I probably benefited from my study of the issue more than any of you, but that is what I love about education-there is so much to learn. In "The Y Factor," I usually focus on the noun in the title of this journal, addressing issues of librarianship. Today, I want to concentrate on the adjective -- "Christian".

One evening I was trying to come up with an idea of how to proceed. Suddenly there flashed into my mind a plan that I quickly wrote down. The coincidence of the new millennium and the fifteenth anniversary of the Delaware Supreme Court's announcement of a new approach to takeover law provides an occasion to evaluate a remarkable experiment in corporate law – the Delaware Supreme Court's development of an intermediate standard of review for appraising defensive tactics. This assessment reveals that Unocal has developed into an unexplained and likely inexplicable preference that control contests be resolved through elections rather than through market transactions. In doing so, the remarkable struggle between the chancery court and the supreme court for Unocal's soul is canvassed. The author also maintains that …

This Paper analyses how the network of enforcers envisaged in the Proposal for a Council Regulation on the implementation of the rules on competition laid down in Articles 81 and 82 of the EC Treaty (September 2000) would operate. We identify four issues. First, we observe that the Proposal (unlike the White Paper) includes safeguards to avoid a shift of competence in favour of national competition laws, which may be questionable in terms of subsidiarity. Second, we recognise that the accountability of antitrust authorities might vary across the members of the network, so that, for instance, some authorities may be …

Crosby And The "One-Voice" Myth In U.S. Foreign Relations, Sarah H. Cleveland

In Crosby v. National Foreign Trade Council, the Supreme Court invalidated a Massachusetts government procurement statute that barred state entities from doing business with companies that did business in Burma. The plaintiffs, an organization of private companies with foreign operations, challenged the law on constitutional and statutory preemption grounds, arguing that it improperly conflicted with federal foreign relations authority. The Supreme Court limited its holding to implied statutory preemption, finding that the Massachusetts provision improperly compromised the President's ability "to speak for the Nation with one voice." Tidal And Subtidal Lateral Structures Of Density And Velocity In The Chesapeake Bay Entrance, Austreberto Cristobal Reyes-Hernandez

Hydrographic and velocity data collected along the Chesapeake Bay Entrance during seven 25-hours cruises centered around neap or spring tides, were used to assess the fortnightly variability in the transverse structure of the tidal and subtidal density and velocity fields. Amplitude and phase of the semidiurnal and diurnal harmonics reflected the influence of bathymetry, buoyancy conditions and fortnightly variability. Tidal amplitudes were almost twice as large in springs than in neaps. Both Chesapeake and North Channels had similar along-channel amplitudes, which suggested a higher vertically integrated mixing energy in North Channel. Tidal velocity convergences were more intense for springs than …

Industrialization was pressing westward from the eastern United States by the mid-nineteenth century. To provide housing for workers in remote areas, many western industrialists built company-owned towns. This paper reviews company towns in eleven western states in order to proceed with further research. Brookings, Oregon, a lumber manufacturing company town, located on the Southern Oregon coast, was chosen for an in-depth analysis.

In comparing land use and design changes, as built and as they are today, it was found that the initial town design could still be discerned but that many changes had been made without regard to the original …

This lecture examines the role of borders in the Berne Convention at the time of the treaty's first passage in 1886, and today. The later 19th century was an era of increasing commerce and communication among countries whose domestic production and reproduction of works of authorship had vastly increased, thanks in part to new technologies, such as photography, lithography, and high-speed printing. But at that time, the frontiers between nations often frustrated authors' hopes for control over, or at least compensation for, the international exploitation of their works. Coastal ocean morphodynamics is the study of the morphological change of the coastal ocean system. Environmental conditions, such as climatic and geological controls, are exogenous inputs of the system, which are responsible for geographic variation among coastal oceans. In the coastal ocean system, coastal morphological changes are the results of a series of morphodynamical processes. In this treatise, quantitative, dynamical sedimentary models are developed to provide an analytical understanding of morphodynamical processes in coastal ocean environments. A dispute resolution panel of the World Trade Organization in June 2000 held the United States in contravention of its obligation under art. 13 of the TRIPs accord to "confine limitations or exceptions to exclusive rights to certain special cases which do not conflict with a normal exploitation of the work and do not unreasonably prejudice the legitimate interests of the right holder." In the dispute resolution proceeding, initiated by the European Union at the behest of the Irish performing rights organization, the contested exception, enacted in the 1998 "Digital Millennium Copyright Act," exempted a broad range of retail and …

Flow Through Well Screens As A Function Of Pump Intake Location, Kristjan F. Bekker

Greater well efficiency and lower production costs may result from a knowledge of water flow through well screens. Current practice generally locates the intake of a pump in the cased section of the well above the screen. This work shows that placing the pump within the screen will increase well efficiency and therefore lower energy cost. This work also shows a correlation of increased well efficiency with respect to larger sand size, larger screen slot size, and lower flow rates.

Laboratory Denitrification Using Sediments From The Elk Valley Aquifer, Alison E. Kammer

An experiment was conducted to determine if a decrease in the content of sulfides related to denitrification could be measured in the laboratory using sediments of the Elk Valley Aquifer in eastern North Dakota. The experiment entailed analyzing sediments for sulfides and solid organic carbon and isolating them in sample containers with a nitrate solution to determine if a measurable decrease in these components could be observed.

Previous denitrification studies in the Elk Valley Aquifer showed an increase in sulfate in conjunction with a decrease in the concentration of nitrate. Sulfate is a by product of autotrophic denitrification where sulfide …

Devils Lake is the largest lake in a chain of approximately 20 interconnected lakes in east central North Dakota. The Devils Lake drainage basin of approximately 8,600 km2, lies in a bowl sculpted by glaciation; thus it is closed and receives and loses water only through precipitation and evapotranspiration. Since 1940, the lake level has risen 14.4 m due to increased precipitation. Geological data show that in the past 10,000 years the lake has alternately dried up and filled due to climate fluctuations (Murphy et al., 1997). In order to respond to the needs of a rapidly changing health care environment, nursing educators must redefine the competencies needed by the beginning registered nurse. The study was designed to assess nursing faculty members' perceptions of competencies used by the beginning registered nurse in practice and their perceptions of the degree to which those same nursing competencies were presented in the nursing curriculum. Faculty members' perceptions were compared also to the results of a previous study which included a survey of beginning nurses to identify their perceptions of such competencies.

The western Cold Turkey Creek structural anomaly is a subsurface structure in Bowman County, North Dakota, near the southern margin of the Williston Basin. The stucture was identified by oil explorationists as a possible impact crater, but its origin remained uncertain. The purpose of this study is to attempt to ascertain if sufficient evidence exists to determine that the anomaly is of impact origin.

The study area was confined to a nine township area surrounding the anomalous stucture in Bowman County, North Dakota. One hundred six oil exploration wells were identified in the area, and well logs were examined and …

A substantial volume of research (e.g., Charrow & Charrow, 1979; Elwork, Sales & Alfini, 1977, 1982) suggests that jurors do not understand the often-convoluted language of standard jury instructions. Some states have recently simplified their instructions, but others continue to debate whether change is beneficial. This study was designed to investigate whether "plain language" jury instructions lead to improved comprehension. College students listened to either new, plain language Minnesota jury instructions or older Minnesota jury instructions addressing the same topics. Participants then took a written comprehension test covering legal rules contained in the instructions. Participants also completed a Nelson-Denny vocabulary …

Processing Algorithms For Tracking Speckle Shifts In Optical Elastography Of Biological Tissues, Donald D. Duncan, Sean J. Kirkpatrick

Parametric and nonparametric data processing schemes for analyzing translating laser speckle data used to investigate the mechanical behavior of biological tissues are examined. Crosscorrelation, minimum mean square estimator, maximum likelihood, and maximum entropy approaches are discussed and compared on speckle data derived from cortical bone samples undergoing dynamic loading. While it was not the purpose of this paper to demonstrate that one processing technique is superior to another, maximum likelihood and maximum entropy approaches are shown to be particularly useful when the observed speckle motion is small.
