Inalienable Rights, Legal Enforceability, And American Constitutions: The Fourteenth Amendment And The Concept Of Unenumerated Rights, Thomas B. Mcaffee Jan 2001

Inalienable Rights, Legal Enforceability, And American Constitutions: The Fourteenth Amendment And The Concept Of Unenumerated Rights, Thomas B. Mcaffee

Scholarly Works

It has become common to believe that those who ratified the Fourteenth Amendment “incorporated” not only the specific guarantees of the federal Bill of Rights, but also the other fundamental rights “retained by the people” in the Ninth Amendment. Even among those who acknowledge that the Ninth Amendment was originally a “federalism” provision that simply “retained” all that had not been granted as “powers” to the federal government are those who contend that, in light of the adoption of similar provisions in the state constitutions, by 1866 this language had become a free-floating affirmation of unenumerated rights. This Article attempts …

Technology Assisted Life Stories, Gary R. Harlow Jan 2001

Technology Assisted Life Stories, Gary R. Harlow

Open Access Master's Theses

A pilot project was undertaken to test an emerging technology with a view to examine the feasibility of assisting older participants in the telling of their life stories. With the use of a digital recorder and voice-to text software, ten older persons were freed from the labor of creating a formal record of their life stories, either through typing ,writing, or manual transcription of audio tape. Extemporaneously, on a hand-held recorder, and in a one-on-one interview format, each participant's voice was converted to digital form as the narration proceeded. This digital recording was then transcribed electronically into a computer, which …

Cultural Predictors Of Asian/Pacific Islander Women’S Hiv/Aids Protective Behaviors, Jennifer C. Huang Jan 2001

Cultural Predictors Of Asian/Pacific Islander Women’S Hiv/Aids Protective Behaviors, Jennifer C. Huang

Open Access Master's Theses

Understanding the HIV/AIDS risk behaviors among heterosexual Asian/Pacific Islander (API) women requires an examination of the circumstances which place heterosexual women at risk of AIDS, as well as the cultural factors which affect API sexuality. Research has been conducted on samples of women, one of the fastest growing populations to be infected with HIV/AIDS, as well as API populations, who are susceptible to HIV infection as any other ethnic group. There is, however, a paucity of research concerning the sexuality of API women. Previous research regarding HIV/AIDS risk factors for women may not be culturally sensitive. Additionally, research pertaining to …

Beliefs About Women Held By African American Women And Men Differing In Level Of Acculturation, Jean M. Jacob Jan 2001

Beliefs About Women Held By African American Women And Men Differing In Level Of Acculturation, Jean M. Jacob

Open Access Master's Theses

Sixty-five African American women and 63 African American men completed research questionnaires examining beliefs about women of different ethnicities and income levels. Data were analyzed to determine if beliefs varied as a function of: participant gender, level of acculturation, and stage of racial identity; and on the basis of the target woman's ethnicity and income level. Data revealed that participants attributed more favorable descriptors to higher income targets regardless of ethnicity. Also, this study found that participants rarely used descriptors contained on inventories such as the Bern Sex Role Inventory (BSRI). Overall, the results suggest that prior research examining beliefs …

The Development Of A Measure Of Attention In Children, Janette Baird Jan 2001

The Development Of A Measure Of Attention In Children, Janette Baird

Open Access Master's Theses

A study was conducted to evaluate the effectiveness of a Preschool Measure Of Attention (PMA) to measure three factors of attention in young children; focus, shift and vigilance. The parents of 148 children rated their children on the PMA, a measure of temperament and on a scale of attentional problems. The results of the study suggest that two factors of attention; vigilance and focus/distractibility, were measured in this group. Age differences in the performance of the sample on these attentional factors were not found to be significant. However the age of the children accounted for 5 percent of the variance …

The East Greenwich Greenway Plan: A Strategy For The Commons, Greg S. Harris Jan 2001

The East Greenwich Greenway Plan: A Strategy For The Commons, Greg S. Harris

Open Access Master's Theses

This Greenway Plan has been prepared in response to increasing development pressure and a heightened local awareness of the need to conserve East Greenwich's open spaces, protect natural resources and water supplies, increase opportunities for passive outdoor recreation, and protect the town's historic rural and scenic characteristics. Changes are recommended to the Zoning Ordinance and the Development and Subdivision Review Regulations that will enhance the town's ability to preserve open space, including farms and ecologically significant corridors, and to incorporate interconnected trail networks between new subdivisions. Rapid changes to the town's character caused by residential growth have led to escalating …

Fluoroscopic Placement Of Double-Pigtail Ureteral Stents., Gregory L. Chen, Demetrius H. Bagley

Department of Urology Faculty Papers

Purpose: Double-pigtail ureteral stent is placed cystoscopically after ureteroscopy. We describe a technique for fluoroscopic placement of ureteral stents and demonstrate its use in a non-randomized prospective study.Materials and methods: Double-pigtail stents were placed either fluoroscopically or cystoscopically in 121 consecutive patients. In the fluoroscopic method, the stent was placed over a guide wire using a stent pusher without the use of cystoscopy. Conversely, stents were placed through the working channel of the cystoscope under vision. The procedure, stent length, width, type, method, ureteral dilation, and use of a retrieval string were noted. Results: A wide range of stent sizes were …

Empirical Model For The Variarion In Concentration Of Metal Ions During A Precipitation Event, David M. Chittenden Ii, Julie D. Chittenden Jan 2001

Empirical Model For The Variarion In Concentration Of Metal Ions During A Precipitation Event, David M. Chittenden Ii, Julie D. Chittenden

Journal of the Arkansas Academy of Science

The concentration of a pollutant in an air mass and the concentration of that pollutant in a series of rain water samples from a single event within that air mass, fluctuate during the course of the event. This the result of scavenging, diffusion, and advection processes. A simple mathematical model, containing only a scavenging term has had limited success in describing changes of concentration in rain water. To date, no attempt has been made to include diffusion or advection terms in the model. In this study, a two factor model was developed after determining that (1) the exponential scavenging term …

Early History Of The Wolf, Black Bear, And Mountain Lion In Arkansas, Annalea K. Bowers, Leah D. Lucio, David W. Clark, Susan P. Rakow, Gary A. Heidt Jan 2001

Early History Of The Wolf, Black Bear, And Mountain Lion In Arkansas, Annalea K. Bowers, Leah D. Lucio, David W. Clark, Susan P. Rakow, Gary A. Heidt

Journal of the Arkansas Academy of Science

During the nineteenth century settlement of Arkansas, the red wolf (Canis rufos), black bear (Ursus americanus), and mourtain lion (Puma concolor) were not only the three largest and most dangerous predators, they also stirred the imaginations of explorers and settlers. References to these species appeared prominently in the journals of early explorers such as George W. Featherstonhaugh (1844) and Frederick Gerstaecker (1854), and their presence inspired voluminous collections of stories and tall tales. Black bears were so common that a large trade developed in pelts, oil, and other body parts, and Arkansas became commonly known as "The Bear State." Wolves …

Molecular Orbital Studies Of Nitrosyl Metalloporphyrin Complexes, John P. Graham, Genevive Brown Jan 2001

Molecular Orbital Studies Of Nitrosyl Metalloporphyrin Complexes, John P. Graham, Genevive Brown

Journal of the Arkansas Academy of Science

Molecular orbital calculations are applied to the study of the structure and bonding of nitrosyl metalloporphyrin complexes. The Fenske-Hall approximate molecular orbital method and the Amsterdam Density Functional (ADF) method are used. The calculations provide qualitative and quantitative explanations for the observed structural differences between the nitrosyl porphyrin complexes ofiron, manganese, and cobalt. It is proposed that the energy of the highest occupied molecular orbital (HOMO) of these complexes is primarily responsible for the observed structural differences. The interaction between the nitrosyl ligand and metal dz2 orbital results in an antibonding orbital that is occupied in the complexes of Fe …

Distribution And Status Of Ophiogomphus Westfalli (Ondonata: Gomphidae) In Missouri And Arkansas, George L. Harp, Linden Trial

Journal of the Arkansas Academy of Science

Ophiogomphus westfalli is endemic to the Interior Highlands (Ozark Plateaus and Ouachita Mountains), in Missouri, Arkansas and southeastern Kansas. First described in 1985, its life history is still little known. Prior to 1997, this species was known from only six sites in Missouri and 10 in Arkansas. From late May through late July in both 1999 and 2000 we surveyed 49 sites, three of them twice each, on Missouri Ozark streams inorder to further clarify the distribution and relative abundance of this dragonfly. Adults, nymphs and/or exuviae were found at 23 sites. Literature and museum searches bring to 72 locations …

Perceived Damage By Elk In The Arkansas Ozarks, Jennifer H. Herner-Thogmartin, Kimberly G. Smith, Michael E. Cartwright Jan 2001

Perceived Damage By Elk In The Arkansas Ozarks, Jennifer H. Herner-Thogmartin, Kimberly G. Smith, Michael E. Cartwright

Journal of the Arkansas Academy of Science

Wildlife managers in Arkansas are faced with managing a growing population of Rocky Mountain elk (Cervus elaphus neloni) that has extended its range to incorporate private lands near the Buffalo National River (BNR) in northcentral Arkansas. This range expansion has created conflicts between private landowners and wildlife management personnel. To document the extent of damage and assess attitudes of landowners with elk on their land, interviews were conducted with landowners who contacted us or the Arkansas Game and Fish Commission about problems with elk. A survey also was created and sent to landowners who live near the BNR in Boone …
