Medical Error Reporting: Professional Tensions Between Confidentiality & Liability, Wendy K. Mariner, Frances H. Miller

Improving patient safety depends on a sophisticated understanding of what can jeopardize it. Reports of adverse patient events and "near misses" constitute valuable information that can foster that understanding. Knowing what has gone wrong in the past facilitates the search for systems improvements, which can prevent recurrence. Unfortunately, providers have been generally unenthusiastic about reporting medical error, whether from a sense of shame, from a fear of liability and institutional sanctions, or from anxiety about reputation and relationships with peers. This Issue Brief lays out the factors that may affect reporting, and explores the limited evidence about whether providers' confidentiality …

In Strickland v. Washington, the Supreme Court sought to create a uniform standard to guarantee effective assistance of counsel to criminal defendants, to "ensure a fair trial," and to assure the reliability of "a just result."' Justice O'Connor's majority opinion created a two-pronged test for overturning a trial verdict: deficient performance and resulting prejudice. The Court explicitly established a difficult burden for proving deficient performance,2 but set a moderate standard for prejudice as the "reasonable probability that, but for counsel's unprofessional errors, the result of the proceeding would have been different. According to Section 512 of the Quality and Work Responsibility Act of 1998, “every adult resident of public housing will be required to perform eight hours of community service each month, or participate in a self-sufficiency program for at least eight hours every month. This requirement does not apply to elderly persons, disabled persons, persons already working, persons exempted from work requirements under State welfare to work programs, or programs receiving assistance under a State program that have not been found to be in non-compliance with such a program” (Hunt, Schulhof, Holmquist, 1998: 5). The much-publicized low-level giving of Catholic donors versus other denominations has been the source of much debate and a rich topic for many research studies and reports, especially within the last 10 years. The major focus of this current study was to show that Catholics are indeed generous and to seek factors that lead to their giving. The positive aspects of Catholic generosity were sought, rather than focusing on negative factors serving as barriers to giving.

A self-administered questionnaire was sent to 208 known Catholic donors of the Diocese of Oakland in California during its Annual Bishop's Appeal. Donors who …

Congress has overlooked a powerful tool for regulating within state jurisdictions: the Property Clause of the United States Constitution. The United States Government owns land in every state and approximately thirty percent of the total land in the United States. The federal government's authority to regulate its property within states derives from the Property Clause and has been described by the Supreme Court as "without limitation."

Professor Appel traces the historical development of the Constitution's Property Clause, from its pre-constitutional origins through modern Supreme Court decisions and academic conceptions. Professor Appel compares the narrow view of Property Clause scholarship - …

Identification of resilience factors in adolescents is necessary to promote health and decrease the incidence of negative health outcomes related to risk-behaviors in this age group. The purpose of this descriptive-correlational research was twofold: (1) to investigate the inter-relationships of perceived health status, perceived self-efficacy, resilience abilities, self-care agency and self-care practices in adolescents and (2) to evaluate a revised measure, The Solem Adolescent Resilience Abilities Scale (SARAS-R). Orem's self-care theory was used as the theoretical framework for this study. Ortho-Planar Linear-Motion Springs, John J. Parise, Larry L. Howell, Spencer P. Magleby

This paper presents an ortho-planar spring design that operates by raising or lowering its platform relative to the base with no rotation. The compact nature of the design, and its non-rotating motion, eliminates the problem of rotation against adjoining surfaces and is less sensitive to variation in assemblies than many current compact springs. Nomenclature is presented to identify different configurations, mathematical equations are provided that accurately model the force-defection relationships, and a pneumatic valve positioner application is demonstrated.
