Gore Wars, Alex Kozinski Jan 2002

Gore Wars, Alex Kozinski

Michigan Law Review

Unless you've been frozen in carbonite or are hopelessly gullible, it must have occurred to you at some point during the last three decades that environmental activists are exaggerating just a bit when they claim that, unless we dramatically change our way of life, we'll soon see the end of civilization as we know it. I'm not sure when these doomsday predictions got started - probably they go back to Malthus and beyond - but I first became aware of environmental Jeremiadism in college in the early 1970s, when tout-le-monde were reading a little book called The Limits to Growth. …

Toward A Jurisprudence Of Cost-Benefit Analysis, Michael Abramowicz Jan 2002

Toward A Jurisprudence Of Cost-Benefit Analysis, Michael Abramowicz

Michigan Law Review

In 1989, Cass Sunstein published an article entitled On the Costs and Benefits of Aggressive Judicial Review of Agency Action. Sunstein apparently meant the words "costs" and "benefits" in an informal sense, as the article considered the advantages and disadvantages of aggressive judicial review without pretense of explicit quantification. That article was several generations ago in Sunstein scholarship, almost 100 articles and over a dozen books. The central concerns of that article, however, are relevant to an assessment of Sunstein's latest book, whose title, The Cost-Benefit State, uses the words "costs" and "benefits" as labels for quantitative assessments of the …

Oliver Cromwell:Change And Continuity, Kari.L Ellis

All-Inclusive List of Electronic Theses and Dissertations

This study looks at the life of Oliver Cromwell,Lord Protector of England in an effort to clarify the diverse and conflicting interpretations resulting from a lack of agreement between those who are biased for and against the Lord Protector. The purpose of the study of this conflicting information is not to settle whether Cromwell was a good figure or bad, but to define more clearly his time.Cromwell, clarified creates a broader understanding of the seventeenth century Englishman. An introduction develops a brief summarization of Pre-Reformation Europe, the forces which brought changes,Reformation Europe and the Post-Reformation era in which Cromwell lived. The non-Cromwellian periods were …

Effects Of Theoretically Distinct Mathematics Interventions On Student Performance And Treatment Acceptability, Christopher Todd Arra Jan 2002

Effects Of Theoretically Distinct Mathematics Interventions On Student Performance And Treatment Acceptability, Christopher Todd Arra

All-Inclusive List of Electronic Theses and Dissertations

Student mathematics achievement and teacher and student acceptability of academic interventions are important factors in determining the usage and effectiveness of academic interventions. The present study compared the effectiveness and acceptability of theoretically distinct mathematics interventions. The study lasted eight weeks. Eighteen teacher-candidates and 54 fourth grade students were exposed to one of three mathematical interventions. Teacher-candidates and students were asked to rate the acceptability of each intervention. A pretest-posttest analysis of students' mathematics achievement was also conducted. Results showed that both teacher-candidates and students preferred all interventions equally and that mathematics achievement did not significantly increase from pre- to …

Personality Assessment Inventory Profiles Of Therapy -Seeking Women With Childhood Sexual Abuse Histories, Susan Renee Schmidt

All-Inclusive List of Electronic Theses and Dissertations

This study investigated the usefulness of the Personality Assessment Inventory (PAI) in detecting the presence of clinical profile patterns in therapy-seeking women with histories of childhood sexual abuse. An outpatient sample of 214 female college students completed the PAI as part of a university counseling center intake procedure. Participants were evenly divided into two groups according to self-reported history of childhood sexual abuse. Results of a two-way multivariate analysis of variance for abuse history showed that the average scores across the PAI's 22 scales were higher for women with childhood sexual abuse histories than for women without such histories. A …

Social Support, Spirituality, Psychological Distress And Quality Of Life In Cancer Patients, Nicole Denise Alexander Jan 2002

Social Support, Spirituality, Psychological Distress And Quality Of Life In Cancer Patients, Nicole Denise Alexander

All-Inclusive List of Electronic Theses and Dissertations

Cancer involves considerable physical and psychological complications. This reality, along with longer life expectancy, promotion of patient choice regarding life-sustaining measures, and concerns regarding distribution of health care funds highlight the need to focus on quality as well as quantity of life for individuals dealing with this disease. Although a relationship between psychosocial factors and quality of life in cancer patients has been speculated, the type and degree of influence is currently unclear. Using multiple regression analysis, potential predictors of quality of life for cancer patients were examined. Among the predictors considered were social support, spirituality, and psychological distress. The …

Efficient Utilization Of Fine-Grained Parallelism Using A Microheterogeneous Environment, William L. Scheidel Jan 2002

Efficient Utilization Of Fine-Grained Parallelism Using A Microheterogeneous Environment, William L. Scheidel

Theses

The goal of this thesis is to propose a new computing paradigm, called micro- Heterogeneous computing or mHC, which incorporates PCI (or other high speed local system bus) based processing elements (vector processors, digital signal processors, etc) into a general purpose machine. In this manner the benefits of heterogeneous computing on scientific applications can be achieved while avoiding some of the lim itations. Overall performance is increased by exploiting fine-grained parallelism on the most efficient architecture available, while reducing the high communication over head and costs of traditional heterogeneous environments. Furthermore, mHC based machines can be combined into a cluster, …

The following study has been conducted in the pursuit of a Masters Degree of Science in Information Technology. The functional purpose of this study was to examine three basic concepts (officer efficiency, safety, and arrest rates) within law enforcement and to attempt to determine if a specific type of information technology (wireless data computers) has had any positive impact on those concepts. To that end, the author has reviewed the history of technology in law enforcement and surveyed a group of patrol officers in the Wilmington Police Department. Difficulties associated with gathering research data from law enforcement agencies has also …

Analyzing The Costs/Tradeoffs Involved Between Layer 2, Layer 3, Layer 4 And Layer 5 Switching, Gautam Kapur Jan 2002

Analyzing The Costs/Tradeoffs Involved Between Layer 2, Layer 3, Layer 4 And Layer 5 Switching, Gautam Kapur

Theses

The switching function was primarily entrusted to Layer 2 of the OSI model, i.e. the Data Link Layer. A Layer 2 switch performs forwarding decisions by analyzing the MAC (Media Access Control) address of the destination segment in the frame. The Layer 2 switch checks for the destination address and transmits the packet to the appropriate segment if the address is present in its table of known destinations. If the entry for that address is not present, the switch then forwards the packet to all segments except the one on which it came from. This is known as flooding. When …

Lawyer-Negotiator As Mood Scientist: What We Know And Don't Know About How Mood Relates To Successful Negotiation, The, Clark Freshman, Adele Hayes, Greg Feldman Jan 2002

Lawyer-Negotiator As Mood Scientist: What We Know And Don't Know About How Mood Relates To Successful Negotiation, The, Clark Freshman, Adele Hayes, Greg Feldman

Journal of Dispute Resolution

This article explores two related questions: First, does mood7 shape how well lawyers succeed at negotiation?" Second, can lawyers succeed better at negotiation by understanding and managing the role of mood? We begin by exploring what scientific evidence we currently have about how mild changes in mood are associated with significant differences in success at negotiation. Ultimately, we argue that existing scientific evidence shows mood plays a far more complicated role than negotiators and negotiation scholars usually imagine, but that further research needs to address more carefully exactly how mood works and how it affects lawyers and legal negotiation. We …

Trial Rights And Psychotropic Drugs: The Case Against Administering Involuntary Medications To A Defendant During Trial, Dora W. Klein Jan 2002

Trial Rights And Psychotropic Drugs: The Case Against Administering Involuntary Medications To A Defendant During Trial, Dora W. Klein

Vanderbilt Law Review

The right of an accused in a criminal trial to due process is, in essence, the right to a fair opportunity to defend against the State's accusations. Those who have experienced the full thrust of the power of government when leveled against them know that the only protection the citizen has is in the requirement for a fair trial. [I]nvoluntary medication with antipsychotic drugs poses a serious threat to a defendant's right to a fair trial. On July 24, 1998, Russell Weston shot and killed two police officers, and wounded a third, near a security checkpoint in the United States …

Moral Progress, Mental Retardation, And The Death Penalty, George J. Annas Jan 2002

Moral Progress, Mental Retardation, And The Death Penalty, George J. Annas

Faculty Scholarship

Two major aspects of the death penalty in the United States directly involve physicians: how the death penalty is carried out and who is subject to execution. As a matter of constitutional law, both are governed by the prohibition against “cruel and unusual” punishment in the Eighth Amendment. The meaning of “cruel and unusual,” unlike every other part of the U.S. Constitution, is determined by public opinion as it reflects society's evolving standards of decency. With regard to how the death penalty is carried out, the role of physicians in capital punishment has been controversial for more than two decades. …

Mitigation Strategies For The Removal Of Rinsate Organics And Lithium-Based Dyes From Textile Effluents, Kathryn W. Huddle Jan 2002

Mitigation Strategies For The Removal Of Rinsate Organics And Lithium-Based Dyes From Textile Effluents, Kathryn W. Huddle

LSU Master's Theses

Governmental agencies have set regulatory values on the concentration of dye-related color that can be released in textile mill effluents. A proprietary biotic and abiotic technology treatment train was built at a candidate facility in northwestern Georgia to reduce the organic content and dye-related color content in the textile mill’s effluent. Laboratory experimentation began with bench scale 4 L immobilized microbe (IMBR) bioreactor tests to biologically treat primary wastewater streams, namely skein dye and space dye, from this candidate facility. The biological treatment reduced the organic content levels, expressed as chemical oxygen demand (COD), from 3185±30 to 290±20 mg/L (COD …

Prediction Of Transient Head On Seepage Path Using Boundary Fitted Coordinate (Bfc) System, Sherly Hartono Jan 2002

Prediction Of Transient Head On Seepage Path Using Boundary Fitted Coordinate (Bfc) System, Sherly Hartono

LSU Master's Theses

One of the main causes of levee failure is seepage through levee. This seepage can cause weakening in the levee structure, which in turn can cause sudden levee failure or overtopping of the levee due to levee depression. The purpose of this study is to determine the transient head on the seepage path due to changing water level during flood period. Transient seepage problems are very important as critical condition can occur during this time rather than during steady state condition. Seepage path through a levee can be predicted using the Boundary Fitted Coordinate (BFC) system method. The physical coordinate …

Feeding Habits Of Blacktip Sharks, Carcharhinus Limbatus, And Atlantic Sharpnose Sharks, Rhizoprionodon Terraenovae, In Louisiana Coastal Waters, Kevin Patrick Barry Jan 2002

Feeding Habits Of Blacktip Sharks, Carcharhinus Limbatus, And Atlantic Sharpnose Sharks, Rhizoprionodon Terraenovae, In Louisiana Coastal Waters, Kevin Patrick Barry

LSU Master's Theses

Little is known regarding the feeding behavior of many shark species. Even less is known about shark feeding habits in Louisiana coastal waters. The stomach contents of gillnet-captured blacktip sharks (n=356), Carcharhinus limbatus, and Atlantic sharpnose sharks (n=55), Rhizoprionodon terraenovae, were examined in this study. Roughly half of the blacktip stomachs (52%) and sharpnose stomachs (45%) contained prey items. The primary prey item in terms of percent number, occurrence, and weight for blacktips and sharpnose was the gulf menhaden, Brevoortia patronus. Both blacktips and sharpnose appear to mainly be piscivores; however, no members of Sciaenidae, the most common family of …

Prayer In Public Schools After Santa Fe Independent School District, Mark W. Cordes Jan 2002

Prayer In Public Schools After Santa Fe Independent School District, Mark W. Cordes

Faculty Articles, Papers, and Other Scholarship

The thesis of this Article is that the distinction between voluntary student prayer, and state-sponsored prayer, has arguably become the central consideration in analyzing school prayer cases. Not only was this distinction emphasized by the Court in Santa Fe and prior cases, but it perhaps best explains the Court's results in the cases. The distinction is one which best balances the competing constitutional concerns potentially present in school prayer cases. In particular, it guards against the primary Establishment Clause concerns. The distinction is also one which overlaps substantially with concerns about state coercion and endorsement of religion. Both coercion and …

Surveying Gender Bias At One Midwestern Law School, David H. Taylor Jan 2002

Surveying Gender Bias At One Midwestern Law School, David H. Taylor

Faculty Articles, Papers, and Other Scholarship

The graduating class of 1997 entered Northern Illinois University College of Law (NIUCOL) with 51% women. That figure steadily dropped over the next three years. The graduating class of 2000 entered NIUCOL with just 33% women. This was especially alarming because one of the administration's missions has been to provide access to the legal profession for persons belonging to groups traditionally under-represented in the profession. The decline was viewed as a possible step backward in what had previously been viewed as a very successful effort to recruit higher levels of women students. In an attempt to accurately measure the types …

Thinking Outside The Civil Case Box: Reformulating Pretrial Conference Laws, Jeffrey A. Parness, Matthew Walker Jan 2002

Thinking Outside The Civil Case Box: Reformulating Pretrial Conference Laws, Jeffrey A. Parness, Matthew Walker

Faculty Articles, Papers, and Other Scholarship

The civil case box generally described in written civil procedure laws references only presented claims and their named parties, including representative attorneys and agents tied to recovery or liability. Yet in many civil cases there must also be determined unpresented claims (i.e., insurance coverage) and nonparty interests (i.e., contingent or expert witness fee recovery). Unrepresented claims and nonparty interests should be processed, like presented claims, with a view toward "just, speedy, and inexpensive" resolutions. Such resolutions can be facilitated through pretrial conferencing. Written pretrial conference laws should be amended to encompass all that may be settled or tried in civil …

The Quality Of Hotel Employee Meals, And Employees' Perception Of The Quality, Eugene Tetteh Gorleku Jan 2002

The Quality Of Hotel Employee Meals, And Employees' Perception Of The Quality, Eugene Tetteh Gorleku

LSU Master's Theses

Growing interest in nutrition and health and the increase in the number of people eating away from home gives power and responsibility to retail foodservice operators. Employees of hotels, restaurants, and other food service establishments are in an important position to influence and impact the diet of the general public since they cook, recommend, and serve customers who visit their institutions. Healthful foods are available, and chefs would benefit from nutritional guidance. The escalating importance of foodservice establishments as the main distribution sites for Americans’ meals highlights the importance of the chef’s role in preparing and providing healthful food consistent …

National newspapers are also found having more interactive Web sites …

Efficient Convolvers Using The Polynomial Residue Number System Technique, Surendar Paruchuri Jan 2002

Efficient Convolvers Using The Polynomial Residue Number System Technique, Surendar Paruchuri

LSU Master's Theses

The problem of computing linear convolution is a very important one because with linear convolution we can mechanize digital filtering. The linear convolution of two N-point sequences can be computed by the cyclic convolution of the following 2N-point sequences. The original sequence padded with N zero’s each. The cyclic convolution of two N-point sequences requires multiplications and additions for its computation. A very efficient way of computing cyclic convolution of two sequences is by using the Polynomial Residue Number System (PRNS) technique. Using this technique the cyclic convolution of two N-point sequences can be computed using only N multiplications instead …

Implementation Of An Integrated Quality Assurance Program For Ct-Tps Process, Junqing Wu Jan 2002

Implementation Of An Integrated Quality Assurance Program For Ct-Tps Process, Junqing Wu

LSU Master's Theses

Systematic constancy and accuracy of a treatment planning system (TPS) are crucial for the entire radiation treatment planning process (TPP). The Quality Assurance (QA) of individual components does not necessarily lead to satisfying performance of the whole process due to the possible errors introduced by the data transfer process between components and other fluctuations. However, most of current QA for TPS is confined to the treatment planning computers. In this study, a time efficient and integrated CT-TPS QA procedure is presented, which starts at the beginning of the TPS input --- Computer Tomograhpy (CT). The whole QA procedure is based …

The Effects Of Fall Coldfront Passages On The Nekton Community In A Tidal Creek In Port Fourchon, La, As Monitored By Hydroacoustics, David J. Harmon Jan 2002

LSU Master's Theses

Split-beam hydroacoustic sampling with two, 420 KHz, 2x6 degree elliptical transducers was evaluated as a tool to quantify nekton movements in a Louisiana estuary. I measured the effects of atmospheric cold front passages on nekton in a tidal creek in Port Fourchon, LA during the fall of 2000. Six “fronts” were sampled between October 6 and December 18, 2000. Nekton density ranged from 0 to 24.4 fish/m3 with an overall mean of 2.44 fish/m3. Net samples were taken to supplement the acoustic data with species composition data. Species composition changed from October to December. A higher number …

The Effects Of Phytase In Nutritionally Adequate Diets, Diets Deficient In Calcium And Phosphorus, And The Interactive Effects Of Phytase And Eimeria Acervulina Infection In Broiler Chicks, Brandy Centrell Watson Jan 2002

The Effects Of Phytase In Nutritionally Adequate Diets, Diets Deficient In Calcium And Phosphorus, And The Interactive Effects Of Phytase And Eimeria Acervulina Infection In Broiler Chicks, Brandy Centrell Watson

LSU Master's Theses

Six experiments were conducted to determine the interactive effects of Eimeria acervulina (E. acervulina) infection and phytase, and the effects of phytase in nutritionally adequate diets and in diets deficient in Ca and available P (aP). Corn-soybean meal (C-SBM) diets were used. In Exp 1, treatments were: 1) C-SBM, 1.0% Ca and 0.45% aP; 2) C-SBM, 0.80% Ca and 0.25% aP; 3) Diet 1 + 600 FTU phytase/kg; 4) Diet 2 + 600 FTU phytase/kg; 5 to 8) Diets 1 to 4 but infected with coccidiosis. Weight gain (ADG), feed intake (ADFI), and gain:feed were reduced (P < 0.01) by the coccidial infection and the reduction in Ca and aP. Phytase increased (P < 0.02) ADG and ADFI, regardless of the Ca and aP content of the diet or the presence of coccidiosis. Gain:feed was increased by phytase but only in uninfected chicks (phytase x coccidiosis interaction, P < 0.02). Phytase increased (P < 0.02) bone ash percentage but only in diets deficient in Ca and aP (P < 0.01). Experiments 2 and 3 included only treatments 1 to 4 of Exp 1. The reduction in Ca and aP reduced (P < 0.01) ADG, ADFI, and gain:feed. Phytase addition increased (P < 0.02) ADG and ADFI in diets deficient in Ca and aP and in the nutritionally adequate diets. Experiments 4, 5, and 6 were conducted to determine the effects of phytase on intestinal transit time in broilers. Diets were: 1) C-SBM, 0.9% Ca and 0.35% aP; 2) C-SBM, 0.80% Ca and 0.25% aP + 600 FTU phytase/kg. Transit time on Day 1, but not on Day 7, was faster (P < 0.03) in chicks fed phytase. These data indicate that phytase is effective in the presence of a coccidial infection, but it may not be as effective as in uninfected chicks. Futhermore, phytase increases growth in diets deficient in Ca and aP and in diets formulated to be adequate in all nutrients. This increase in growth may be due to a faster transit time of feed through the digestive tract, resulting in a greater feed intake and gain.

The Differences In Performance Of A Left Vs. Right Brained Golfer On A Curvilinear Golf Course, Robin Suzanne Jamison Jan 2002

The Differences In Performance Of A Left Vs. Right Brained Golfer On A Curvilinear Golf Course, Robin Suzanne Jamison

LSU Master's Theses

Our everyday movement is reflected by those individuals who design the world in which we live. Ninety percent of the people who shape our everyday lives are right handed. Individuals perceive life differently, especially left and right handed individuals. One reason left and right-handed individuals interpret differently is due to the brains’ two hemispheres processing information separately. Can this difference in interpretation result in varying abilities of performance? Research has proven that those individuals who are right hemisphere dominant process and comprehend shapes better than left hemisphere dominant individuals. Golf is an activity that is exhibits the constant changing of …

The Effect Of Nocturnal Sampling On Semen Quality And The Efficiency Of Collection In Bovine Species, Jennifer H. Yates Jan 2002

The Effect Of Nocturnal Sampling On Semen Quality And The Efficiency Of Collection In Bovine Species, Jennifer H. Yates

LSU Master's Theses

The objective of this study was to evaluate two semen collection schedules utilizing the assumed behavioral differences between bovine species. The efficiency was measured by bull behavior and semen quality parameters. Four Holstein and four Brahman bulls were collected each during a morning and a night collection time weekly. Ejaculates (n=64) were obtained via artificial vagina over four-weeks. To avoid masking benefits of night collection, the first collection of the week was alternated between night and day. Two collection teams were employed to reduce the time needed for collection, and the variability in collection method. Sampling order and collection team …

Fecal Coliform Decay And Regrowth Kinetics In An Anaerobic Dairy Wastewater Environment, Shufang Liu

LSU Master's Theses

The kinetics of fecal coliforms (FC) decay and regrowth were analyzed under laboratory conditions using filtered dairy wastewater under anaerobic conditions. The mean specific growth rates during the regrowth phase, µr , in the batch study were 1.79, 1.46, and 1.27d-1 for initial organic carbon concentrations of 478, 235 and 127 mg/L COD, respectively. The substrate concentrations had a significant impact on the FC regrowth. A maximum specific growth rate (mmax) of 1.92 d-1, and half-saturated coefficient (ks) of 60.92mg/L were determined from these data. The mean dark FC decay rate coefficients, kd , at 35oC in the batch study …
