Preliminary Evaluation Of A Guideline Classification System, Elmer Bernstam, Nachman Ash, Mor Peleg, Samson Tu, Edward H. Shortliffe, Robert A. Greenes Jan 2001

Preliminary Evaluation Of A Guideline Classification System, Elmer Bernstam, Nachman Ash, Mor Peleg, Samson Tu, Edward H. Shortliffe, Robert A. Greenes

Faculty, Staff and Student Publications

In a previous paper, we presented a proposed expansion of the National Guideline Clearing-house (NGC) classification1. We performed a preliminary evaluation of the classification based on 100 guidelines randomly selected from the NGC collection. We found that 89 of the 100 guidelines could be assigned to a single guideline category. To test inter-observer agreement, twenty guidelines were also categorized by a second investigator. Agreement was found to be 40-90% depending on the axis, which compares favorably with agreement among MeSH indexers (30-60%)2. We conclude that categorization is feasible. Further research is needed to clarify axes with poor inter-observer agreement.

Care As A Public Value: Linking Responsibility, Resources, And Republicanism, Linda C. Mcclain Jan 2001

Care As A Public Value: Linking Responsibility, Resources, And Republicanism, Linda C. Mcclain

Faculty Scholarship

I begin this Article with the preceding two statements concerning care for children because they focus on the relationship between resources and responsibility and capture two conflicting approaches to that relationship. The first statement resists a definition of "responsibility" that leaves out the work of social reproduction, that is, of caring for children and preparing them to take their place as responsible, self-governing members of society. Highlighting the lack of resources that poor parents face when tackling the work of social reproduction, the statement also suggests common ground among parents across class lines as to the importance of caring for …

Client Weight As A Barrier To Non-Biased Clinical Judgment, Tricia Duncan Hassel, Carol J. Amici, Nancy S. Thurston, Richard L. Gorsuch Jan 2001

Client Weight As A Barrier To Non-Biased Clinical Judgment, Tricia Duncan Hassel, Carol J. Amici, Nancy S. Thurston, Richard L. Gorsuch

Faculty Publications - Doctor of Psychology (PsyD) Program

A sample of 95 Christian and 68 Non-Christian mental health professionals were given a picture of either an overweight or average-weight male or female client and a generic case vignette. Participants were asked to make clinical judgments of pathology and client attributions for the pictured client. Results indicated that mental health professionals ascribe more pathology and negative attributes to obese clients than to average-weight clients. In addition, Christian mental health professionals are just as likely as non-Christians to ascribe more negative attributes to obese clients. Ways to remove barriers to unbiased psychotherapy and deal with countertransference issues are discussed from …

Miranda And Some Puzzles Of 'Prophylactic' Rules, Evan H. Caminker Jan 2001

Miranda And Some Puzzles Of 'Prophylactic' Rules, Evan H. Caminker

Articles

Constitutional law scholars have long observed that many doctrinal rules established by courts to protect constitutional rights seem to "overprotect" those rights, in the sense that they give greater protection to individuals than those rights, as abstractly understood, seem to require.' Such doctrinal rules are typically called "prophylactic" rules.2 Perhaps the most famous, or infamous, example of such a rule is Miranda v. Arizona,' in which the Supreme Court implemented the Fifth Amendment's privilege against self-incrimination4 with a detailed set of directions for law enforcement officers conducting custodial interrogations, colloquially called the Miranda warnings. 5

Initiative Process In Washington, Philip A. Talmadge Jan 2001

Initiative Process In Washington, Philip A. Talmadge

Seattle University Law Review

This is an introduction to the Seattle University Law Review's Symposium on the initiative process in Washington. In this Symposium, the authors address a variety of issues associated with the initiative process in our state. They examine the specific case of Initiative 695, the role of the courts in reviewing initiatives, the application of the Republican Government Clause in the United States Constitution to Washington's initiative process, and the larger question of whether the entire initiative process is unconstitutional. These articles are timely analyses of a pressing public issue. This Seattle University Law Review Symposium on initiatives will highlight difficult …

Initiatives—Enemy Of The Republic, Brewster C. Denny Jan 2001

Initiatives—Enemy Of The Republic, Brewster C. Denny

Seattle University Law Review

The Seattle University Law Review's Symposium on the initiative process in Washington State addresses an issue of both transcendent importance to the health of the Republic and immediate challenge to the welfare of the children of this state. This discussion could not be more timely, and not just locally. Here's why. Devolution, tax cuts for the rich and the super rich, welfare reform, and a more conservative, market-oriented philosophy of government lay on the states and low income parents and children the burden of meeting the most critical needs of children-from prenatal care through college. With twenty percent of our …

In Praise Of The Treatise Writer: Law's Special Knowledge, Ellen M. Bublick Jan 2001

In Praise Of The Treatise Writer: Law's Special Knowledge, Ellen M. Bublick

Seattle University Law Review

Dobbs, the author of the foremost treatise on tort law, and Hayden, the author of a number of thought provoking articles, have written a book with a clear structure—one that carefully and methodically elucidates the doctrinal framework of state tort law. The book also addresses problems in tort theory and practice and outlines major supplements and alternatives to existing tort remedies.

Teaching Torts By Integrating Ethical, Skills, Policy And Real-World Issues, And Using Varied Pedagogical Techniques: Reflections On Using The Henderson, Pearson And Siliciano Casebook, Lynn M. Daggett

Seattle University Law Review

In brief, the Henderson, Pearson, and Siliciano casebook includes materials on ethics, problems and other skill-based activities, a diverse set of ideological perspectives presented in a non-preachy way, and addresses numerous real-world issues and concerns. The casebook also lends itself to the variety of teaching and active learning methods I employ in my Torts classes.

Epsteinian Torts: Richard A. Epstein, Cases And Materials On Torts, Allison H. Eid Jan 2001

Epsteinian Torts: Richard A. Epstein, Cases And Materials On Torts, Allison H. Eid

Seattle University Law Review

A fascinating aspect of Epstein's scholarly work is his exploration of the apparent tension between libertarian principles and utilitarian thought—an exploration that comes alive in his casebook. To Epstein, these two competing principles often coalesce to yield a single "correct" answer to a problem. In other words, the answer that arises from a desire to protect a pre-determined set of individual rights-for example, private property rights, or the right of personal autonomy often produces an outcome that is also beneficial to the overall common good. Some scholars have critiqued Epstein's work by suggesting that there is more disharmony than harmony …

Thou Shall Not Strike: Religion-Based Peremptory Challenges Under The Washington State Constitution, Justin Dolan Jan 2001

Thou Shall Not Strike: Religion-Based Peremptory Challenges Under The Washington State Constitution, Justin Dolan

Seattle University Law Review

This Comment will first define the peremptory challenge and discuss its history and normative values. It will then examine the United States Supreme Court's treatment of the peremptory challenge, focusing on how the peremptory challenge has changed from a litigation device that lawyers could exercise without explanation to one that at times requires an explanation for it to survive constitutional challenge. Next, this Comment will discuss state courts' independent interpretation of fundamental rights, Washington courts' decisions in harmony with this principle, and State v. Gunwall, the guide to independent constitutional interpretation in Washington. This Comment will show that under …
