Uni-State Lawyers And Multinational Practice: Dealing With International, Transnational, And Foreign Law, Ronald A. Brand

This Article addresses how a lawyer may ethically engage in a transnational practice given the current structure of state-by-state bar admission. Part I examines the ethical pitfalls of a transnational practice, including an examination of applicable APA Model Rules of Professional Conduct. This section also addresses different tests for determining whether a lawyer has committed the unauthorized practice of law. Part III makes use of examples to illustrate the legal framework for determining whether a lawyer has committed the unauthorized practice of law. This Article examines the pressures of globalization on the practice of law and legal ethics from an Australian perspective. The Article first examines the positive aspects of globalization and then turns to the potentially disruptive and homogenizing aspects of globalization upon indigenous and non-Western societies. Next, the Article considers how globalization threatens to disrupt tradition and culture in Western societies, specifically focusing on the tradition of the law and legal practice. This Article explores the revival of interest in consumer protection in the United States, and the impact of this revival on the consumer movement. The Author examines the influence that political organizations and institutions have upon the final shape and content of consumer law in the United States and European Union. The Article begins with a general introduction to institutional theory across academic disciplines and to the institutional environment and arrangements in which consumer lawmaking proceeds in the United States and Europe. Red Light, Green Light: Has China Achieved Its Goals Through The 2000 Internet Regulations?, Clara Liang

In the mid-1990s, when the Internet began to burgeon in China, many thought that the rule of the Chinese Communist Party (CCP) would finally come to an end. The combination of foreign capital and trans-border information exchange promised a potential influx of democratic ideas and ideals. The CCP responded with both physical and regulatory limits on the use of the Internet by the Chinese people. Some commentators characterized these limits as feeble attempts by the CCP to control a nebulous medium. Others viewed the limits as ineffective steps by the government to become a highly developed authoritarian state.

United States courts have only incomplete and uneven jurisdiction, most acquired piecemeal and only in recent years, to prosecute genocide, war crimes and crimes against humanity committed outside our borders. Recent developments in international law and practice-especially the heightened commitment of democracies including the United States to end impunity for atrocities, and the imminent prospect of a permanent International Criminal Court (ICC) with worldwide jurisdiction-suggest the need to expand and rationalize the jurisdiction of U.S. courts to make it coextensive with that of the ICC.

This response begins by addressing the different perspectives as presented by the panel “Sex, Lies and Exploitation.” One of the panelists, professor Plasencia, presented a powerful and graphic documentation of digital communication’s influence on the sex industry. Some of the images involved explicitly portrayed the sex trade while in others, it was portrayed more subtly as an arranged or mail-order marriage. The author's response to professor Plasencia is mixed. On the one hand, it is rather easy these days for one to mistakenly encounter a sexually explicit website. James Gordon Bennett., owner of the New York Herald, was the visionary founder of the Casino Theatre at Newport, Rhode Island. The Casino, a complex located on fashionable Bellevue Avenue, was recognized as the first complete resort facility in America. The theatre was an integral part of this complex. Between 1879 and 1881, this showcase was designed by the New York firm of McKim, Mead & White. White designed the theatre.
It is important to recognize that theatrical productions were a notable component of Newport life from pre-Revolutionary times. These theatrical endeavors were a prelude to the Newport Casino Theatre. …

Landpower And Crises: Army Roles And Missions In Smaller-Scale Contingencies During The 1990s, Conrad C. Crane Dr.

The author analyzes the role of landpower in the 170 smaller-scale contingencies conducted by the United States during the last decade. He divides such contingencies into engagement, enhanced deterrence, hostility, and stabilization phases, and discusses the military's role in each one. The author especially emphasizes the recurring problems in the planning, execution, and force structure for stabilization tasks, including nation-building. He concludes that, despite the desire of American leaders to limit military involvement in such missions, it is unavoidable because of the capability mismatch between military and civilian organizations, combined with the requirements of peace operations and the character of …

U.S. strategy in the Balkans and the Army's role there is examined. The author recommends continued U.S. involvement, consideration of a long-term American military presence in the region, and some significant changes in role of the U.S. Army. The goals that led the United States into the Balkans have not yet been fully met. To do so requires both sustained involvement in that region and a continued refinement at the Army's peace operations capabilities. From a broader perspective, he argues that, if U.S. political leaders decide that involvement in protracted peace operations will be an enduring part of American strategy, …

The United States Court Of Appeals For The Federal Circuit: The Promise And Perils Of A Court Of Limited Jurisdiction, Randall R. Rader
The Honorable Helen Wilson Nies Memorial Lecture
The Honorable Randall Rader discusses current criticisms of the Federal Circuit and the speed of which the Circuit sets precedent. Before addressing these issues, he posits a belief that the standard by which the Circuit is being judged is incorrect. Judge Rader's speech gives a foundation by which a correct standard should be exacted, examples of the current atmosphere leading to the precedents being set, and generally addresses why the Federal Circuit is fundamentally unique from other jurisdictions.

DNA typing has had a major impact on the criminal justice system. There are hundreds of opinions and thousands of cases dealing with DNA evidence. Yet, at virtually every stage of the process, there are important issues that are just emerging or that have been neglected.
At the investigative stage, courts have barely begun to focus on the legal limitations on the power of the police to obtain samples directly from suspects and to use the data from DNA samples in various ways. Issues such as the propriety of "DNA dragnets" (in which large numbers of individuals in a geographic …
