Religion And The First Justice Harlan: A Case Study In Late Nineteenth Century Presbyterian Constitutionalism, James W. Gordon

In this Article, the Author argues that Harlan's religion and its values informed both his personal and his public life. Harlan's close personal friend, Justice Brewer, once commented on Harlan's personal attachment to the two "fundamental" documents in his life: the Bible and the Constitution. Justice Brewer suggested that Harlan had one hand on the Bible, and the other hand on the Constitution when he went to bed every night. Although it is widely known that Harlan was a religious man, only recently has any scholar paid much attention to this fact. No one has fully described the principles of …

The First Circuit reversed the district court's order dismissing Lucas Rosa's claim against Park West Bank. The appeals court's reversal seems to be part of an emerging nationwide rejection of cases from the 1970s and 1980s. In these cases courts summarily dismissed sex discrimination claims brought by transgender plaintiffs, no matter how squarely the facts appeared to present a clear-cut case of discrimination based on sex. This created that appeared to be a "transgender" exception to sex discrimination law. The purposes of this research were to determine: 1.) if sexual harassment policies, content, communication and subsequent related training, or lack thereof, subject South Florida community colleges to legal risk; and 2.) the perceptions of how sexual harassment policies and procedures affect students and faculty, their interactions, and how students learn and how faculty teaches, being mindful of a possible cultural component.

This dissertation, through an historical study, attempts to give the reader a clear depiction of different types of investment strategies. The four diverse investment strategies, as compared to the Optimal Strategy, were tested from December 1, 1997, through January 30, 2001 Three years of daily closing price data was obtained and utilized within a simulated model. Ten stocks, from ten diverse sectors, listed on the S&P 500 as well as the National Association of Investment Clubs (NAIC) 1999 Individual Investor's Top 100 Index, were analyzed and evaluated for each investment strategy over the duration of the study. Little is known about incidence, risk factors, and etiology of acute lower respiratory tract infection (ALRI) and pneumonia among the very young children from the rural communities of the developing countries. This study examined incidence and risk factors for ALRI and etiology and risk factors for pneumonia in a group of infants in Bangladesh. A cohort of 252 newborns was prospectively followed from birth to 24 months of age. Data on respiratory symptoms and feeding habits were collected routinely by household visit. Objectives . This population-based study was conducted to examine the effects of various technologies, that evolved in the late 1980s and early 1990s to improve infant survival, on time to death. The study examined the temporal variations in time to infant death from perinatal related causes, at varying birth weights and for two races, between 1985 and 1995, and considered the implications of the findings for future perinatal policy and interventions. This Article addresses the extent to which officials and citizens should rely directly on their religious convictions to reach political judgments and make political arguments. Reviewing opposing "exclusive" and "inclusive" positions, this Article suggests that officials generally should not articulate arguments in religious terms. Many officials should have a greater freedom to rely on religious bases of judgments, and private citizens should not regard themselves as constrained in the manner of officials. This approach, defended initially from the perspective of detached political philosophy, fits comfortably with a variety of overarching religious views. Enhancing Micro-Organism Images By Estimating Image Background, Delong Liu

One- and two-dimensional techniques are proposed for enhancing micro-organism images using linear least-squares fitting, median filtering combined with bicubic approximation and wavelet filtering, respectively. The quality of enhanced images with pixel dimensions of 1200 x 1600 is examined from their corresponding binary images. It shows that one-dimensional modeling requires much less computation but provides relatively low quality output. On the other hand, the two-dimensional approximations for non-uniform lighting background, using both bicubic spline and wavelet filtering, are more effective and yield very high quality binary images tested with three different grayscale images.

The Power Of Suggestion: Inertia In 401k Participation And Savings Behavior, Brigitte C. Madrian, Dennis F. Shea

In this paper, we analyze the 401(k) savings behavior of employees in a large U.S. corporation before and after an interesting change in the company 401(k) plan. Before the plan change, employees were required to affirmatively elect participation in the 401(k) plan. After the plan change, employees were automatically and immediately enrolled in the 401(k) plan unless they made a negative election to opt out of the plan. Although none of the economic features of the plan changed, this switch to automatic enrollment dramatically changed the savings behavior of employees. We have two key findings. There has been considerable discussion of a variety of issues related to fair value in the actuarial literature, in conferences, and among individuals interested in this topic. Unfortunately, we seem to be failing to communicate due, in part, to inconsistent use of terminology. Good Day Sunshine: Stock Returns And The Weather, David Hirshleifer, Tyler Shumway

Psychological evidence and casual intuition predict that sunny weather is associated with upbeat mood. This paper examines the relationship between morning sunshine in the city of a country's leading stock exchange and daily market index returns across 26 countries from 1982 to 1997. Sunshine is strongly significantly correlated with stock returns. After controlling for sunshine, rain and snow are unrelated to returns. Substantial use of weatherbased strategies was optimal for a trader with very low transactions costs. However, because these strategies involve frequent trades, fairly modest costs eliminate the gains. These findings are difficult to reconcile with fully rational price …

Do Behavioral Biases Affect Prices?, Joshua D. Coval, Tyler Shumway

This paper documents strong evidence of behavioral biases among Chicago Board of Trade proprietary traders and investigates the effect these biases have on prices. Our traders appear highly loss-averse. Traders who experience morning losses are about 16 percent more likely to assume above-average afternoon risk than traders with morning gains. This behavior has important short-term consequences for afternoon prices, as losing traders are prepared to purchase contracts at higher prices and sell contracts at lower prices than those that prevailed previously. However, during the ten minutes that follow these trades, prices revert strongly to their earlier levels. Consistent with these …

A High-Altitude Snow Chemistry Record From Amundsenisen, Dronning Maud Land, Antarctica, Elisabeth Isaksson, Wibjorn Karlen, Paul A. Mayewski, Mark S. Twickler, Sallie I. Whitlow

In this paper a detailed record of major ions from a 20 m deep firn core from Amundsenisen, western Dronning Maud Land, Antarctica, is presented. The core was drilled at 75° S, 2° E (2900 m a.s.l.) during austral summer 1991/92. The following ions were measured at 3 cm resolution: Na+, Mg2+, Ca2+, Cl−, NO3−, S04 2− and CH3SO3H (MSA). The core was dated back to 1865 using a combination of chemical records and volcanic reference horizons. The volcanic eruptions identified in this core are Mount Ngauruhoe, New Zealand (1974–75), Mount Agung, Indonesia (1963), Azul, Argentina (1932), and a broad …

A Preliminary Assessment Of Tidal Flooding Along The New Hampshire Coast: Past, Present And Future, Larry G. Ward, Jamie R. Adams

This report presents the results of a preliminary study that examines several critical coastal issues for New Hampshire including sea level fluctuations (past, present and future), shoreline migrations, and tidal flooding. Included are: 1) an analysis of sea level changes over the Holocene and resulting shoreline migrations, 2) an assessment of low-lying areas with elevations below selected tidal flooding datums in coastal areas, and 3) an assessment of increases in low-lying areas that are potentially at risk to tidal flooding over the next century due to sea level rise.
