Traditionally, authors' copyright rights have been limited in order to promote the progress of science and the useful arts. However, authors today are increasingly employing additional protective measures that arguably are not subject to such limitations. Even if such extra-copyright measures are not limited like copyright protections, several principles underlying the copyright regime support imposing such limits on authors' rights. In this Article, based upon John Rawls's theory of justice as fairness, I develop a theory of justice between generations of authors. But Some Are More Equal: Race, Exclusion, And Campaign Finance, Spencer A. Overton

Proposed campaign finance reforms and critiques of current campaign finance jurisprudence are incomplete because campaign finance reformers overlook social and historical realities related to race. This Article uses race as an analytical factor to develop a more comprehensive understanding of campaign finance. Past state-sanctioned discrimination has contributed to current racial disparities in property. Under the current campaign finance system, these disparities in property shape the racial distribution of political influence no less than poll taxes, literacy tests, or at-large electoral districts. Further, seemingly neutral campaign finance doctrine threatens to lead to future racial disparities in the political distribution of societal …

As testing for late-onset genetic conditions becomes increasingly available, concerns have been raised about the psychosocial costs of obtaining such genetic information. Anxiety and distress can result from testing that offers only probabilistic results as to whether and when the condition will develop, especially when treatment is limited or unavailable. Many have therefore urged caution regarding late-onset testing, suggesting that knowledge can sometimes be toxic. Sites Of Redemption: A Wide-Angle Look At Government Vouchers And Sectarian Service Providers, Ira C. Lupu, Robert W. Tuttle

The constitutional issues presented by the use at religious institutions of government-financed vouchers for social services have been addressed repeatedly, but virtually all of the writing in the field focuses exclusively on educational services. Most of that writing, moreover, takes the overly simple view that voucher programs are linear relationships running from government to recipient to service provider. Proponents of such programs argue that the presence of recipients as intermediate decision-makers breaks the link between the state and religion, and therefore solves the constitutional problem of church-state connection. Opponents argue that use of intermediaries is nothing more than "money-laundering," and …

Federating repositories by harvesting heterogeneous collections with varying degrees of metadata richness poses a number of challenging issues: (1) how to address the lack of uniform control for various metadata fields in terms of building a rich unified search interface, and (2) how easily new collections and freshly harvested data in existing repositories can be incorporated into the federation supporting a unified interface? This paper focuses on the approaches taken to address these issues in Arc, an Open Archives Initiative compliant federated digital library. At present Arc contains over 1M metadata records from 75 data providers from various subject domains. …

Much of the literature on EFL education in Japan describes a system that is fraught with problems. Over the last decade the Japanese Education Ministry (Monbusho) has introduced a number of reforms and introduced some new EFL courses into Japanese schools. The stated aim of the new courses has been to focus on the development of students' communicative abilities in English. However, the effectiveness of these reforms has been questioned particularly at the senior high school level. Srebp-1 Integrates The Actions Of Thyroid Hormone, Insulin, Camp, And Medium-Chain Fatty Acids On Accalpha Transcription In Hepatocytes, Yanqiao Zhang, Liya Yin, F Bradley Hillgartner

In chick embryo hepatocytes, activation of acetyl-CoA carboxylase-α (ACCα) transcription by 3,5,3′-triiodothyronine (T3) is mediated by a cis-acting regulatory unit (−101 to −71 bp) that binds the nuclear T3 receptor (TR) and sterol regulatory element-binding protein-1 (SREBP-1). SREBP-1 directly interacts with TR on the ACCα gene to enhance T3-induced transcription. Here, we show that treating hepatocytes with T3 or insulin stimulates a 4-fold increase in the concentration of the mature, active form of SREBP-1. When T3 and insulin are added together, a 7-fold increase in the mature SREBP-1 concentration is observed. Time course studies indicate that the T3-induced increase in …

Comparing Communication Technology On Chinese, English, And Spanish Diabetes Web Sites, Yanko F Michea, Karen Pancheri, Yang Gong, Elmer Bernstam

Technological and cultural factors influence access to health information on the web in multifarious ways. We evaluated structural differences and availability of communication services on the web in three diverse language and cultural groups: Chinese, English, and Spanish. A total of 382 web sites were analyzed: 144 were English language sites (38%), 129 were Chinese language sites (34%), and 108 were Spanish language sites (28%). We did not find technical differences in the number of outgoing links per domain or the total availability of communication services between the three groups. The problem

Greenberg has recently stated that isolating temporal ceramic indicators for the Early Bronze II-III periods is "one of the thorniest issues in the archaeology of Palestine" (2000: 183). Part of theproblem stems from the homogenous nature of ceramic assemblages from Early Bronze Age Palestine; part of it stems from a continued lack of published information. Both of these issues are addressed by this study. Excavations at Tell Ta`annek between 1963 and 1967 unearthed the remains of a multi-period site, including the residues of an Early Bronze II-III fortified settlement. The meaning and referent of “seed” and its related pronouns in Gen 3:15 have been discussed throughout the history of Jewish and Christian interpretation. This dissertation analyzes Gen 3:15 exegetically, intratextually, and intertextually, tracing the meaning of this “seed” in Genesis, the rest of the Old Testament, and the New Testament.
