Protecting Plaintiffs' Sexual Pasts: Coping With Preconceptions Through Discretion, Jane H. Aiken

Part I of this Article traces the development of the civil application of Rule 412, the so-called “Rape Shield Rule”. Part II analyzes the inconsistencies within the cases decided under the new civil rule and links those inconsistencies to the language of the rule. It identifies the trends within the cases about what constitutes probative value for purposes of the rule and how courts assess prejudice. The Article concludes that rules of evidence designed to remedy bias of fact finders should not be cast as discretionary. Many of the problems that arise in the interpretation of Rule 412 could be …

Evidence suggests that the feminist consensus on Jean-Jacques Rousseau “misogyny” is breaking down.New studies are emerging that bring to light the many sympathetic portrayals of women in Rousseau’s works and the important role he ascribed to women within the family. Some modern feminists are even finding ways of reading Rousseau that speak to women’s concerns today. Overturning the notion that Rousseau was an arch-misogynist will be an uphill battle, however, given how very widespread it has become. Moreover, before we can arrive at a coherent and convincing appraisal of Rousseau’s views on women, a curious paradox needs to be addressed: …

Controlling Toxic Harms: The Struggle Over Dioxin Contamination In The Pulp And Paper Industry, William Boyd

This essay addresses the challenges of controlling toxic harms through an intensive case study of efforts to regulate and remedy dioxin contamination in the U.S. pulp and paper industry. By focusing on the struggle to control a specific toxic harm in a specific industrial sector, the essay explores the politicized nature of toxic harms in the United States and, in the process, highlights the considerable shortcomings of existing legal frameworks and institutions for dealing with problems of such scope and complexity. Before the ethical dreams and political ambitions of law can even be articulated, let alone realized, the aesthetics of law have already shaped the medium within which those projects will have to do their work. This work attempts to retrieve and expose those recurrent forms that shape the creation, apprehension, and identity of law. What is at stake is an attempt to reveal the aesthetics within which American law is cast. The point is not simply to appreciate these aesthetics, but to understand how "substantive" conflicts in law are often motivated, sustained and circumscribed by the aesthetics through which they …

As scholars of world religions search for promising ways of responding to the ecological crisis, the Christian tradition can look for inspiration to Descriptio Positionis Seu Situationis Monasterii Claraevallensis, a twelfth-century description of the site and surroundings of Clairvaux abbey. The text exudes the unnamed author's deep appreciation and gratitude for the cooperative interactivity of human beings, other species, the land, water, and air that assured their mutual sustainability and maintained the site's integrity. This view predates by centuries the efforts of contemporary philosophers to reflect on the human relation to other biota and abiota that constitute ecological systems, to …

Given the significant controversy regarding parapsychology and the study of psi phenomena, there appear to be opportunities to improve design in parapsychological experimentation through the use of more sensitive and reliable means of measurement. The current study was an attempt to introduce a design that employs time as an outcome measurement, the use of groups and individuals as opposed to just individuals, and the use of more specific and focused content through the use of problem-solving tasks, in an attempt to create a sensitive and replicable experiment in telepathy. Estrogen (E2) plasma levels fluctuate as a function of estrous cycling in the mouse. Apolipoprotein E (apoE) mRNA has been shown to increase in both hippocampal astrocytes and microglia during proestrus when plasma estrogen levels are high. The current study was designed to evaluate apoE localization and glial activation in mouse olfactory bulb (OB) as a function of the estrous cycle. In the rat OB, estrogen receptor β (ERβ) is present in the glomerular and external plexiform layers, but not the internal plexiform and granule cell layers. The accepted methods of age determination in the coyote (Canis latrans) are either highly subjective and unquantifiable or expensive and require the extraction of the canine tooth. Since neither of these methods are ideal, their limitations have impeded research on this species. Therefore, it was my objective to (1) develop and test the accuracy and precision of a descriptive key based on tooth wear patterns on the lower canine tooth, (2) develop and test the reliability of multiple regression models for aging coyotes using measurements from extracted teeth, and (3) suggest criteria for improving the consistency of results …

The sand prairie is a unique ecosystem in the state of Illinois, being the habitat for many interesting plants and animals not found elsewhere in the state. One such plant is the state-endangered Stylisma pickeringii (Torr. ex M.A. Curtis) Gray var. pattersoni (Fern. & Schub.) Myint (Convolvulaceae), also known as Patterson's bindweed or Patterson's dawn flower. It currently is found in only three Illinois counties—Cass, Henderson, and Mason. Presently, two of the three populations of S. pickeringii are located on private lands. Very little information is known about the reproductive biology of S. pickeringii var. pattersoni. Nguyen Du's Truyen Kieu or Tale of Kieu has arguably provided a life model for Vietnamese females. The poem's influence extends in important ways to contemporary Vietnamese writers as well, including those as politically and artistically diverse as Duong Thu Huong and Le Ly Hayslip. In Novel Without a Name, Paradise of the Blind and Memories of a Pure Spring, Duong Thu Huong transforms the terms of Nguyen Du's poem to those of Vietnam during its revolutionary period and today. "More than we recognize, our inner life is shaped by the traditions of the group to which we happen to belong; and until we escape from such prison, at least through imagination, or better far through personal contacts, our culture is bound to remain tragically cramped and incomplete" (On Journey 67-68). Reports of pulmonary physiopathological insults following severe trauma resulting in respiratory failure are not new in medical literature1,2. In 1967 Ashbaugh and colleagues described a syndrome of acute respiratory distress following a variety of precipitating conditions3. Severe hypoxemia, diffuse pulmonary infiltrates, poor lung compliance and absence of left heart failure characterize this condition. Ashbaugh et al4 subsequently named it as adult respiratory distress syndrome to differentiate it from infant respiratory distress syndrome. An automated robotic inspection system for electronic manufacturing has been developed to identify pin defects of IC packages mounted on printed circuit boards using surface mount technology. The automated robotic inspection system consists of two robots, a computer, a CCD camera with frame gabber for image acquisition, and a customized windows program using neural network for on-line defect identification. Gray scale images of the pins on IC packages are acquired using ambient light. The images are filtered and formatted to appropriate size, so that Matlab neural network tool could be used. Preliminary Results From A Survey On The Prevalence Of Parasitic Helminths And Protozoa In Raccoons, Opossums, And Skunks, Michelle Belviy, T. A. Yazwinski, C. A. Tucker, Jennifer Robins
Discovery, The Student Journal of Dale Bumpers College of Agricultural, Food and Life Sciences
Raccoons, skunks, and opossums (N=57, 60, and 60, respectively) were necropsied for parasite detection and identification from September, 2001 until April, 2002. Qualitative coprological exams and adult Baylisascaris collections have been completed. Fecal stages and/or types found were Baylisascaris and Strongyloides-type (skunks and raccoons); Capillaria and Trichostrongyletype (raccoons and opossums); Acanthacephalan and ascarid type (opossums only); free larvae (skunks only); and coccidial (protozoan) oocysts (all three host species). Adult Baylisascaris were recovered from 33.3% of the raccoons and 58.3% of the skunks. Data collection relative to this survey, which is still ongoing, includes the determination of Sarcocystis prevalence in excised …
