The Legal Structure Of American Freedom And The Provenance Of The Antitrust Immunities, Christopher Sagers Jan 2002

The Legal Structure Of American Freedom And The Provenance Of The Antitrust Immunities, Christopher Sagers

Law Faculty Articles and Essays

It is a reflection of the subtle relationship between legal doctrine and the larger social context it regulates that, on occasion, some humble point of mere theory proves to be the lynchpin of a serious social problem. Often the most pernicious aspect of such a situation will be the very obscuriyy that causes courts to overlook it.

That is emphatically the case with the issue addressed in this paper. Confusion persists over the seemingly academic question whether the so-called "Noerr-Pennington" or "petitioning" immunity, a doctrine in antitrust law which protects persons from being sued when they seek action from their …

Scale And Orientation-Invariant Scene Similarity Metrics For Image Queries, James Carswell Jan 2002

Scale And Orientation-Invariant Scene Similarity Metrics For Image Queries, James Carswell

Articles

In this paper we extend our previous work on shape-based queries to support queries on configurations of image objects. Here we consider spatial reasoning, especially directional and metric object relationships. Existing models for spatial reasoning tend to rely on pre-identified cardinal directions and minimal scale variations, assumption that cannot be considered as given in our image applications, where orientations and scale may vary substantially, and are often unknown. Accordingly, we have developed the method of varying baselines to identify similarities in direction and distance relations. Our method allows us to evaluate directional similarities without a priori knowledge of cardinal directions, …

Challenges Of Growing Research At New And Emerging Heis, Ellen Hazelkorn Jan 2002

Challenges Of Growing Research At New And Emerging Heis, Ellen Hazelkorn

Books/Book chapters

Newer institutions are accused of adopting the accoutrements of traditional universities, actively copying their research profile and teaching programmes, and engaging in ‘academic’ or ‘mission’ drift. For others, however, these changes are part of the natural or inevitable process of institutional development and historical change, or a further step in the democratisation of the ‘Humboltian ethic’ (Neave, 2000, p265). If massification and expansion in 1960s differentiated the second stage in higher educational development from its elite origins, then the late 1990s marked the beginning of the third stage. By then, it was clear that a broadly educated population could no …

The relationship between reading strategies that enhance essential learning in both · reading and history was studied. A U.S. History model has been developed to make connections between the teaching of history content and reading comprehension. Research has been obtained that indicates a direct correlation between student learning in a content area classroom and the integration ofreading strategies within daily lesson plans. Secondary teachers must be taught by teacher preparation programs and coached by administrators on how to develop lesson plans based on their students' need to use effective reading strategies. Secondary teachers must align their daily lessons and assessments …

All Graduate Projects

The search for early childhood curricula to prepare children from lowincome families for success in school began with the opening of Head Start in 1965 and Project Follow Through in 1967. Since then, interest in Early Childhood Curriculum Models has come and gone as the result of shifting trends in society. The nation is currently experiencing a renewed awareness in this area. The examination of the natural environment in relation to language acquisition is of increasing interest, as language acquisition is the precursor to pre-literacy skills. The natural environment is explored and an examination of several Early Childhood Curricula is …

The Integration Of Music Education Strategies Into The Regular First Grade Elementary Classroom, Gloria Jane Frueh Jan 2002

The Integration Of Music Education Strategies Into The Regular First Grade Elementary Classroom, Gloria Jane Frueh

All Graduate Projects

A handbook of activities for teaching music in an elementary first grade classroom was developed for use by first grade regular classroom teachers. A review of current educational research implicates music as being a valued discipline in early educational development of children. A number of public schools do not have a music specialist. If music education is to be part of the school's curriculum, it will have to be taught by the regular classroom teacher. Using the National Standards for Music Education and this handbook as a guide, teachers can address the nine music education fundamentals. Integration and assessment strategies …

Images Of Service: Reflections From The Campus Compact Midwest Collaboration Community Service Directors Fellowship Program 2000-2001, Beth Blissman, Jay Cooper

Higher Education

We Americans are people of the journey. From boats across the Atlantic by way of Pilgrim quest, to the holocaust of the middle passage, to classic travelogues such as On the Road or Travels with Charley (in Search of America}, the stamp of the mythic journey seems to be indelibly planted on our national psyche. And as we all know, journeys have several staple elements: anticipation, consumption of a variety of foods at exorbitant prices, wrestling with a roadmap, and children in the back crying, "Are we there yet?" A quintessentially American component to the journey, however, is the postcard.

Insurance, Terrorism, And 9/11: Reflections On Three Threshold Questions, Robert H. Jerry Ii Jan 2002

Insurance, Terrorism, And 9/11: Reflections On Three Threshold Questions, Robert H. Jerry Ii

UF Law Faculty Publications

For most of us, the collapse of the World Trade Center towers exists at the outermost edge of human comprehension. Even after one visits Ground Zero, the events of 9/11 retain a surreal quality, invoking feelings beyond words as one tries to contemplate losses immeasurable with numbers. Indeed, the insurance losses are insignificant when compared to the human tragedies caused by the terrorist attacks -- and in insurance terms, we witnessed the most costly, complex events to transpire in a single day in the history of the planet. Many years will pass before all the insurance ramifications of 9/11 are …

Little Engines That Could: Community Clients, Their Lawyers, And Training In The Arts Of Democracy, Susan Bennett Jan 2002

Little Engines That Could: Community Clients, Their Lawyers, And Training In The Arts Of Democracy, Susan Bennett

Presentations

We assume a lot about the virtues of governance "from the bottom up." We trust in it as an antidote: to oppression from the other direction; to the kind of "top-down" planning that we blame for the tragedies of urban renewal; and to the hubris of any "helping professionals" who think they have good ideas about the way in which communities ought to be helped.' In short, we place a great deal of faith in the authenticity of the neighborhood-based organization as an engine of democracy. Less emphatically, we also (sometimes) assume that programs run by neighborhood-based organizations carry with …

Antiques Roadshow: The Object Of Learning, Laura Felleman Fattal Jan 2002

Antiques Roadshow: The Object Of Learning, Laura Felleman Fattal

Journal of Social Theory in Art Education

Even as school administrators were cutting the unique feature of museum Educators from the school district budget, museum directors in Philadelphia were calling teaching through objects, 'lightning in a bottle.’ Educating through objects that have been crafted by talented artisans, owned by famous people, cherished by their association with loved ones, or inanimate witnesses to important historical moments is a recognized and immediate path to learning in the arts. In the search for the authentic, while simultaneously embracing the virtual, Americans participate in shaping a broad understanding of popular culture and accumulated history. Americans are having a love affair with …

Tagging A Boxcar In An Anxious Age, Jim Edwards Jan 2002

Tagging A Boxcar In An Anxious Age, Jim Edwards

Journal of Social Theory in Art Education

On Wednesday, September 12th, scheduled to fly from Salt Lake City to San Francisco, I found myself instead driving a rental car from Logan, Utah to the Bay Area. I left early - at daybreak, on a clear morning, just at that turning point when summer slides into autumn. Several hours later, on Interstate 80 east of Salt Lake and along the Bonneville Salt Flats, the National Public Radio station began to crackle and fade. By the time I crossed into Nevada, and moments after turning off the radio, I slunk into a state of sad resignation. Two hours of …
