Why The Injection Of Race In Saldano V. State Constitutes Fundamental Error, Diana L. Hoermann

The Scholar: St. Mary's Law Review on Race and Social Justice

This article examines the historical use of a person’s race in the legal system, more specifically in criminal cases. Race should not determine the quality of justice an individual receives. An enlightened criminal justice system would not allow race to determine a person’s fate. However, the Texas criminal justice system allows the consideration of a person’s race in determining whether that person should receive the death penalty. In Victor Hugo Saldano v. The State of Texas, an unpublished opinion, the Texas Criminal Court of Appeals upheld the imposition of the death penalty where the jury heard an expert witness claim …

In 1990, the United States Congress passed the Hate Crime Statistics Act (HCSA) which set into motion the development of a law-enforcement based data collection system aimed at learning more about “hate crimes.” By 1999 the term “hate crime” had become so widely used and recognizable that when news broke of the murders of Matthew Shephard, a University of Wyoming student who was brutally murdered because he was gay, and James L. Byrd, a disabled black man who was savagely murdered because of his race, the media understandably labeled these acts as “hate crimes.” In this paper the authors will …

Narrating Machines: Figurations Of Technology In "1 Henry Vi", "Robinson Crusoe", And "The Matrix"., Robert Patton Fanning

This essay attempts to demonstrate a tradition of the narrative use of technological tropes in Anglo-American popular narratives since the Renaissance. A play by William Shakespeare, a narrative by Daniel Defoe, and a recent movie are analyzed and compared to show the varying ways that technology has consistently figured in narrative attempts to address the contemporary social concerns narratively.

A broad literature has presented that there is a direct connection between parent participation in a child’s education and learning. However, very little literature exists on high school Professional Development School (PDS) students and their parent’s participation in their learning. This thesis focused on student and parent perceptions of student learning, respect and success, as well as, how parents were involved in their child’s education. This study surveyed 9th - 11th grade students and their parents at Grafton High School (GHS), a PDS, located in Grafton, West Virginia, during the spring of 1997. I'Ll Take My Land: Contemporary Southern Agrarians, Suzanne W. Jones

For many earlier southern white writers, the southern rural landscape was the repository of nostalgia for lost ways of life, whether it was the plantation fantasy that Thomas Nelson Page pined for in his stories In Ole Virginia (1887) or the segregated agrarian ideal that many contributors yearned for in I'll Take My Stand (1930). For modern southern white writers, beginning most prominently with William Faulkner, the rural landscape has conjured up unsettling guile about a way of life that flourished on the backs of the black people who tilled that land. Holism, Hermeneutics, And Heterophenomenology: A Critique Of Daniel Dennett's Intentional Stance, George Fletcher

All Volumes (2001-2008)

Heterophenomenology downplays the reality of the internal experiential aspects of consciousness in deference to an intentional, language-based model of consciousness that places emphasis on the neutral acceptance of the speech reports of subjects as the basis for understanding consciousness – thus placing the foundations of consciousness in a physical, monistic (physical sans soul), computational device (the brain). I shall argue that this methodology can be seen as a form of empathic extrapolation of self-understanding onto the other in dialogue, akin to the work of early hermeneutics. 11 This methodology is closely tied in with a contemporary connectionist conception of computability …

Human trafficking has become a fast-growing global criminal activity, affecting just about every country in the world. Each year, at least four million people are trafficked worldwide, with an annual profit of up to seven billion dollars for the trafficking network. Trafficking victims often believe they are accepting jobs in different sectors, but are often taken across borders, sometimes through coercive 31 methods, where they can often end up in exploitative situations.
