Motivations And Gratifications For Selecting A Niche Television Channel: Byu Television, Diena L. Simmons Jan 2002

Motivations And Gratifications For Selecting A Niche Television Channel: Byu Television, Diena L. Simmons

Theses and Dissertations

The growth of direct broadcast satellite television distribution to the home as a viable competitor to cable and terrestrial broadcast has fostered the availability of special interest or niche channels and therefore provided greater choice to the viewer. This study, based on uses and gratifications theory, examined the relationships among ritual and instrumental viewing motivations and satisfactions, viewer religiosity, and viewing attentiveness as they related to the selection of a niche television channel, Brigham Young University Television.
The uses and gratification approach provides an appropriate framework for studying "media consumption, the interrelated nature of television user motives, and the relationships …

The Symphony In America: Maurice Abravanel, And The Utah Symphony Orchestra: The Battle For Classical Music, Alex D. Smith Jan 2002

The Symphony In America: Maurice Abravanel, And The Utah Symphony Orchestra: The Battle For Classical Music, Alex D. Smith

Theses and Dissertations

Between 1947 and 1979 the Utah Symphony Orchestra was transformed from an obscure, part-time, amateur orchestra into one of the major symphony orchestras in America. By 1947 the orchestra, which had begun as a Works Progress Administration organization, was barely hanging on. The symphony struggled to remain financially solvent, performing only a few concerts per year. Thirty-two years later the Utah Symphony Orchestra was one of the most prestigious musical ensembles in the country— receiving rave reviews from critics around the world, touring extensively, and with more than a hundred albums to its credit. The remarkable growth of the Utah …

Reparations And The Colonial Dilemma: The Insurmountable Hurdles And Yet Transformative Benefits, Ediberto Román

Faculty Publications

The Seventh Annual Latina and Latino Critical Race Theory ("LatCrit") Conference held in May 2002 at the University of Oregon, not unlike other efforts in the movement, addressed a panoply of challenging, provocative, and controversial issues. Perhaps one the most intellectually interesting and yet troubling panels addressed reparations for the inhabitants of United States' colonial territories. Specifically, the panel was titled "Reparations, Redress, and Remedies: Undoing the Legacy of Colonialism and Imperialism." Members of the academy as well as a representative of Puerto Rico's Independence Party participated in a lively discussion and debate. Although the articles resulting from this panel …

Turkish Journal of Agriculture and Forestry

Structural and statistical analyses of small establishments in the forest products industry were performed in 63 towns and cities in six provinces in the Eastern Black Sea region, which is relatively less developed than many other regions in Turkey. The other objective of this study was to classify the establishments by using various factors. Correlation, cluster and discriminate analysis were used for classification of these establishments. Twenty-five various factors, collected especially from workers, were analyzed. The study was realized using questionnaire forms, filled in with the face-to-face communication method. As a result, 341 questionnaire forms were filled out in 63 …

Integrating The Activities Required To Recruit And Retain Profitable Customers In Contemporary Retail Banking, Susan Walsh Jan 2002

Integrating The Activities Required To Recruit And Retain Profitable Customers In Contemporary Retail Banking, Susan Walsh

Articles

Today’s high street retail bank faces a major challenge in integrating the marketing activities required both to recruit new customers and to retain existing profitable ones. The challenge involves a judicious mix of “transaction marketing” – mainly aimed at winning new clients – and of “relationship marketing”- largely aimed at retaining present ones. Evidence from a detailed qualitative study of marketing practice in a UK high street bank, a subsidiary of an Irish headquartered bank, demonstrates just how problematic achieving this balance can be. The date indicates that this bank underinvested in a number of activities that are of primary …

Comparing Precaution In The United States And Europe, Jonathan B. Wiener, Michael D. Rogers Jan 2002

Comparing Precaution In The United States And Europe, Jonathan B. Wiener, Michael D. Rogers

Faculty Scholarship

The regulation of health and environmental risks has generated transatlantic controversy concerning precaution and the precautionary principle (PP). Conventional wisdom sees the European Union endorsing the PP and proactively regulating uncertain risks, while the United States opposes the PP and waits for evidence of harm before regulating. Without favouring either approach, this paper critically analyses the conventional depiction of transatlantic divergence. First, it reviews several different versions of the PP and their different implications. Second, it broadens the transatlantic comparison of precaution beyond the typical focus on single-risk examples, such as genetically modified foods. Through case studies, including hormones in …

International Remedies In National Criminal Cases: Icj Judgment In Germany V. United States, Douglass Cassel Jan 2002

International Remedies In National Criminal Cases: Icj Judgment In Germany V. United States, Douglass Cassel

Journal Articles

In Germany v. United States (2001), the International Court of Justice ruled that the Vienna Convention on Consular Relations confers judicially enforceable rights on foreign nationals detained for prolonged periods or sentenced to severe penalties without notice of their right to communicate with their consulates. The Court also ruled that states which fail to give timely notice cannot later invoke procedural default to bar individuals from judicial relief. However, the Court did not clearly address other issues, such as requiring individuals to show prejudice to the outcome of the trial, or denial of certain remedies for Convention violations, which may …

How Much Does Legal Status Matter? Adoptions By Kin Caregivers, Margaret F. Brinig, Steven L. Nock Jan 2002

How Much Does Legal Status Matter? Adoptions By Kin Caregivers, Margaret F. Brinig, Steven L. Nock

Journal Articles

Virtually all the legislation dealing with families that include children begins with a "best interests of the child" premise.' Most, if not all, of the litigated results at least seem to maximize the outcomes for adults. This discrepancy should not be surprising, for both substantive and procedural reasons.

The substantive reason, as even the Supreme Court has noted, is that most of the time, what is good for parents will also be good for children. Moreover, having parents who possess many "rights" allow them to better exercise their parental responsibilities. From a procedural perspective, adults are usually the named parties …

Domestic Partnership: Missing The Target?, Margaret F. Brinig Jan 2002

Domestic Partnership: Missing The Target?, Margaret F. Brinig

Journal Articles

Chapter 6, Domestic Partnerships, like many other parts' of the ALI Principles of the Law of Family Dissolution, functions as a set of default rules. Under the ALI Principles for domestic partnerships, therefore, if the parties meet state presumptive requirements for domestic partnerships and have not otherwise contracted, the rules of Chapter 6 apply. Usually, law sets default provisions to 1) what most parties would want; or 2) to what will promote efficiency. I will discuss these two concepts in turn, illustrating how the ALI domestic partnerships provisions satisfy neither ex ante hypothetical bargaining nor efficiency criteria, and thus that …

An Unconstitutional Stereotype: Catholic Schools As Pervasively Sectarian, Gerard V. Bradley Jan 2002

An Unconstitutional Stereotype: Catholic Schools As Pervasively Sectarian, Gerard V. Bradley

Journal Articles

The Supreme Court first held public assistance to religious schools unconstitutional in 1971 in Lemon v. Kurtzman. From then until now the concept of “pervasively sectarian” has played a central role in “parochaid” jurisprudence; every holding against “direct” aid has rested upon it as a necessary premise. “Pervasively sectarian” refers to the assertedly religious (“sectarian”) character of the entire curriculum at parochial schools. Religion, it is said, so permeates the whole educational program that “direct aid” to any aspect of that program inescapably aids religion itself. And that, it is said, violates the Establishment Clause. Because aid statutes typically aim …

Attitudes Toward Spanish Language Maintenance Or Shift (Lmls) In The Lower Rio Grande Valley Of South Texas, Hugo A. Macias, Pamela L. Anderson, Ralph Carlson

Writing and Language Studies Faculty Publications

This article considers attitudes among Spanish/English bilinguals of the Lower Rio Grande Valley of Texas toward Spanish language maintenance or language shift to English. The investigation was undertaken to replicate and compare results with similar data collected in 1982. Since the area has changed socially in the intervening years and is now the third-fastest-growing metropolitan-suburban area in the United States. it seems prudent to reconsider the sociolinguistic attitude changes that may also have occurred. Data collection. sampling. the indices. and the analysis of the 1982 study were replicated as nearly as possible for the present study. Results of the analysis …

Electronic Real Estate Records: A Model For Action, Arthur R. Gaudio Jan 2002

Electronic Real Estate Records: A Model For Action, Arthur R. Gaudio

Faculty Scholarship

The legal, technological, and structural components are in place to allow the legal community to embark on the process of creating a uniform real property recording act. Certain jurisdictions have started the process by adopting various provisions allowing counties to implement electronic recording systems. These provisions are, however, disparate and inconsistent. Given the inconsistencies in the manner in which the electronic recording systems are developing, national commercial and lending practices would have a difficult time attempting to comply with all the possible permutations. In the near future, Fannie Mae, the Property Records Industry Association, and the Mortgage Industry Standards Maintenance …

Veteran Teacher Perceptions Of The Grossmont Model Of Peer Assistance And Review. Is It A Viable Alternative To Traditional Evaluation?, Edwin L. Basilio Edd Jan 2002

Veteran Teacher Perceptions Of The Grossmont Model Of Peer Assistance And Review. Is It A Viable Alternative To Traditional Evaluation?, Edwin L. Basilio Edd

Dissertations

This study looked at factors that influenced veteran teacher perceptions of the newly implemented Peer Assistance and Review (PAR) program in the Grossmont Union High School District. More specifically, the study explored (1) reasons why teachers with at least five years of successful teaching experience voluntarily chose to forfeit their regularly scheduled traditional evaluation and substitute it with a peer review, (2) factors that contributed to positive perceptions of the PAR program, (3) factors that contributed to negative perceptions of the PAR program, and (4) perceived differences between the traditional and PAR methods of teacher evaluation. This study incorporated multiple …

Heritage College: Partnership Leadership As Catalyst To A Multicultural Learning Community, Mary Ann Joan Elizabeth Kaczmarski Edd

Dissertations

Heritage College, a four-year, fully accredited, independent, nonprofit college located in rural, south central Washington, serves multicultural populations that have been educationally isolated. It was created against tremendous odds in 1981 by a small, diverse group of committed individuals. An initial study of Heritage College, conducted in 1991, yielded such compelling findings in the areas of leadership, mission, and community, among others, that a more rigorous, in-depth research study was called for. This dissertation is the follow-up study. The president of Heritage College states that the College sees itself as a leadership- and team-oriented institution with a distinctive focus on …

Conflict Of Interest And Competency Issues In Law Clinic Practice, Peter A. Joy, Robert R. Kuehn Jan 2002

Conflict Of Interest And Competency Issues In Law Clinic Practice, Peter A. Joy, Robert R. Kuehn

Scholarship@WashULaw

Although clinical legal education is an established part of American legal education, few commentators have considered how the ethical issues governing lawyers' conflicts of interest and competency apply in the law school clinic context. This article fills that gap by identifying and explaining the ethical obligations law clinic students and supervising clinical faculty encounter in case and client selection due to conflict of interest and competency considerations. It analyzes various conflicts of interest due to prior, current, or future employment of law clinic students and faculty, and it explores conflicts based on the status of clinical faculty as employees of …

Gender Contests, Susan Frelich Appleton Jan 2002

Gender Contests, Susan Frelich Appleton

Scholarship@WashULaw

This contribution for the “Law, Ethics, and Gender in Medicine” column in the Journal of Gender Specific Medicine interrogates the understanding of gender itself, at a time when transgender and intersex issues were just beginning to “come out” in both popular culture and case law. Against this background, the column explores the roles that physicians have played in such gender contests and considers how evolving medical attitudes can help achieve reform.

Ethics In Journalism And Cheryl Kernot: A Colloquium, Rhonda Breit, John Harrison, Martin Hirst, Trina Mclellan, Desley Bartlett

Graduate School of Media and Communications

Ethics asks the 'ought' question. Ought Laurie Oakes have disclosed Cheryl Kernot's affair with Gareth Evans? Ought the affair be taken into account in any assessment of Kernot's motives for defecting to the ALP? Ought Kernot have disclosed the affair to ALP leaders before her defection? Ought Kernot have omitted the affair from her memoir? Ought politicians' private lives be paraded in public? Ought journalists re-consider their treatment of high-profile women in public life? All these issues and more are discussed in the colloquium below.

The Effects Of Cross-Level Conflict: The Moderating Effects Of Conflict Culture On The Group Faultlines - Performance Link, Katerina Bezrukova, Karen A. Jehn Jan 2002

The Effects Of Cross-Level Conflict: The Moderating Effects Of Conflict Culture On The Group Faultlines - Performance Link, Katerina Bezrukova, Karen A. Jehn

Psychology

We examine how task, relationship, and process conflicts arise from group faultlines. We define group faultlines as hypothetical dividing lines that split a group into subgroups based on the group members' attributes (adapted from Lau & Murnighan, 1998). We further link group conflict to performance, and predict different effects for individual performance, group performance, and employee satisfaction. We also examine the moderating effect of the organizational conflict culture on the relationship between group faultlines and group conflict. We define conflict culture as employees' beliefs about the amount and intensity of a certain type of conflict (i.e. task conflict, relationship conflict, …
