The Core Virtue Of Christian Librarianship, Gregory A. Smith Jan 2002

The Core Virtue Of Christian Librarianship, Gregory A. Smith

The Christian Librarian

Christian librarians should derive their professional ethics from methodical exegesis of the Bible. The New Testament's most salient ethical statements center on love-for God, neighbor, and fellow believers. Each of these has significant implications for library practice. Identifying love as the core virtue of librarianship represents a radical departure from secular approaches to library ethics. While the biblical and secular models converge on some significant points, they are fundamentally opposite. Where the two reach similar conclusions, the biblical model proves to be more philosophically consistent. The Scriptures speak with enduring relevance to the issues facing librarians.

Prediction Of Electric Load Using Kohonen Maps - Application To The Polish Electricity Consumption, Amaury Lendasse, M. Cottrell, V. Wertz, M. Verleysen Jan 2002

Prediction Of Electric Load Using Kohonen Maps - Application To The Polish Electricity Consumption, Amaury Lendasse, M. Cottrell, V. Wertz, M. Verleysen

Engineering Management and Systems Engineering Faculty Research & Creative Works

The Problem of Electrical Load Forecasting Presents Some Particularities, Compared to the Generic Problem of Time-Series Prediction. One of These Particularities is that Several Values (Corresponding to One Day of Consumption) Are Usually Expected as the Result of the Prediction. in This Paper, We Propose an Original Method Dividing the Problem into Three Parts: Prediction of the Daily Mean, of the Daily Standard Deviation and of the Normalized Daily Profile. for the Mean and the Standard Deviation, Radial Function Networks Are Used as Nonlinear Approximations. for the Normalized Profile, a Method based on Kohonen Maps is Proposed. This Method is …

The Belated Decline Of Literalism In Professional Responsibility Doctrine: Soft Deception And The Rule Of Law, William H. Simon Jan 2002

The Belated Decline Of Literalism In Professional Responsibility Doctrine: Soft Deception And The Rule Of Law, William H. Simon

Faculty Scholarship

Literalism is the doctrine that a facially accurate but knowingly deceptive statement does not violate prohibitions of falsehood and misrepresentation. This essay argues that Literalism has had greater legitimacy in professional responsibility than in other areas of law, but that it seems to be in terminal decline. It surveys the arguments for and against Literalism and concludes that its impending demise should be welcomed.

Relational Contract And Other Models Of Marriage, Robert Leckey Jan 2002

Relational Contract And Other Models Of Marriage, Robert Leckey

Osgoode Hall Law Journal

This article proposes relational contract as a model for analyzing marriage under Canadian law. In contrast, in Bracklow v. Bracklow, the Supreme Court of Canada recognized two "competing" models of marriage and three models of spousal support. The difficult policy issues in the law of spousal support relate not to a tension between different models but instead go to compensation, including reliance and expectations. This article uses relational contract to critique Bracklow, considering the challenges in defining models. The Court's basic social obligation model and its non-compensatory support are unjustifiably broad, and its compensatory support is too narrow. In assessing …

Electronic Structure And Bonding In Metal Porphyrins, Metal=Fe, Co, Ni, Cu, Zn, M.-S. Liao, Steve Scheiner

Chemistry and Biochemistry Faculty Publications

A systematic theoretical study of the electronic structure and bonding in metal meso-tetraphenyl porphines MTPP, M=Fe, Co, Ni, Cu, Zn has been carried out using a density functional theory method. The calculations provide a clear elucidation of the ground states for the MTPPs and for a series of [MTPP]x ions (x = 2+, 1+, 1−, 2−, 3−, 4−), which aids in understanding a number of observed electronic properties. The calculation supports the experimental assignment of unligated FeTPP as 3A2g, which arises from the configuration (dxy)2(dz …

Electronic Structure And Bonding In Unligated And Ligated Feii Porphyrins, M.-S. Liao, Steve Scheiner

Chemistry and Biochemistry Faculty Publications

The electronic structure and bonding in a series of unligated and ligated FeII porphyrins (FeP) are investigated by density functional theory (DFT). All the unligated four-coordinate iron porphyrins have a 3A2g ground state that arises from the (dxy)2(dz2)2(dπ)2 configuration. The calculations confirm experimental results on Fe tetraphenylporphine but do not support the resonance Raman assignment of Fe octaethylporphine as 3Eg, nor the early assignment of Fe octamethyltetrabenzporphine as 5B2g. For the six-coordinate Fe–P( …

Lawyer Advertising And The Philosophical Origins Of The Commercial Speech Doctrine, Ronald D. Rotunda Jan 2002

Lawyer Advertising And The Philosophical Origins Of The Commercial Speech Doctrine, Ronald D. Rotunda

University of Richmond Law Review

The topic of lawyers advertising for clients seems prosaic enough, but it is really a subset of a much larger, more theoretical question. What Americans think about the Constitutional right of lawyers to advertise and market their services both reflects and molds what we think about the right to be left alone. In 1928, Justice Brandeis, in his famous dissent in Olmstead v. United States, wrote that our Constitution "conferred, as against the Government, the right to be left alone-the most comprehensive of rights and the right most valued by civilized men." Justice Brandeis did not speak in a vacuum; …

The Signaling Model Of Social Norms: Further Thoughts, Eric A. Posner Jan 2002

The Signaling Model Of Social Norms: Further Thoughts, Eric A. Posner

University of Richmond Law Review

One of the most notable trends in legal scholarship is the explosion of writing on social norms. Just a few years ago one might have argued that the scholarship was marginal, of interest to only a handful of law professors, but expressions of skepticism about the value of this scholarship have become rare. At the same time, it would be wrong to say that "law and social norms" ("LSN") is a movement or school within legal scholarship: the writings about this topic are too diverse, and there is little of that sense of forward movement that is characteristic of more …

The study also investigated the relationship between the principals’ and teachers’ perceptions of the principals’ leadership style as well as the principals’ and teachers’ perceptions of the presence of the 14 school cultural norms in their school cultures.

The sample used in this study included building principals and their instructional staffs from 32 small, public middle schools across the Commonwealth of Virginia. Onsite visits were conducted by the researcher to …

"How To Think About Equality." Review Of Sovereign Virtue: The Theory And Practice Of Equality, By R. Dworkin, Don Herzog Jan 2002

"How To Think About Equality." Review Of Sovereign Virtue: The Theory And Practice Of Equality, By R. Dworkin, Don Herzog

Reviews

Ronald Dworkin's' latest might well seem sharply discontinuous with his other work. The formal theoretical apparatus that kicks off the book is a forbiddingly abstract - some will say arcane - hypothetical auction, coupled with a hypothetical insurance market. There is simply nothing like it in Taking Rights Seriously, or A Matter of Principle, or Law's Empire, or Life's Dominion, or Freedom's Law. Then again, Dworkin first published the key papers on the auction some twenty years. ago and has never flagged, as far as I know, in his commitment to the basic project.2 Theorists have been waiting for the …

The Constitution And The New Deal, Richard D. Friedman Jan 2002

The Constitution And The New Deal, Richard D. Friedman

Reviews

The Supreme Court of the New Deal era continues to captivate American lawyers and historians. Constitutional jurisprudence changed rapidly during the period. Moreover, some of the most significant changes appeared - whatever the reality - to result from pressure imposed in 1937 by President Franklin Roosevelt's plan to pack the Court with Justices amenable to his programme. The structure of constitutional law that emerged within a few years of Roosevelt's death remains intact in significant respects today.

"Business On Trial: The True Story." Review Of Business On Trial: The Civil Jury And Corporate Responsibility, Richard O. Lempert Jan 2002

"Business On Trial: The True Story." Review Of Business On Trial: The Civil Jury And Corporate Responsibility, Richard O. Lempert

Reviews

Jury trials are very much an affair of stories. Lawyers tell stories to juries. Evidence is more convincing when presented in story order. Jurors use stories to make sense of evidence. And litigants, particularly losing litigants, tell stories about juries. One of the favorite stories of losing business litigants, second only to the irrational jury story, is the Robin Hood story. Juries love to play Robin Hood, to steal from the rich (businesses and insurance companies) and to give to the poor (individual litigants, especially individual tort litigants). The storytellers see no mystery here. Jurors are "little guys," like the …

Genetic Interventions: (Yet) Another Challenge To Allocating Health Care, Arti K. Rai Jan 2002

Genetic Interventions: (Yet) Another Challenge To Allocating Health Care, Arti K. Rai

San Diego Law Review

Much of the existing literature on genetic intervention addresses questions of discrimination or reproductive decisionmaking. Although this book discusses those questions,

it takes as its major focus an issue that is perhaps even more vexing—the issue of how we should, from the standpoint of distributive justice, allocate genetic interventions. In other words, given the wide range of genetic interventions that may become available, how should we divide such interventions? Implicit in this problem is the reality that scarcity will prevent individuals from having access to all genetic interventions that would be of benefit to them. In this brief Essay, I …

Punishing Reproductive Choices In The Name Of Liberal Genetics, Alexander Morgan Capron Jan 2002

Punishing Reproductive Choices In The Name Of Liberal Genetics, Alexander Morgan Capron

San Diego Law Review

When the four American moral philosophers who individually have already made the most significant contributions to the ethical analysis of contemporary health care and medicine collaborate, it should come as no surprise that their joint effort is a lucid and powerful analysis of the principles that a just and humane society would employ in setting policies about how the new tools of molecular genetics should be used for human betterment. In From Chance to Choice: Genetics and Justice, Allen Buchanan, Dan W. Brock, Norman Daniels, and Daniel Wikler aimed to steer a middle course between two extreme models. The first …

Is Moral Theory Perplexed By New Genetic Technology?, Richard J. Arneson

San Diego Law Review

From Chance to Choice: Genetics and Justice

intelligently addresses difficult issues at the intersection of medical ethics and the theory of justice. The authors Allen Buchanan, Dan W. Brock, Norman Daniels, and Daniel Wikler repeatedly emphasized their opinion that advances in genetic technology force upon us entirely new ethical questions that previous moral theories lack the resources to resolve.

The claim that

new scientific discoveries render previous moral theories obsolete should be regarded with suspicion. Suspicion should be further aroused when readers note another feature of the authors’ theorizing that neatly fits the claim that we stand at the dawn …

A Rawlsian Approach To Solving The Problem Of Genetic Discrimination In Toxic Workplaces, Robert A. Bohrer

San Diego Law Review

The Human Genome Project (HGP) may well be the beginning of a technological leap that rivals the advent of the Industrial Age.2 The principal goal of the project is to map and fully sequence3

the twenty- four chromosomes that contain the complete genetic contents of a

normal human cell. The human genome consists of twenty-two pairs of chromosomes plus the X and Y chromosomes that determine gender.4 As would be expected for such a technologically adventurous undertaking, the HGP has been accompanied by a substantial outpouring of concern about the ethical, legal, and social issues that will arise from this …

Does Technological Enhancement Of Human Traits Threaten Human Equality And Democracy?, Michael H. Shapiro Jan 2002

Does Technological Enhancement Of Human Traits Threaten Human Equality And Democracy?, Michael H. Shapiro

San Diego Law Review

This Article outlines some of the moral, legal, and general policy difficulties that societies and individuals will face if technological enhancements via germ line and somatic mechanisms become possible. It identifies and analyzes some of the conceptual structures necessary to explain the nature of these difficulties, suggests some alternative basic scenarios—such as greater or lesser scarcity of technological enhancement resources, impacts on how we perceive each other, and different remediation patterns—and then maps and reverse maps the projected technological developments against the value and legal structures. This Article also describes and comments on what may seem to be, from our …

Pavlovich V. Superior Court: Spinning A World Wide Web For California Personal Jurisdiction* Jan 2002

Pavlovich V. Superior Court: Spinning A World Wide Web For California Personal Jurisdiction*

San Diego Law Review

This Casenote questions the Pavlovich court’s holding. More

specifically, it argues that the exercise of personal jurisdiction in this case violates the Due Process Clause of the Fourteenth Amendment to the United States Constitution and that the court erred when it failed to quash service of process. Further, this Casenote posits that exercise of jurisdiction here not only eviscerates the mandates of International Shoe Co. v. Washington and its progeny, but also extends California jurisdiction to cover Internet users everywhere.

Unbuckling The “Chemical Straitjacket”: The Legal Significance Of Recent Advances In The Pharmacological Treatment Of Psychosis, Douglas Mossman

San Diego Law Review

The

pharmacotherapeutic properties of antipsychotic medications— their actions, therapeutic uses, benefits, adverse effects, contraindications, and risks—are quintessentially medical topics, even when the situations and contexts in which doctors prescribe or recommend their use raise legal questions. Frequently, however, the legal database (that is, published opinions, legislation, regulation, and law review articles) is the principal or sole information source cited and consulted by lawyers, judges, and scholars who write about these drugs and make decisions concerning the persons that may have to take them. What often results is the perpetuation of mistaken, outdated, distorted, biased, contradictory,

or just plain foolish ideas …

Sua Sponte Appellate Rulings: When Courts Deprive Litigants Of An Opportunity To Be Heard, Barry A. Miller

San Diego Law Review

But the Supreme Court and other appellate courts have failed to follow any consistent practice about sua sponte holdings. The difficulty courts have is illustrated by the fact that even the most prominent appellate judges sometimes say they want procedural regularity, but in other cases exercise the freedom to do what they like.

Clearer Skies For Investors: Clearing Firm Liability Under The Uniform Securities Act Jan 2002

Clearer Skies For Investors: Clearing Firm Liability Under The Uniform Securities Act

San Diego Law Review

Securities fraud poses a major threat to the financial security of millions of investors. Stock fraud and the brokerage firms perpetrating it thrive, bilking investors out of millions of dollars annually. The North American Securities Administrators Association (NASAA), an association comprised of state and regional securities regulators, estimates that investors lose $6 billion a year to investment fraud, including micro-cap stock fraud.1 In 2000, Bradley Skolnick, the Indiana Securities Commissioner and former head of the NASAA, stated that boiler rooms were “the single greatest source of investment scams.” Yet defrauded investors are unlikely to recover funds lost to fraud, because …

Shallow coastal lagoons are subject to anthropogenic nutrient enrichment and disturbances that result in loss of seagrass ecosystems. These losses have generated a desire by coastal managers for tools to monitor existing seagrass meadows, and to restore those that have been lost. The following Chapters in this dissertation address aspects of these issues. Chapter 1 documents a nearly 16 month study of Zostera marina seasonal and year-to-year leaf and rhizome morphology and growth in Ninigret Pond, R.I. Individual shoots produced approximately 0.11 leaves per day from March to December. Shoot surface area and the length of the longest leaf on …

The Fundamental Study Of Polyvinylidene Fluoride (Pvdf) And Its Application In A Pyroelectric Ir Sensor Device, Marcel Benz

Open Access Dissertations

The object of this research project was to find fabrication methods of pyroelectric devices for an infrared sensor using poly(vinylidene fluoride) (PVDF) polymer thin films. It is anticipated that such sensors will lead to IR cameras with improved sensitivity and reduced production costs compared to currently available technology. This concept had originated in collaboration with Teltron Technologies, Inc., a display manufacturing company in Pennsylvania. In order to succeed with the predicted polymer application a profound general research study on PVDF was undertaken. Initially the work focused on the preparation of PVDF thin polymer films. Solution deposition from an acetone/N,N-dimethylformamide (DMF) …
