A Common Characteristic Profile For Leveraging E-Rate Acquisitions In Arkansas, Drew Mashburn Jan 2002

A Common Characteristic Profile For Leveraging E-Rate Acquisitions In Arkansas, Drew Mashburn

Theses and Dissertations

The study investigates how four school districts in Arkansas maximized their E-rate discounts and leveraged their acquired E-rate services toward educational improvements. The purpose is to provide a common characteristic profile of school districts that leveraged their E-rate discounts toward effective technology integration. The findings contribute to an increased understanding of how schools benefit from the discounts produced by E-rate. In addition, these implications can be utilized by other school districts for an increased understanding of effective E-rate application strategies and technology integration efforts. The qualitative data provide a common characteristic profile that identifies attributes each district shared. Evidence of …

Sovereignty, Territoriality, And The Rule Of Law, Joan Fitzpatrick Jan 2002

Sovereignty, Territoriality, And The Rule Of Law, Joan Fitzpatrick

UC Law SF International Law Review

On November 13, 2001, President George W. Bush issued a Military Order in which he claimed power as Commander in Chief to detain indefinitely and to try, by ad hoc military commissions, persons designated by him as international terrorists. This Order represents a stunning claim to absolutist power and a rejection of any meaningful legal constraints on the treatment of the captives. The Order and the "War on Terrorism" on which it is premised challenge the most commonly accepted principles of post-Westphalian sovereignty: exclusive control over territory, noninterference, and equality among states.

The legal premise for the Order is the …

Regulating The Five Steps To Death: A Study Of Death Penalty Direct Appeals In The Florida Supreme Court, 1991-2000, Ken Driggs

St. Thomas Law Review

Between 1991 and 2000 the Florida Supreme Court published at least 343 direct appeal opinions on 288 men and women sentenced to death in circuit court, Florida's felony trial court. All but nineteen, 266 or 92% of the individuals, saw a conviction affirmed. One hundred seventy seven, or 61% of the individuals, also saw their death sentence affirmed while the remainder won various forms of relief, though often only temporary. This article and the accompanying appendix will examine those 288 cases, try to quantify them, and consider what they say about recent Florida death penalty jurisprudence. In a few instances, …

Critical Creativity: On The Convergence Of Medium Education And Media Education, Michael J. Emme Jan 2002

Critical Creativity: On The Convergence Of Medium Education And Media Education, Michael J. Emme

Journal of Social Theory in Art Education

Days after the September 11, 2001 attacks on the World Trade Center in the United States I heard an interview on the radio. The short exchange, with peace educator and activist Johan Galtung, not surprisingly in light of world events, focused on conflict resolution. While I was impressed by professor Galtung's commitment to peacemaking and his real experience serving as a mediator in world conflicts, what struck me most was the word he used to describe the key ingredient in conflict resolution. That word was 'creativity'. As an artist, art educator, academic and parent I suppose it makes sense that …

Remembering Poland: The Ethics Of Cultural Histories, William Gorski Jan 2002

Remembering Poland: The Ethics Of Cultural Histories, William Gorski

Ethnic Studies Review

Art Spiegelman's Maus, Cynthia Ozick's The Shawl, and Eva Hoffman's Lost in Translation and Exit into History are recent American texts that draw upon cultural histories of Poland to launch their narratives. Each text confronts and reconstructs fragments of twentieth-century Poland at the interactive sites of collective culture and personal memory. By focusing on the contested relationship between Poles and Jews before, during, and after World War II, these texts dredge up the ghosts of centuries-long ethnic animosities. In the post-Cold War era, wherein Eastern Europe struggles to redefine itself, such texts have a formative influence in re-mapping the future …

The Impact Of The 1918-1919 Influenza Epidemic On Virginia, Stephanie Forrest Barker Jan 2002

The Impact Of The 1918-1919 Influenza Epidemic On Virginia, Stephanie Forrest Barker

Master's Theses

In the fall of 1918 an unparalleled influenza pandemic spread throughout the world. More than a quarter of Americans became ill, and at least 600,000 died. For many Virginians, this was a time of acute crisis that only could be compared to the days of the Civil War. This thesis describes Spanish influenza's impact on Virginia, primarily focusing on the cities of Newport News, Richmond, and Roanoke. It details influenza's emergence in Virginia and explores how state and city officials dealt with this unprecedented epidemic. This study examines how the epidemic disrupted daily routines of life and overwhelmed the state's …

Does The Missouri Safe Schools Act Past The Test - Expelling Disruptive Students To Keep Missouri's Schools Safe, Cathi M. Kraetzer

Missouri Law Review

The Missouri Court of Appeals for Easter District of Missouri interpreted the Missouri Safe Schools Act of 1996 in Hamrick ex rel. Hamrick v. Affton School District Board of Education to require a public school to admit for enrollment a student who had been expelled from a non-public school. Shortly after the court’s decision, the Missouri General Assembly amended the dispositive language of Section 167.171.4. It is not clear that public school districts in Missouri can deny enrollment to students suspended or expelled from both public and non-public schools. This Law Summary discusses whether the statutory change furthers the goas …

'Bus Fare, Please': The Economics Of Sex And Gifts Among Adolescents In Urban South Africa, Carol E. Kaufman, Stavros E. Stavrou Jan 2002

'Bus Fare, Please': The Economics Of Sex And Gifts Among Adolescents In Urban South Africa, Carol E. Kaufman, Stavros E. Stavrou

Poverty, Gender, and Youth

Force or coercion are often a part of sexual relationships in South Africa, especially among adolescents. This coercion is also often pinioned by an economic exchange: gifts or favours for sex. Studies have pointed out the negative consequences of the exchanges which are often characterised by large age differences (‘sugar daddies’) or power imbalances. Perhaps more pervasive but largely ignored, gift-giving in same-age relationships also may be associated with sexual leverage, an exchange which somehow entitles one partner physical and sexual rights to the other’s body. The circumstances surrounding gifts and favours may shape young women’s and men’s sexual experiences, …

Catalunya Invisible: Contemporary Drama In Barcelona, Sharon G. Feldman Jan 2002

Catalunya Invisible: Contemporary Drama In Barcelona, Sharon G. Feldman

Latin American, Latino and Iberian Studies Faculty Publications

During the winter of 2000, Lluís Pasqual staged a Catalan version of Anton Chekov's The Cherry Orchard at Barcelona's Teatre Lliure, the historic home of Catalonia's most stable, accomplished, and distinguished repertory theatre company. In Chekov's play, Madame Lyobov Andreyevna Ranyevskaya, an emblem of the fading elegance and dwindling supremacy of the Russian aristocracy, is compelled by her situation of financial despair to sell her estate and cherry orchard to the nouveau-riche Lopakhin and then return to Paris on the eve of the Revolution. The orchard that was once admired for its beauty eventually will be destroyed in order to …

Federalism And The Rehnquist Court, Calvin Massey Jan 2002

Federalism And The Rehnquist Court, Calvin Massey

UC Law Journal

The conventional wisdom is that the Rehnquist Court has a federalism agenda-restricting the scope of federal legislative power and augmenting state power to ignore federal law-that it is implementing Term by Term. In this Article Professor Massey challenges that view, arguing that the localist bias of the Rehnquist Court's federalism is far less monolithic than is typically assumed. Of course it is true that the Rehnquist Court has used judicial review in important ways to increase state autonomy and limit federal legislative power. The scope of state freedom from regulation under the commerce clause has broadened; the deference paid by …

Intellectual Property Rights As A Policy Tool For Earth Observation Data In Europe, Frans G. Von Der Dunk Jan 2002

Intellectual Property Rights As A Policy Tool For Earth Observation Data In Europe, Frans G. Von Der Dunk

Space, Cyber, and Telecommunications Law Program: Faculty Publications

This chapter provides a contribution to analyze and evaluate the possibilities and obstacles of using intellectual property rights as a policy tool in the European Earth observation context. To this end, the generic concept of “intellectual property rights” will be discussed first. Secondly, such an analysis will then be applied to the legal particularities provided by Earth observation from space. Thirdly, a few international treaties on intellectual property rights will be discussed. Fourthly, the particular legal framework available in principle for any policies in Europe will be scrutinized, for example the specifics of the legal order having arisen within the …
