 1999), China enjoys a substantial lead over India.

We also examine determinants of Internet diffusion. We find that the Chinese Internet has benefited from economic and trade reform begun in the late 1980s, a strong government commitment to the Internet, complementary human and capital resources, etc. The two nations have very different governments and policies, leading to differing approaches …

Extending Winters To Water Quality: Allowing Groundwater For Hatcheries, Amy Choyce Allison

The Winters Doctrine of federally reserved water rights applies to groundwater and water quality. Because most Indian tribes would have no water rights under state law, the reserved water rights doctrine, known as the Winters Doctrine, emerged to establish a federal right to water on Indian reservations sufficient to fulfill the purposes of the reservation. The reserved water rights doctrine originated in Winters v. United States, which was preceded by two cases upholding the federal government's right to reserve certain water rights. Defense Horizons

The U.S. military, under the guidance of the Secretary of Defense, is moving toward a new concept of military planning and operations that is agile and adaptable to the conflict at hand. The aim is to develop capabilities that can rapidly break an adversary’s will to fight and undermine the utility of asymmetric capabilities. The new concept called effects-based operations (EBO) encompasses processes, tools, and organizations that focus on planning, executing, and assessing military activities for the effects produced rather than merely tallying the number of targets destroyed. EBO practitioners draw on the full range of instruments of national power …
