The Indonesian government's land laws and policies lead to displacement of and hardship for the indigenous peoples of the archipelago. The Basic Agrarian Law, Basic Forestry Law, and Spatial Planning Law all allow for expropriation of indigenous lands formerly governed under the adat legal system. In addition, the central government's policy of transmigration—the shifting of people from the populous Inner Islands of Java, Bali, and Madura to the Outer Islands—only increases the economic and cultural pressure on indigenous peoples of the Outer Islands. Judicial Activism At The World Trade Organizational: Development Principles Of Self-Restraint, J. Patrick Kelly

In a number of recent decisions the AB has begun to grapple in a non-systematic way with both the incorporation and creative interpretation issues.14 These decisions raise serious concerns that the AB is exceeding its authority under the DSU and inappropriately incorporating non-WTO law or interpreting WTO agreements in a manner that diminishes the rights of members. This article explores both the incorporation and creative interpretation questions by assessing the relative merits of three different models of how social regulatory policy might be integrated into WTO decision-making: the Judicial Activist Model, the Contract Model, and the Legislative Model.

International legal research regarding international economic dispute settlement tends to be a-theoretical. A theoretically-grounded analytic framework is employed in this article which draws from scholarship from political science, sociology, and economics regarding institutions and international governmental organizations. The knowledge-legitimacy-efficiency analytic framework is applied in this article to studies of General Agreement on Tariffs and Trade (GA TT)/World Trade Organization (WTO) dispute settlement in order to relate this relevant scholarship to the economic field under primary study, Internet domain names. GA TT/WTO knowledge regarding international trade law has thickened through multi-lateral trade negotiations and dispute settlement decisions. The WTO's legitimacy is …

Part of any Muslim's effort to return to their religious past usually involves an invocation of Islamic law, or what has been termed the Shari'ah. This Note intends to cursorily examine Islamic law-where it was, and where it is going. More specifically, this Note will examine a growing fracture within the Islamic community and how a fissure among so-called fundamentalists will ultimately influence an understanding of Islamic law.

Gaba B Receptors In The Ventral Tegmental Area Regulate Morphine-Induced Motor Sensitization And Accumbal Fos Expression In C57bl/6 Mice, Kimberly Anne Leite-Morris

Mesolimbic dopamine (A10) neurons have a central role in mediating opiate-induced motor sensitization and are implicated in drug addiction. This dissertation examines the hypotheses that GABAB receptors are located in the ventral tegmental area (VTA), that morphine sensitization occurs via A10 neuronal activation, and that GABAB receptor activation in the VTA inhibits the development and expression of morphine-induced sensitization. Dopaminergic neurons projecting from the VTA to the nucleus accumbens (NAc) of the forebrain are involved in mediating behavioral sensitization to morphine. GABA B receptor activation in the VTA leads to inhibition of dopaminergic transmission and inhibition of opiate actions. Sensitization …

A significant theoretical shift in the research community examining a class of terminal, infectious neurological disorders that includes Mad Cow Disease, Creutzfeldt-Jakob disease, and Kuru was assisted by rhetorical production. The local rhetoric of one laboratory, that of Professor Stanley B. Prusiner, involved first situating an heretical hypothesis within the framework of the orthodox narrative and then audaciously promoting that heresy. Another aspect of rhetorical production in this case involved situating a new language associated with the heretical hypothesis. To promote their new lexicon, the Prusiner team evoked orthodox values of consistency, efficiency, and collective ratification. Eventually, what was once …

This is a transcript of a two hour symposium which deals with the Sulzer knee and hip replacement class action. A copy of the settlement is included as an appendix. The settlement in the U.S. District Court for the N.D. Ohio was unique and creative approach to resolving a mass tort class action. In a novel move, Sulzer agreed to open its books to an independent review firm to determine how much the firm could pay without going bankrupt. The number was $1 billion. As negotiated by the parties and approved by the court, the final settlement provides compensation for …

A method of enhancing the tenderness of meat for animal or human consumption by treatment of pre-rigor muscle with the compositions of the invention. It has been found that other quality meat traits can also be enhanced with the method of the invention.
