Advisory Committee On The Federal Rules Of Evidence: Tending To The Past And Pretending For The Future?, Paul R. Rice

This Article characterizes the history of the Advisory Committee on the Federal Rules of Evidence as disappointing. It argues that too often, over too long a period of time, the Advisory Committee has neglected its stewardship responsibilities and the blatant inadequacies of the codified evidence rules. As a consequence, significant problems have gone unattended as the Committee waits to see if the judges can solve the problems their rules have created.

The article notes that some concepts created in the codified evidence rules have proven to be problematic, if not completely inadequate, but there has been no willingness to re-examine …

The creation and interpretation of evidence rules is a burgeoning area for evidence scholarship. Recent changes to federal evidence law, such as the addition of rules on the admissibility of a defendant's prior sexual conduct, and the amendments to the rules regarding expert testimony, have highlighted the political and controversial aspects of procedural rulemaking. Giving Codification A Second Chance--Testimonial Privileges And The Federal Rules Of Evidence, Kenneth S. Broun

The draft Federal Rules of Evidence proposed to Congress in 1972 contained a set of rules governing privileges. After a storm of protest over both the concept of codified federal privilege rules and the content of the drafted rules, Congress excluded the proposed privilege rules from its 1975 enactment of the Federal Rules of Evidence. It substituted current Rule 501, which provides for privileges to be governed by the state law of privilege in diversity cases and the "principles of the common law" in all other cases.

Non-Point Source (NPS) pollution models are effective watershed-scale predictors of NPS loadings and useful evaluators of agricultural Best Management Practices (BMPs) and water quality Total Maximum Daily Loads (TMDLs). The work reported in this thesis examined two applications of the AGricultural Non-Point-Source (AGNPS) pollution model: 1) predicting surface runoff, nutrient loading, and sediment yield predictions for an artificially delineated farm-scale watershed; and 2) evaluating relative benefits of different BMPs on reducing sediment accumulation in a lake surrounded by agricultural land. Advances in computing power have made it possible for scientists to perform atomistic simulations of material systems that range in size, from a few hundred thousand atoms to one billion atoms. An immersive and interactive walkthrough of such datasets is an ideal method for exploring and understanding the complex material processes in these simulations. However rendering such large datasets at interactive frame rates is a major challenge. A scalable visualization platform is developed that is scalable and allows interactive exploration in an immersive, virtual environment. The purpose of this study was to investigate the influence of perception of social support, privacy preference and level of depression on marital adjustment for couples presenting for infertility treatment. Data was obtained from three infertility clinics in Louisiana from January 1, 2001 through October 1, 2001. Forty-seven couples presenting for infertility treatment completed four questionnaires measuring marital adjustment, perception of social support, privacy preference and level of depression. Demographic and descriptive information was gathered from an information sheet completed by the subjects. In this study I discuss the importance of audience selection and response upon the dramaturgies of African American playwrights August Wilson and Ed Bullins. Using the theories and criteria for African American art and theatre as espoused by Alain Locke, W.E.B. Du Bois, and Amiri Baraka, and created by the 1960s and 1970s Black Theatre and Black Aesthetic movements, I discuss the importance of audience selection to Wilson's dramas, especially given his tremendous success on Broadway. Many organizations are committing to education and training that deepens skills, perspectives, and competencies of their leaders. This research located 103 studies from 1982-2001 with a full range of managerial leadership development interventions including feedback, developmental relationships, on-the-job experiences, and formal training. It integrated results of 83 of these studies with formal training interventions via meta-analytic techniques to determine the effectiveness of interventions, in their enhancement of performance, knowledge, and expertise at the individual, team or group, or organizational level. This thesis examines the role and status of the tourist in the present day. It argues that the tourist, and the touristic experience, is emblematic of the consumption-based economy of late capitalism. It analyses tourism as a practice of, rather than opposed to, everyday life, for many subjects in late-capitalist Western society. The argument is developed by comparing and contrasting the tourist with the flâneur. The flâneur is regarded as a representative subjectivity of early modernity who developed visual and spatial practices, methodologies of movement and observation, which interpreted the city. Autosomal dominant polycystic kidney disease (ADPKD) is one of the most common Mendelian disorders, affecting approximately 1 in 1000 individuals. The disease is recognised as a systemic disorder, which expresses a complex phenotype between and within families. Mutations in at least two genes (PKDI and PKDZ) result in ADPKD, however, additional genetic and non-genetic factors are expected to contribute to the observed phenotypic variance.

The Power Of Desire In Selected Plays By Henrik Ibsen, Brooke Torrens

This thesis explores how desire operates in selected plays by the Norwegian dramatist, Henrik Ibsen. I will argue that desire acts us a motivating force, urging the characters to seek fulfilment in their ideals, resulting in both defeat and triumph. The four plays considered, Rosmersholm, The Lady From the Sea. Hedda Gabler and The Master Builder, depict characters that are unable to sustain ordinary existence. This inability produces equivocal and contradictory human emotions that both restrict and impel the characters as they journey toward their downfall and salvation. Academic achievement can impact on psychological wellbeing and can have a profound impact on later educational and vocational opportunities. Failure to achieve well academically has been associated with a number of factors including depression, a pessimistic explanatory style and mobility. There is evidence too to suggest that the impact of these variables is greater on younger boys and older girls. This study aimed to identify the needs of mothers when they were indecisive (immobilized) about believing or protecting their child who had been sexually abused, taking into consideration that they had also been sexually abused in childhood (multigenerational abuse) and that their ecological contexts may have also played a role. Four Mothers were recruited from an agency dealing in abuse issues. Case studies were compiled after recording a qualitative conversational, semi-structured interview (Burgess-Limerick & Burgess-Limerick, 1998), using questions derived from the literature. Peer collaboration is a commonly used learning strategy, perceived by educators as a valuable educational activity. Studies do indicate a performance output benefit for children working collaboratively compared to children working individually. However, the longer term cognitive benefits of collaboration appear to be limited by a number of factors. It is suggested that cognitive change following peer collaboration is limited to children working with a more cognitively competent peer (or one with a different perspective), active participation and reasoned communication. To date there has been limited research addressing the psychosocial consequences of poor coordination in Australian adolescent boys. The implications of failing to meet the expected physical standards of their peers, teachers and parents, can result in low self-esteem and subsequent withdrawal from participation (Lintunen, 1995). According to Harter's (1981) Theory of Competence Motivation, low motor competence is likely to lead to low self-perceptions in the athletic domain. This review was focussed on three areas (1) theoretical concepts of stress, coping and social support; (2) explanations for the patterns of prisoners' perceptions of their support-seeking behavior; and (3) the impact on families providing support. Prisoners' patterns of support seeking in the prison environment appear more consistent with hierarchical organisations than the domestication model of unit management. For stressful, uncontrollable situations, emotional support is sought from families, who are difficult to access. The family obligation to provide the free service of support to prisoners has implications for prison management and policy. Priorities for future research are (1) the impact …

The types of parenting challenge that arise as a direct result of both intoxication and a drug using lifestyle were examined. Increasingly, advanced cancer patients are receiving care in the community supported by families and hospice home care services. However, little or no preparation is provided to family caregivers who assume this supportive role, often 24 hours per day. Pain management is consistently identified by family caregivers as their primary concern related to care and support of a relative with cancer. This project involved a three-phase program of research to develop and test a pain management program (PMP) that would provide family caregivers of advanced cancer patients with information and skills to manage the patient's pain.

Since 1984 the role of the government in Western Australia, has changed in relation to occupational safety and health. This study considers the effect of the occupational safety and health legislation using workers' compensation accident data. Academic and general staff accident data from a Western Australian University were researched. The time period is 20 years- 1979 through 1998 inclusive. 2,773 worker's compensation claims were analysed using Mann Whitney -U tests and cross-tabulations of safety prevention expenditure against the claims.
